2. Nature, Purpose of -Easement.
The parties desire to create and hereby do create a formal
agreement to establish an easement to constructr improve,
maintain and repair a subsurface pipline for the conveyance of
effluent (commonly called a "S-40R---ORa,,P), having not more than

following described portion of Parcel A:

A portion of this pipeline easement shall be a single
pipline used in common by the parties from a point of juncture
at T- on Parcel A to the public

Parcel A and a portion shall be used separately by the parties
consisting of branch lines from said point of juncture to the
respective residences of the parties on Parcels A and B.
The Grantor may make all normal residential uses of the
surface of said easement area and construct fencing and
landscaping. The Grantor shall not build any permanent
structure or cause any construction which will restrict access
f or construction or maintenance of the pipeline. The
Grantee(s), may pass over said easement area to cause repairs
and extensions as necessary, provided that full restoration of
landscaping improvements is effected.
The parties wish to formally dedicate and confirm in
writing the establishment of said easement and to state the
terms and conditions of its use and maintenance in a manner that
will meet the needs of each of the parties and apportion the
obligations of the parties in a reasonable manner.
3. Grant of -Easement..
The parties agree that the easement described above shall
be forever a pipeline easement for the joint and mutual use and
benefit of the parties as owners of their respective properties
or for their heirs, successors or assigns. Grantor hereby
grants and conveys to Grantee all such easement rights,
privileges, authority and interests in the above described
portion of Parcel A as is necessary to carry out the purposes of
this agreement. However, each of the parties disclaims, waives
and relinquishes aay claim of fee ownership interest in the land
of the other upon which said easement lies.

4. Maintenance.
The reasonable cost of any necessary maintenance, repairs
or upkeep of the improvements or facilities located on the
describea easement pursuant to the purposes of this agreement
shall be shared or allocated between the parties as follows:
(a) As to all common portions, the use of which is shared
by the parties, the cost shall be shared equally.
(b) As to portions which serve and benefit only one parcel
or the other the cost shall be borne solely by the party whose
property is so served and benefitted. .
(c) As to any improvements and modifications to the facil-
ities that are desired by one of the parties but not agreed to
by the other party, such expense shall be the sole obligation of
the party desiring same.
