letters on a raceway. The letters will be lit individually. Due to its proximity to residential
ievelopment, it seems more appropriate to use individual opaque letters.

arch of the parapet. Edmonds Community Development Code discourages the use of neon

No formal written publice comments have been received to date.
Summary:
In order to approve the application as submitted, the Architectural Design Board must find that
the proposed roof design is a modulated roof design as required by ECDC 16.50.020. See
Attachment 5.
1 As proposed, the project is consistent with the land use designation of the Comprehensive
Plan. It is up to the Architectural Design Board to determine whether the project is
consistent with the Urban Design Guidelines.
2. The proposal appears to be consistent with the bulk standards and use requirements of the
Zoning Ordinance, subject to the following conditions:
a. The applicant must submit height calculation information with the building permit, to
verify that the proposal will not exceed the maximum allowable height.
3. With the approval of the Board the proposal appears to be consistent with the requirements
of the criteria of ECDC sections 20. 10 and 20.12.

The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be

The above building permit application is hereby closed due to the following reasons:
The permit was applied for by King's Heating to install new direct vent furnaces
in the 2 upstairs retail spaces, as well as install new exhaust fans in the 2 new restrooms
and install makeup air to the lower hallway.
On October 12, 2009 1 was informed by Gary of King's Heating during a phone
conversation that due to differences between King's and the building owner, King's
would no longer pursue obtaining the permit. No fees had been collected for the permit
application, so no refund is needed.
The issues of work to be done were resolved in the following manner:
The direct vent furnaces were not installed; instead, electric baseboard
heaters were installed, which satisfied the code requirement for heating. it
was confirmed that a permit was obtained from L&I for this work. Also, it
is evident by the openable doors and windows in each space that sufficient
natural ventilation is provided in order to comply with code.
2. As there was some overlap, or redundancy, in the scope of work of the
mechanical permit and the shell and core permit (BLD2009-0142), the
owner was able to complete the installation and obtain approval for the
exhaust fans and makeup air within the scope of the shell and core permit.

monument sign and an internally illuminated wall sign.

The proposed project requires a Design Review. Projects that remain under the SEPA threshold
are reviewed by staff with the building permit and the design review is considered an
administrative Staff Decision subject to the requirements of ECDC 20.60 (Sign Code) and is a
Type I decision pursuant ECDC 20.01.003.A.
Analysis:
1. Location. The project site is located at 610 5 1h Avenue South. The site is zoned BD3 —
Downtown Business. The comprehensive plan designation for the site is Downtown
Convenience and it is located within the Downtown/Waterfront Activity Center overlay.
2. Sign type. There are two signs depicted in the application materials. One is an externally
illuminated monument sign and the other is an internally illuminated wall sign. Both sign
types are conditionally permitted within the Downtown Activity Center.
3. Size. Sites within the BD zone are permitted 1 square foot of sign area per lineal foot of wall
containing the main public entrance. The site of Hamburger Harry's has 56 lineal feet of
frontage and is therefore permitted a maximum sign area allowed of 56 square feet. The
monument sign is 27.32 square feet and the wall sign is 21.97 square feet for a total sign area
of 49.29 square feet. The requested sign area is within the maximum allowed for the site.
4. Color. Both signs have red letters and yellow trim around an oval that circles "Hamburger
Harry's". The monument sign and background of the wall sign contain shades of brown
consistent with other colors used on the site. The colors are acceptable and are consistent
with those used throughout the site.
5. Height. Pursuant to ECDC 20.60.020.M.5, internally illuminated signs in the downtown area
are not permitted to be higher than 14 feet. The top of the internally illuminate wall sign is
proposed to be a 14 feet. Free standing signs within the BD zone can be a maximum of 14

feet in height according to ECDC 20.60.045.D. The proposed monument sign is 6 feet in
height. Both signs are consistent with the height requirements in ECDC 20.60.
6. Number. Pursuant to ECDC 20.60.045.F only one free standing sign is permitted per site.
There is potentially enough space for four businesses at this location. The proposed
monument sign would be the one allowed freestanding sign for the site. Since Hamburger
Harry's is using all of the space on the one allowed free standing sign, the City requested
approval in writing from the property owner giving Hamburger Harry's permission to use all
of the space on the one allowed free standing sign. The property owner gave permission to
allow Hamburger Harry's to have the only free standing sign. See the attached email
correspondence with Timothy Linehan, property owner.
7. Landscaping. Free standing signs must have a landscaped area twice the size of the sign area
at the base of the sign. Since the monument sign has a sign area of 27.32 square feet, a
landscaped area of at least 54.64 square feet must be provided at the base of the monument
sign. The application materials indicate an 8 by 8 foot landscaped area at the base of the sign
which is consistent with the landscaping requirements.
Decision:
Based on the facts and conclusions of this report, staff finds that the design review for this
project (File No. BLD20100156) is APPROVED.

Just to clarify. Other businesses at the site can have signs on the buildings above their space, but only one free
standing sign (sign not attached to a building) on the site is allowed. Some places, like the Gregory just down the
street, have monument signs designed so more than one business can have their information on the sign. Since
Hamburger Harry's is proposing to use all of the allowable space for the one free standing sign on the property,
we wanted a letter of consent from the property owner.
So the other businesses will be allowed signs on the buildings over their space, but you are giving permission to
Hamburg Harry's to have the only free standing sign.

I received some color samples for the old 5th Avenue Grill site @ 610 5th Avenue South, file BLD-2009-0142. I
have a question... I drove by the building and noticed that the new paint was neutral but that the north elevation. .
is still dark red and the east elevation is still mustard yellow.old colors I wasn't sure if the exterior painting was
complete or if the mustard yellow was going to be painted neutralto match the new colors? Do you happen to
know? the new colors will match neutral stucco The color samples indicate that the "body on north/westleast
elevation of restaurant to match" yes we have not painted yet we wanted to get ok of colors ... we did

3.0 DESCRIPTION
3.1 General
Magna Wall Fiber -Reinforced Stucco System is an exterior
cementitious wall finish consisting of a proprietary mixture of
Portland cement, water, sand, synthetic fibers, and
proprietary admixtures. The products are applied onto wire
fabric or metal lath, that is mechanically fastened to the
framing members. The system is intended for application over
foam plastic boards, fiber board, plywood, oriented strand
board, gypsum sheathing or GP Gypsum Dens -Glass Gold
Sheathing substrates and attached to wood- or steel -framed
exterior wall construction. The Magna Wall Stucco system is
also applied directly over concrete or unit masonry substrates
with or without lath.
3.2 Materials
3.2.1 Magna Wall Fiber -Reinforced Stucco: A factory -
prepared mixtureofType 1, 11 orIll Portland cement complying
withASTM C 150, synthetic fibers and proprietary admixtures.
The mixture is packaged in 80 pound (36 kg) bags. Five to
seven gallons (119 to 27 L) of water and 180 to 220 pounds
(82 to 100 kg) of sand are mixed with each bag in the field.
The product is also available in a factory -mixed pre -sanded
form requiring only the addition of 2 to 4 gallons (8 to 15 L) of
water. When required, colors may be added in accordance
with the manufacturer's instructions.
As an alternative to 80 pound (36 kg) bags, the stucco mix is
also available in bulk containers that are mixed at a
manufacturing plant. The bulk products consist of two types,
either the dry stucco mix pre -mixed with sand, or the dry
stucco mix and sand contained in separate compartments
within the bulk container and mixed at the site. The bulk
container is delivered to the job site and field -mixed with
water. The following conditions shall apply regarding the use
of the stucco mix in bulk containers:
3.2.1.1 The bulk container shall bear an identification label
information stated in Section 5.0 of this report.
3.2.1.2 A signed certificate from the manufacturing plant for
each unit, stating the plant name and address, job site and
address, date of manufacture, quantity and curing
instructions. The ratio of batched sand amount. to be
combined with each 80 pounds (37 kg) of stucco mixture shall
be stated in the certificate.
3.2.1.3 Procedures shall be provided to prevent tampering
with the controls on the amount of product mixture and sand
combined.
3.2.1.4 The stucco, sand and water ratios stated in Section
3.2.1 shall be maintained and verified by Magna Wall
3.2.2 Sand: Clean and free from deleterious amounts of
loam, clay, silts, soluble salts, and organic matter. Sand
gradation shall comply with ASTM C 144, as stated in Table
1 .

3.2.3 Lath
3.2.3.1 Wire -fabric Lath: Minimum No. 20 gage, 1 inch
(25.4 mm) galvanized steel, woven -wire fabric. Other laths
shall comply with ASTM C 933 (welded) and ASTM C 1032
(woven). Wire -fabric lath shall be self -furred when applied
over all substrates except unbacked polystyrene. Self -furring
lath shall be used in accordance with the following
requirements:
3.2.3.1.1 The maximum overall wall coating thickness, using
the minimum wire noted in Section 3.2.3.1 of this report, shall
be 1/, inch (12.7 mm).
3.2.3.1.2 Furring crimps shall occur at maximum 6 inch (152
mm) intervals each way. Furring crimps shall provide a
minimum '/, inch (3.2 mm) clearance from the substrate after
installation.
3.2.3.2 Metal Lath: Lath shall comply with ASTM C 847,
with a minimum weight of 1.75 pounds per square yard (0.67
kg/M2) . Furring and self -furring requirements shall be as set
forth for wire -fabric lath.
3.2.4 Substrates
3.2.4.1 Foam Plastic Board: Foam plastic formed from
expanded polystyrene resin, with a maximum flame spread
index of 25 or less and a smoke -developed index not
exceeding 450 when tested in accordance with ASTIVI E 84 in
the thickness intended for use. The foam boards shall have
a minimum nominal density of 1.5 pounds per cubic foot (24.0
kg/m3). When used over open stud framing, the boards shall
be a minimum of 1 inch (25.4 mm) thick and have a 3/, inch
(9.5 mm) projecting tongues with compatible grooves for
horizontal joints. See Figure 1 for joint detail. Foam plastic
boards installed over solid substrates are permitted to have
a minimum thickness of '/, inch (15.9 mm). The maximum
board thickness shall not exceed 4 inches (25.4 mm). The
insulation board shall be labeled in accordance with
Condition of Use 7.8 of this report.
3.2.4.2 Exterior Gypsum Sheathing Board: Water-
resistant core gypsum sheathing complying with ASTM C 79,
minimum '/2 inch (12.7 mm) thick.
3.2.4.3 Dens -Glass Gold Sheathing:, Noncombustible,
resinous coated, glass -fiber mat faced, water-resistant
sheathing, minimum '/2 inch (12.7 mm) thick, manufactured
by G-P Gypsum Corporation (see NER-574).
3.2.4.4 Fiberboard: Asphalt impregnated fiberboard
complying with ANSI/AHA A194.1 for regular density
sheathing, min iMUM 7/" inch (11. 1 mm) thick.
3.2.4.5 Plywood: Exterior or Exposure 1 complying with US
DOC PS 1. Minimum panel thickness shall be '/,, inch (7.9
mm) thick for studs spaced a maximum of 16 inches (406
mm) on center, and minim U M 3/" inch (9.5 mm) thick with
exterior glue for studs spaced a maximum of 24 inches (610
mm) on center. Plywood shall be installed in accordance with
a nominal '/, inch (3.2 mm) spacing between sheets at ends
and sides.
3.2.4.6 Oriented Strand Board: Exposure 1, performance -
rated panels, complying with US DOC PS 2, minimum 3/, inch
(9.5 mm) thick. Panels shall be installed in accordance with
a nominal '/, inch (3.2 mm) spacing between sheets at ends
and sides.
3.2.5 Sealants: Minimum of an acrylic latex sealant
complying with ASTM C 834.
3.2.6 Weather -resistive Barrier: A minimum of one layer)
of a weather -resistive barrier complying with the requirements
of Chapter 14 of the applicable Code (Chapter 7 of the
International Residential Code). E.I. DuPont Tyvek
StuccoWrap is also permitted for use as an alternative to the
weather -resistive barrier prescribed by the applicable code.
3.2.7 Flashing, trim and accessories: All flashings, trim,
weep screeds, and corner reinforcement shall be of
corrosion -resistant metal or approved plastic. Flashings shall
be designed and installed to direct moisture from behind the
system to the exterior of the cladding. Flashings shall be
installed at the perimeter of all penetrations of the system.
The weather -resistive barrier shall be shingle lapped over the
nailing leg of the flashing in a manner to shed water.
4.0 INSTALLATION
4.1 General
All substrates on which the stucco products are intended to
be installed shall be covered with a minimum of one layer of
the weather -resistive barrier stated in Section 3.2.6 of this
report. The weather -resistive barrier is permitted to be omitted
when the stucco is installed directly over cast concrete or unit
masonry substrates.
Flashing, corner reinforcement, metal trim and weep screeds
shall be installed as shown in this report. Weep screeds are
installed at the bottom of the wall a minimum of I inch (25.4
mm) below the plate line, and a minimum of 4 inches (102
mm) above grade. The screed shall comply with the
applicable code requirements and shall allow trapped water
to drain to the building exterior.
The weather -resistive barrier, lath, and foam plastic board
(when used) shall lap over the nailing leg of flashings and
weep screeds as shown in the standard details at the end of
this report.
At building corners, the stucco is permitted to be installed with
either a square or rounded detail as shown in the details at
the end of this report.
Corrosion -resistant fasteners for lath attachment to wood
framing members shall penetrate a minimum of 1 inch (25.4
mm) into framing members. When the substrate consists of
plywood or oriented strand board as stated in Section 3.2.4.5
or Section 3.2.4.6 of this report, the thickness of the
sheathing is permitted to be considered in determining the 1
inch (25.4 mm) fastener penetration requirement. Fasteners
for lath attachment to steel framing shall penetrate a minimum
of 1/4 inch (6.4 mm) beyond the steel framing. The lath shall
be embedded in the coating and shall be completely covered.
The exterior cementitious coating shall be applied by hand-'
troweling or machine spraying in one or two coats at minimum
nominal '/, inch (9.5 mm) overall thickness, except where self -
furring wire lath is used (see Section 3.2.3.1). The coating
shall be applied at ambient air temperatures between 35 and
120 degrees F (2 and 49oC) by applicators approved by
Magna Wall, Inc. After application, the coating shall be

protected from freezing air temperatures during the initial six
hours of curing. The second coat, when provided, shall be
applied within seven days after the first coat. If the second
coat is not installed within seven days, a bonding adhesive,
complying with Military Specification MIL-B-19235, shall be
brushed or sprayed on the base coat or a bonding treatment
shall be added to the mix of the second coat prior to
application over the base coat.
Where the coating is job -mixed, an installation card, as noted
in Figure 4 of this report, shall be.provided on the job -site
with the name of the applicator and the product to be used,
before any weather -resistive barrier or exterior sheathing is
installed. Also, see Section 7.6 of this report.
4.2 Application Over Open Framing
The weather -resistive barrier described in Section 3.2.6 of
this report shall be placed over open wood or steel framing.
The framing shall be spaced a maximum of 24 inches (610
mm) on center. Wall bracing, in accordance with the
applicable code, shall be installed. The foam plastic board
described in Section 3.2.4.1 of this report shall be placed
horizontally with the tongue facing upward in 2 foot by 8 foot
(610 mm by 2438 mm) sections and temporarily held in place
with galvanized staples or roofing nails. Self -tapping screws
shall be used to temporarily fasten the board to metal
framing. Vertical butt joints of the foam boards shall be
staggered a minimum of one framing space from the adjacent
courses and occur directly over framing. In applications where
the foam plastic board abuts a solid substrate, the butt joints
in the foam plastic boards shall occur over a vertical framing
member. The foam plastic board is permitted to be omitted
where a solid substrate occurs. When the foam plastic boards
are installed over a solid substrate, the vertical butt joints in
the foam plastic are not required to occur over vertical
framing or to be staggered.
The lath shall be installed over the foam plastic board and
shall be fastened through the board to wood framing with
minimum 2 inch (51 mm� long, No. 11 gage [0.148 inch (3.75
mm) shaft diameter], /, inch (9.5 mm) diameter head]
galvanized roofing nails or No. 16 gage [0.0625 inch (1.59
mm) shaft diameter, minimum '/, inch (12.7 mm) crown width]
galvanized staples. Fasteners shall be spaced a maximum of
6 inches (152 mm) on center and shall be of sufficient length
to achieve a minimum 1 inch (25.4 mm) penetration into the
wood framing. The use of staples shall be limited to
installations where the wood species has a minimum specific
gravity of 0.42. The lath shall be fastened to steel framing
members [minimum No. 20 gage [0.0359 inch (0.912 mm)
thick]] using No. 8-18, S-12, panhead, self -tapping screws
spaced a maximum of 6 inches (152 mm) on center. The
screws shall be of sufficient length to penetrate the steel
framing members a minimum of '/, inch (6.4 mm). The wire
lath shall be applied with a minimum overlap between sheets
of 1 inch (25.4 mm) at both ends and sides. The metal lath
shall be applied with a minimum overlap of'/2 inch (112.7 mm)
at the sides and 1 inch (25.4 mm) at the ends.
The weather -resistive barrier, lath and foam plastic board
shall lap over the nailing leg of the flashing as shown in the
standard weep screed details at the end of this report.
Corrosion -resistant weep screeds shall be installed at all
locations where the horizontal edge of the foam plastic board
is exposed after application of the stucco coating. Corrosion -
resistant casing beads shall be installed at all locations where
the vertical edge of the foam plastic board is exposed after
application of the stucco coating. The evaluation of the this
system is limited to use where penetrations through and
terminations of the system are provided with flashing. The use
of the system where sealant is the sole means of sealing
penetrations is outside the scope of this report.
At penetration locations, such as windows and doors, the
foam plastic board is permitted to be beveled at a 45 degree

angle as shown in the details at the end of this report. At
building corners, the stucco is permitted to be installed with
either a square or rounded detail as shown in the details at
the end of this report. When a rounded corner detail is
provided, the foam plastic boards shall be held back slightly
at each corner and additional corner reinforcement is not
required. Where square corners are provided, metal corner
reinforcement shall be installed.
4.3 Application Over Solid Substrates
All solid substrates, except for concrete and unit masonry,
shall be covered with a minimum of one layer of weather -
resistive barrier as described in Section 3.2 6 of this report
and the metal lath described in Section 3.2.3 of this report.
The installation of foam plastic boards over solid substrates
is optional and shall be governed by the conditions stated in
this report. When foam plastic boards are installed over solid
substrates, the length of the fasteners used to attach the lath
shall be increased by the thickness of the foam boards.
The weather -resistive barrier, flashings, accessories, metal
lath and coating shall be installed as described in Section 4.0
and Section 4.3 of this report. Foam plastic insulation
installed prior to lath installation shall be a minimum '/, inch
(12.7) thick. When the system is installed over a foam plastic
substrate, the weather -resistive barrier shall be installed over
the EPS, except in areas adopting the Standard Building
Code or Uniform Building Code, where the barrier is permitted
to be installed behind the foam. When Tyvek StuccoWrap is
used as the weather -resistive barrier, the barrier is permitted
to be installed behind the foam for all applications. The
installation of the weather -resistive barrier shall be as stated
in Section 4.1 of this report.
At building corners, the stucco is permitted to be installed with
either a square or rounded detail as shown in the details at
the end of this report. Both square and rounded corners shall
be provided with metal corner reinforcement.
In addition to the requirements stated in this section,
Sections 4.3.1 through 4.3.5 of this report contain
requirements specific to the use of the coatings over specific
substrate types.
4.3.1 Exterior Gypsum Sheathing: Water-resistant core
gypsum sheathing, complying with Section 3.2.4.2 of this
report, shall be installed directly to wood or steel framing with
studs spaced a maximum of 24 inches (610 mm) on center.
The gypsum sheathing shall be fastened to wood framing with
minimum I'/, inch (38 mm) long, No. 11 gage [0.148 inch
(3.75 mm) shaft diameter, 0.438 inch (11.1 mm) head
diameter] galvanized roofing nails or No. 16 gage [0.0625
inch (1.59 mm)] shaft diameter]] galvanized staples spaced a
maximum of 6 inches (152 mm) on center at the edges and
at intermediate supports. For steel framing, the sheathing
shall be attached to No. 20 gage [0.0359 inch thick (0.91
mm)]) steel studs with No. 8-18, S-12 panhead, 1 inch long
(25.4 mm), self -tapping screws spaced a maximum of 10
inches (254 mm) on center to all framing members.
4.3.2 Dens -Glass Gold Sheathing: Dens -Glass Gold
sheathing, complying with Section 3.2.4.3 of this report, shall
be installed directly on wood or steel framing with studs
spaced a maximum of 24 inches (610 mm) on center. The
sheathing shall be fastened to wood or steel framing in
accordance with the requirements contained in NER-574.
4.3.3 Fiberboard: Fiberboard sheathing, complying with
Section 3.2.4.4 of this report, shall be installed directly to
wood or steel framing spaced a maximum of 24 inches (610
mm) on center. The walls shall be braced in accordance with
the requirements of the applicable code. The fiberboard shall
be temporarily held in place with corrosion -resistant staples,

The purpose of this letter is to follow-up with issues outlined in City letter dated June 20, 2007
(copy attached for your convenience):
• The City has completed review of the as -built floor plans prepared by Mr. Allen and we
have no further issues regarding the revisions made to the original plans prepared by Mr.
Manusos.
• Framing and insulation inspection approval has been granted to the original 'cooler area'
addition (upper and lower floors). Please contact the City Building Inspector for a
sheetrock nailing inspection when this work is done.
• City officials have verified that the lower floor is completely vacant and contains no
storage items or property. This lower floor is considered 'crawl space' thereby
eliminating the requirement for occupancy separations (fire walls) until a future use is
proposed and approved by the City.
• The Engineering Division has waived all exterior site improvements as shown on Sheet C
of the approved plans; if you have any questions contact Jeanie McConnell at 425-771-
0220 extension 1338.
• As building owner it is your continued responsibility to ensure that the interior stairwell
leading to the lower floor remains fully secured/blocked from access from the upper
floor.
• The City Senior Fire Inspector requires that the rear yard area be kept clean of debris,
cardboard and combustible items and be clear for fire fighter access at all times.

You have submitted a question that states "Do I need the 2 parking stalls that I am currently
renting from Bob Gregg?"
These two parking stalls were leased pursuant to building permit BP-2004-0562, which was a
buil ding permit to allow a remodel and small addition. As part of that permit, I had calculated
the parking required under the new parking code, which allows uses in the Downtown Business
Area to provide parking at a flat rate of one space per 500 square feet of gross floor area for non-
residential uses (8CDC 17.50.010.C). Using the area of 4,588 + 4,276 8,864 square feet, this
rounds to an 18 parking space requirement.
Prior to this permit, Planning Division staff had reviewed a building permit for a change of use
from banquet to retail, office and service uses.and had calculated the parking required under the
older parking code to be 21 stalls, and stated that three spaces were provided on-s.ite.
A barrier -free parking stall is required for this site, and in the creation of that stall under BP-
2004-0562, the existini parking was reduced in order to provide a driveway to the barrier -free
stall, and to provide the stall at the proper slope. In addition, the trash and recycling enclosure
had to be redone. These two requirements resulted in the elimination of two of the the three
parking spaces that had formerly been provided on the site.
Since this site was not providing adequate parking, it was not Allowed to reduce the minimal
number of parking spaces it was already providing, but was required to provide those spaces off -
site. That is why the additional two parking stalls are being leased from Bob Gregg.
Since nothing has changed in the parking requirements, size of the building, or parking provided
on-site�j then the two parking, stalls that were required with BP-2004-0562 are still required to. be
provided off -site.

Dear Shawn:
We have received your Architect's letter dated July 12, 2004, and faxed modified letter of
July 14, 2004, requesting a waiver from the entry width requirement from 24' to 17' and
provide the following determination.
Upon field investigation and review of your Architect's letter, we have concluded that;
due to the location of the buildings structural columns and the expense that would be
necessary to relocate them, the encroachment of an existing power pole guy anchor and c.
the fact the entry will only be utilized to access one handicap stall, we hereby grant
conditional approval of your request.
The existing 17 foot access between the building and columns can be utilized for access
to the one handicap stall on site. Approval of this request is restricted to handicap access
only. No other vehicles will be allowed to park on site. Signs shall be installed
indicating "no parking anytime" as noted on the approved drawings.
If other vehicles are found to be parking on site, other than the one authorized, this
approval shall be revoked and the required 24' wide entrance will be required.

If the 1/800 ratio is used for the office space 29 stalls are required.
Although the foyer and restroom areas are not in any one of the proposed tenant spaces, they are
included in the gross floor area of the building and over time and through redevelopment could be
included in the floor area of a specific use. That being the case, they are identified as General
Commercial in the table above and the Planning Division will apply the lowest parking requirement for this
type of building to those common areas; this would be the requirement for offices without on -site customer
service, 1 stall / 800 sq. ft. of gross floor area.
Based on the grandfathered number of parking stalls for the site, 18, and the number of stalls previously
permitted on the site, 3, it appears that 12 more parking stalls will be required to support the changes you
are proposing. These additional stalls may be provided through one of three ways. First, developing more
on -site parking. Second, by establishing a parking agreement with a nearby neighbor that has extra
parking. Or, finally, by paying into the City's In -Lieu fee for parking.

THIS INDENTURE OF LEASE, made and entered into this day by and between
B-T DEVELOPMENT CO., hereinafier called the LESSOR, and
Henry Arce AbaThe Arce Company hereinafter called the

WHEREAS, the LESSOR owns the following described real property situate in
the County of Snohomish, State of Washington, all as more particularly described on
Exhibit A, and represent in a sketch marked Exhibit B and attached hereto, which

hereinafter referred to as the "Premises", and
WHEREAS, LESSEE desires to lease and license the described premises and the

(a) The LESSOR represents that it has the full right, power and authority
to enter into this Lease for the terms herein granted and that the leased property may be

(b) USE- LESSEE shall use the premises for storage and growing
of supplies and plants to be used and/or sold in conjunction with business as conducted as
The Arce Company — and shall use the premises for any other purpose
with the consent of the LESSOR, nor shall LESSEE use the premises for illegal
purposes or create or maintain a nuisance thereon.
2. TERM: The term of this lease shall conimence on

I - LEASE
($300.00 payable in advance on the first day of each month, except as provided in the
following paragraph. LESSOR acknowledges receipt of the sum of
Three Hundred -Dollars ($300, 00 in payment of the first months rent, with
the balance of said sum being applicable to payment towards the last months rent when
said rent becomes due providing LESSEE has fully and faithfully performed the covenants
of this lease during its full term.
LESSEE agrees that any monthly rental payment due on the first of the month will
be made in a timely manner and that any payment made five (5) days or more after the first
day of each month shall carry a late payment charge of twelve percent (12%) on the
amount so due.
LESSEE agrees that the basic monthly rent, as of the first day of each month
commencing May - 1, 19 9 6 , shall be increased but not decreased by such
an attiount as will reflect the proportionate change between the Consumer Price Index for
all urban consumers of the Seattle -Everett area, Washington, as published by the United
States Department of Labor, Bureau of Labor and Statistics, for the first twelve months of
the term of this lease, and said Consumer Price Index, for each preceding fiscal year of this
Lease. Should the Bureau discontinue the publication of its Consumer Price Index, then
the computation of the adjustment of rent shall be the one said Bureau designates as
providing the most accurate comparison with consumer prices for each fiscal term of this
Lease. The parties recognize that the Consumer Price Index for the last month of the
initial year of this Lease may not be published at said time, and in such event, until such
Index is published and until LESSOR gives LESSEE written notice of.such Index
percentage change, the LESSEE shall continue to pay the LESSOR the basic rent in
monthly installments herein provided, plus ten percent (10%). On the first day of the
calendar month following such publication and notice, the rent shall be adjusted and the
LESSEE shall pay LESSOR any additional rent attributable to such Index for each and
every preceding month resulting from an increase of rent attributable to such Index. If the
adjustment of rent attributable to said Index is less than the ten percent (10%) adjustment
provided for above, then LESSEE may withhold from any subsequent monthly rental
payment the amount of overpayment which was incurred.
4. TAXES AND UTILITY CHARGES:
(a) LESSEE shall be liable for and shall pay throughout the term o*f this
Lease, all license and excise fees and occupation taxes coveting the business conducted on
or from the premises; all taxes on property of LESSEE on the premises and any sales or
rental tax which may hereafter be imposed upon the rentals payable hereunder.
(b) LESSOR shall be solely responsible for all real property taxes on the

(c) LESSEE shall pay for all charges for water, sewer, metro, heat, gas
and electrical power and other utility charges used by the LESSEE in his occupancy of the
leased premises.
5. ALTERATIONS:
(a) LESSEE agrees, as hereinabove provided, to accept the premises in
their present condition. LESSEE shall not make any alterations, additions or
improvements in the premises without the written consent of LESSOR and all alterations
or improvements shall be made at LESSEE'S expense and shall become the property of
the LESSOR and shall remain in and be surrendered with the premises as a part thereof at
the termination of this lease without disturbance, molestation or injury. If LESSEE shall
perform work with the consent of the LESSOR as aforesaid, LESSEE agrees to comply
with all laws, ordinances, rules and regulations of the pertinent and authorized public
authorities. LESSEE further agrees to save LESSOR free and harmless from damage,
loss or expense arising out of said work,
(b) All work shall be done in a good and workmanlike manner and shall be
done in such a manner as not to permit any liens to be filed against the property.
6. SURRENDER OF PREMISES- — At the expiration of its tenancy, LESSEE
shall surrender the leased premises in the same condition as they were upon delivery of
possess to LESSEE at the commencement.of this Lease term, normal wear and tear
expected.
7. ASSIGNMENT AND SUBLEASING: LESSEE shall not, without the written
consent of the LESSOR, let or sublet the whole or any part of the premises, nor assign,
voluntarily, involuntarily or by operation of law, this Lease or any part thereof LESSEE
shall continue to remain bound by the terms of this Lease in the event of any agreement by
the LESSOR to the subletting of or assignment of this Lease. If consent is once given by
the LESSOR to the assignment of this Lease or any interest therein, LESSOR shall not be
barred from afterwards refusing to consent to any further or subsequent subletting or
assignment.
8. INSURANCE: LESSEE shall, during the entire term of this Lease, keep in full
force and effect insurance with respect to the premises, and the business opetated.by the
LESSEE on the premises. LESSEE shall maintain an insurance policy or policies insuring
against bodily injury in sums of not less than ONE HUNDRED THOUSAND DOLLARS
($100,000) per person and THREE HUNDRED THOUSAND DOLLARS ($300,000)

tenant or contiguous tenants of the LESSOR, or any agent or 'servant or employee of
LESSEE.
(b) INSURANCE POLICIES: In respect to all insurance policies required
to be obtained by the LESSEE herein, copies of the policies shall be fumished to LESSOR
upon his request and demand. In every such policy a cancellation provision of not less
than thirty (30) days shall be made for written notification of cancellation to the LESSOR-
9. ATTORNEY FEES: All costs, expenses and reasonable attorney fees that may
be incurred or paid by either party in enforcing the covenants and agreements of this Lease
shall be recovered by the prevailing party from the other.
10. DEFAULT: If rent payable by the LESSEE to the LESSOR shall be and
remain unpaid for more than five (5) days afler the same is due and payable, or if LESSEE
shall violate or breach any of the other covenants, agreements, stipulations or conditions

and LESSOR shall not be liable for damages by reason of such reentry or forfeiture.

The leased property is located immediately West of the Baskin -Robbins Ice Cream Store, which
is owned by the said doctors and/or the Company.
Running Northwesterly from the Baskin -Robbins property (owned by the Company), is an eight
inch (8") storm and surface water drainage line, which drains and connects to a manhole located on the
Northwesterly portion of the Company's property.
Because of the inordinate amount of surface water run-off coming from the 610 Fifth Avenue real
property, the Lessee's have requested that the doctors and their Company grant the Lessee permission to
continue to use the connection to said storm and surface water drainage line, to reduce the surface water
problem which the"I'lic Arcc Company is having, and
FOR AND IN CONSIDERATION of the permission hereby granted to the Lessee to utilize

It's not just the parking memo that is misplaced, it is the entire street file. I don't feel very comfortable recreating the
parking memo for the site unless we have given up on finding the street file for the project. Right now I only feel good
about using the numbers that are written on the permit concerning parking.
About parking. I am aware of the codes prohibition of outdoor uses in the BC zone. I also informed Mr. Arce about that
and asked him about the seating under the awning. Mr. Arce informed me that because the building is a no smoking
building, he has those chairs for people who might want to go out for a smoke and no service is provided out there. Since
no service is provided out their, I left it at that.

combination of our not billing for 16 months and to the customers water leak.
1. am basing this reduction on the past two month (normal) consumption of 93 units then
multiplying it over three billing periods. This would be the time this restaurant opened in
June of 1996.
Also the owner, Henry Arce, in talking with Paul Mar, stated that we would allow them
to make partial payment arrangements until this bill is clear. In my conversation with Mr.
Arce, I have allowed him to pay this back payment at 25% per billing period. Again, his
current consumption total will show 279 units only after adjustment.

on Sth Ave 9 be designated as a Handleapped Parking only space.

ZONING REQUIREMENTS ON BC &'RM PROPERTY
As a result-of.complaints from adjacent property owners.this
Division has reviewed the use requirements for the property
occupied.by*your busines's and brings the following to your
attention:
1). Section 12.13.040(d) of the City Code requires a Conditional
Use Permit,for a plant nursery in a residential district.
You must, therefore., apply for such a permit for that portion
of your land.in the RM Zone'to.the west.
2) Section 12.13.200(g) of -the City'Code (Limitations'on Uses
In BC Districts) specifies that operations on the premises
sh*all*not constitute a nuisance by reason of noise beyond
the property boundary lines. tomplaiints; directed to.the
City by adjoining residents indicate'that they do�sider
the exterior loudspeaker system used in your. business a
nuisance.
3) Sound lev61 medsurements taken by this Division on May'3,
1977,.indicated that sound from the speaker can be heard
on -the complainants property. We, therefore., request that.*
use of the loudspeaker be terminat6d..
