for compliance with the following criteria pursuant to ECDC 23.40.160:

3. The proposal is consistent with the general purposes of this title and the public interest;

23.40.110, Mitigation requirements.
5. The proposal protects the critical area functions and values consistent with the best
available science and results in no net loss of critical functions and values; and
6. The proposal is consistent with other applicable regulations and standards,

GENERAL CONDRTIONS
1. Premises. The Customer is responsible for accurately informing CITY WIDE FENCE COMPANY, INC. ("CWF') and physically marking all property lines,
easements, right-of-ways, neighborhood and community covenants, and subsoil conditions prior to commencement of the work, including location ofavy burred pipes,
septic tan!(,,, sprinkler systems or drain fields. Otherwise, CW14- will assume all soil is clean, unobstructed. and of good bearing. CWF has not made any soil studies and
is thus proceeding with the construction on the assumption that the underlying soil or land is suit -able for the proposed construction, and no extra excavation or backfill
will be reqUired.The determination of any need for a soil analysis, as well as the cost of analysis, shall be paid by the customer. Any and all unmarked sprink!er lines
broken by CWF shall be repaired by the arrangement and expense of the Customer.

The Customer shall establish the finish grade, and clear the area in which the siructure is to -be installed, ofall obstructions, debris, brush and/or plants prior
to the set date. Any portion(s) of the area left uncleared by the Customer shall be cleared bN CWF's crews on the set date. Unless pre -arranged and included on the contract,
the Customer shall be charged $55.00 per man/per hour for clearing and/or grad . ing the %�ork. The Customer shall place all stakes clearly marking the placement of all
end, corner, and gate posts.
2. Changes In The Work. The Customer may request chan&es or modifications in the scope of work. These requests may be agreed upon orally or*in writing.
If agreed upon in writing, such changes or modifications shall be identified and agreed upon in a written change order prepared by CWF and signed by both parties. Unless
mutually agreed and signe(I by both parties in writing, all extra work directed by the Customer and performed by CWF shall be billed by CWF and paid by the Customer
at the flat fate of $55.00 per man/per hour for all labor plus 20 percent markup on all invoiced materials, subcontractors, equipment and permits and worker hours.
3. Registration And Bond Information. Current Washington law requires that this notice be provided on certain construction Projects. This notice is not a
reflection upon the abilities or credit of your contractor. If you are dealing with a lending institution, ask your loan officer what pro�edure the institution follows to verify
the subcontractor arid material suppliers,are being paid when either you or your lender pays money to your contractor. Request lender supervision when dealing with a
lending institution that provides interim or construction financing. See RCW 60.04.22 1. You may ask the contractor to disclose all potential lien claimants as a condition
of payment. You or your lender can, instead of making progress payments to your contractor, make numerous jointly payable checks to the contractor and the various
subcontractors and suppliers as work progresses. There may be an additional cost from your lender for this additional service. For an additional cost, you may Kqquest
your contractor post a perforniance bond. That will give you recourse in the event that the contractor fails to properly complete its obligation pursuant to this Agreement.
This will increase the price of the construction project. If you enter into a contract 10 construct a new residence or commercial structure, or renovate an existing commercial
structure, you may not receive a Notice of Right to Claim Lien from subcontractors who have contracted with the prime contractor.
CWF is registered with the State of Washington, Registration No. CITY)yFC 121 N9 as a specialty contractor and has posted with the State a bond of $6,000.00
for tbc*purpose of satisfying claims against the contractor for negfi ent or improper work or breach of contract in the conduct of the contractor's business. The annual
expiration date of CWF s registration is September 30th.-This bonTmay be renewed annually by the contractor. You should contact the State ofWashington Depar(i tent
of Labor and Industries (1 -800-647-0982) to determine the current regijtration status of CWF. This bond may not be sufficient to cover a claim which might arise from
the work done tinder your contract. If any supplier of materials used in your construction project or any emplovee of the contractor or subcontractor is not paid by the
contractor or subcontractor on yourjob, your property may be liened to force payment. If you wish additional �rotection. you may request the contractor to provide you
with original "lien release" documents from each supplier or subcontractor on your project. The contractor is required to provide you Nvith further information about Ilien
release document,. if you request it. General information is also availal�le from the Department of Lqbor and Industries.
4. Correciion Of Work. The Customer may hold b ck A in final payment an amount which the Customer reasonably believes to*be the estimated cost of
correcting or completing the work identified on this �single-p h Is. t. to be paid upon CWF's corrections of the work, completion of final miscellaneous work and final
cleaning or the premises. Ther� shzd�be no holdback fo-r wan iiity ork. The Customer shall assign a specific dollar amount to each item on the ilunchlist. deduct ihis"
amount from the final balance owing to CWF as CIF's f rial voice and shall pay the balance or the contract price to CWF at the time that the Customer�defivers
the signed written punch list to CWF. If requesteg A w in " 5C IF, the Customer shall promptly deposit the holdback amount into a joint signature interest bearing
account under the name,� of the Customer and CW to art lisb -sement based upon the subsequent agreement between the Customer and CWF, or based upon the
decision of the Arbitrator. CWF shall be paid all ap ue intei st o payments to C—,WF from this account. If the Customer does not deposit the holdback into said account
within seN en (7) days of receiving CWF's written,r1qu Vthi fail shall conclusively constitut� the Customer's waiver of any and all claims against CWF. The terms

6. Disputes and Remedy. If a dispute should arise between the parties, the parties shall promptly meet and attempt in good faith to resolve the dispute. Openness,
calm and good faith are required of both parties. Any unsettled.disputes between the parties shall be decided by a suit filed in an appropriate jurisdiQtiZynafnleis� the;parties

7. Warranty. CWF warrants that all labor, materials and taxes will be paid for, and there will be no potential lien claimants upon the completion of the work
and final payment by the Customer. All work will be performed in a commercially reasonable rnanner and that there will be no defects in workmanship. CWF will
promptly return to the project and repair or replace, as necessary, any defect in workmanship at CWF's sole expense. CWF's warranty is for a period oftwelve (12)
months from the date of this Agreement. Any claim or cause of action arising under the terms of this Agreement. including the warranty, must be filed in court or competent
jurisdiction within twelve (12) months from the date of this Agreement. Any claim or cause of action which is not timely filed is waived. Warranty work performed by
CWF does not extend the warranty. The warranty is void ifa person or Firm other than CWF performs or reperforms and work within the sco fthi Agreement. THIS
WARRANTY IS GIVEN IN LIEU OF ANY WARRANTIES OTHERWISE PROVIDED UNDER THE LAWS OF WASHINGTON OR FEDUL LAWS, INCLUDING
ANY EXPRESS OR IMPLIED WARRANTIES OF FITNESS, MERCHANTABILITY OR HABITABILITY. CWF is not responsible for consequential damages. In
the event that the Customer encounters a defect in the manufactured or supplied product, CWF shall assist the Customer in securing repair or replacement of these products
pursuant to the particular manufacturer's or distributor's warranty. CWF is not responsible for twisting of wooden posts. -
8. Interest. Any accrued balance owing and unpaid to the Contractor, regardless of whether the amount in dispute is liquidated or unliquidated, shall bear an
interest of 18% per annum.
9. Permits. Any building or other permits which must be obtained prior to installation of the structure shall be obtained and paid for by the Customer.
10. Delays. Should the Customer directly or indirectly cause delays or interruptions in the performance of CWF's work, the Customer agrees to compensate CW`F,
for its loss or extra expenditure of time on the project via the change order method as described in paragraph 2.
11. Credit Verification. This Agreement is subject to CWF's verification of the Customer's credit and determination that such credit is adequate or satisfactory to CWF.
