The City's Building Inspector has written a correction notice to Michel Construction which required the geotechnical engineer of record to inspect the wall and provide a report. The City is in receipt of the report and can provide you a copy via the Freedom of Information Act. Michel Construction will be submitting a revised shoring plan or revised retaining wall plan (designed and stamped by a licensed professional engineer) to correct issues addressed in, the report. The City may require a peer review of the proposal. If the builder has destroyed landscaping on your property, he is responsible for restoring the damage. However, this is a private matter between you and the builder/owner of the construction project. Regarding the surface of the roof, a brown roofing material was approved by the Architectural Design Board (ADB) through a public process. A Planning Division representative will contact the builder and request that he take action to address the concern you have expressed. Automobile access to the new building from Beck's Lane was the only feasible alternative for the builder because of the significant grade difference between the garage floor and Alder Street. Our City policy is not to post speed limits or place traffic calming devices in alleys, especially on steep slopes as exist on this particular alley. However, when the project is complete, we will have our Traffic Engineer monitor this situation to see if it may warrant such measures. Upon completion of construction of this project and the project at 5h and Walnut, the builders will be required to provide a new pavement overlay on the alley (Beck's Lane) from the new building west or your property to 5th Avenue. An adequate fence will be required to protect against falls and damage to the new building below, which should be the responsibility of the builder. We also request relief of any personal and property liability for the hazard involved in the 15 foot drop. The construction has destroyed much of the landscaping to the west of our building. The builder has promised verbally to cooperate in restoring the landscaping to our mutual satisfaction. The surface of the roof on the new building creates an intense glare on sunny or overcast days that is extremely unpleasant for the residents on the west end of our building. The builder is aware of our concern and has promised to investigate possible solutions, but to date has done nothing. The automobile access to the new building from Beck Lane is also a potential hazard. Coupled with the traffic from the new.building on Fifth and Walnut, Beck Lane will be heavily used. Because of the sharp crest of the hill, visibility at the top is extremely limited. The garage entrance of • the new building will be difficult to anticipate, especially with the garbage container planned for the SE corner of the building. Velocity on Beck's Lane should be limited to 5 mph, through the use of signs and bumper strips. • Lastly, the building has been under construction for over a year and is still far from completion. Meanwhile, we must endure the inconvenience of the destruction of our west landscape, dust, truck traffic, noise and an unattractive building site. . We request a written response to the points above. We urge vou to make a physical inspection of the site, including a visit to one of the ap-art'ments affected by the glare.
