Conditional Waiver. No critical area report is required for the project described above.
I . There will be no alteration of a Critical Area or its required buffer.
2. The proposal is an allowed activity pursuant to ECDC 23.40.220, 23.50.220, and/or
23.80.040.
3. The proposal is exempt pursuant to ECDC 23.40.230.
Erosion Hazard. Project is within erosion hazard area. Applicant must prepare an erosion and
sediment control plan in compliance with ECDC 18.30.
Critical Area Report Required. The proposed project is within a critical area and/or a critical area
buffer and a critical area report is required., A critical area report has been submitted and evaluated
for compliance with the following criteria pursuant to ECDC 23.40.160:
I The proposal minimizes the impact on critical areas in accordance with ECDC 23.40.120,
Mitigation sequencing;
2. The proposal does not pose an unreasonable threat to the public health, safety, or welfare
on or off the development proposal site;
3. The proposal is consistent w I ith the general purposes of this title and the public interest;
4. Any alterations permitted to the critical area are mitigated in accordance with ECDC
23.40.110, Mitigation requirements.
5. The proposal protects the critical area functions and values consistent with the best
available science and results in no net loss of critical functions and values; and
6. The proposal is consistent with other applicable regulations and standards.
F-J Unfavorable Critical Area Decision. The proposed project is not exempt or does not adequately
mitigate its impacts on critical areas and/or does not comply with the criteria in ECDC 23.40.160 and
the provisions of the City of Edmonds critical area regulations. See attached findings of
noncompliance.
Fj Favorable Critical Area Decision. The proposed project as described above and as shown on the
attached site plan meets or is exempt from the criteria in ECDC 23.40.160, Review Criteria, and
complies with the applicable provisions of the City of Edmonds critical area regulations. Any
subsequent changes to the proposal shall void this decision pending re -review of the proposal.

It has come to the attention of the Building Division that
there is a potentially unstable stream bank on the east side
of your Droperty at the above address.
Section 7004 of the Uniform Building Code, as adopted by the
City, provides that when any existing embankment or fill on
private property has become a hazard, or endangers property,
or adversely affects the safety, use or stability of public
way or drainage channel, the owner of the property is responsible
for eliminating the hazard.
Prior obstruction and flooding of the subject drainage channel
has resulted in property damage along its course. Therefore.,
you are advised that during the rainy season, periodic inspection
of your portion of the bank will be necessary together with
possible preventitive maintenance measures.

SUBJECT: SLOPE STABILITY AT 535AND�539' HEMLOCK WAY
At your request, we have inspected the bank� adjacent to the creek
at the aforementioned residences. The bank appears to be fill,
and it is in excess of the permissible 2:1 slope. The top of the
bank at both houses shows cracks, indicative of soil movement.
Based on our field investigation, we are of the opinion that there
is -a potential for a slide at both residences.
Chapter 70 of the Uniform Building Code authorizes you to require
the home owners to stabilize the bank. This should be done in
order to protect the integrity of the drainage channel and insure
that the City is not liable for neglect.

The existing problems at this subdivision site have evolved,
for overa year. Each time the contractor attempted to correct
a problem it resulted in a worse situation. At present, Hemlock
Way in the area of this development is a shabby sight.
Initially, Jay Bollinger contacted me at the Public Works
counter. He was inquiring into�the engineering requirements for
the Gwinn subdivision so as to obtain building permits.
Through the course of events, three builders applied for
permits on four building sites. However, Jay Bollinger made
most of all the contact with the Engineering Dept. regarding
required improvements.
As work progressed, and became substandard in the public
right-of-way, Jay Bollinger personally and continually assured
me that he would take care of the problems. To date, Jay Bollinger
has been working in the public right-of-way without a permit ana
without inspections. The physical problems at the site are
worsening under his substandard work causing a large trench at
the entrance to the subdivision.
The subdivision bond was released by me considering that
the basic requirements had been met. Although some corrections
were needed at the time (and have since worsened due to building
activity), Jay Bollinger assured me that they would be corrected.
At that time, I told Jay Bollinger and Tony Pinto (the maker of
the bond) that I would release the bond. However, I stipulated
that the Engineering Division would not approve the building
permits for final occupancy until all problems had been cor-
rected. Both agreed.
At present, Jay Bollinger (the primary developer) claims
responsibility only for work under his own building permits (if
that much). He is now disclaiming any responsibility for work
in the right-of-way by saying that they are not his permits.
Also presently, Bob Bollinger is working in the right-of-
way without a permit in an attempt to gain occupancy for Paul
Ghenov. Mr. Ghenov is illegally occupying 535 Hemlock Way
C)
with no water meter hook-up.
