hearing was closed. Mrs. Derleth stated that this is a
residentially plated area and she expressed surprise at
the way in which it was platted. Mr. Leraas stated that
he felt it would be much safer than the way in which it
was originally platted. Mr. Hatzenbuhler asked whether
the easement has been granted yet on Lot 16. Mr. Pantley
stated that he planned on granting the easement. Ms. Block
stated that the easement would have to be granted and re-
corded and that the original plat would have to be amended.
MR. HATZENBUHLER MOVED, SECONDED BY MR. ROY TO APPROVE
V-26-78 BECAUSE IT DOES MEET THE CRITERIA REQUIREMENTS
AND IT ELIMINATES WHAT WOULD BE A HAZARDOUS DRIVEWAY AS
PROPOSED IN THE ORIGINAL PLAT. THIS VARIANCE IS APPROVED
WITH THE REQUIREMENT ' OF A 15- ACCESS WITH 12' OF PAVING
AND TURNAROUNO. MOTION CARRIED.

Ms. Mary Lou Block stated that this was a corner lot and'
the variance was for 6' from the front yard setback. A
corner lot requires two front yard setbacks. Granting of
this variance would not amount to a rezone. The special
-conditions are that this being a corner lot limits the
amount of the total area which can be built upon. The ap-
plicant wishes to make an addition to the sides and rear of the
existing home.
Enforcement of the zoning eode would Dre-
vent'the applicant from what appears to be a reasonable'en-
largement of the home. The home is very small and the con-
ditions were established many years ago. Granting of this
variance would not be detrimental to the healthi safety or
welfare of others in the vicinity. The setback is from the
street side of the lot and the 141 setback on the east side
appears adequate and will not present a sight problem for
the surrounding houses. This is a minimum variance and the
.addition of 10' along the east side of the house is the most
practical manner in which to expand the house in conjunction
with the othor aspects of the proposal. The granting of this
variance will be in harmony with the code as it provides for
an enlargement of the house and makes use of the open space
on the lot for improvement of the home. The Pla*nning Divi-
sion recommended approval of this variance with the condi-
tion that the applicant meet any Engineering Department re-
quirements forremoving the e istina site obstruction vosed
bv the location of the larqe x tree, The public portion of
the hearing was opened, no one wished to speak and the pub-
lic portion of the hearing was closed.
MOTION:
MR. LERAAS MOVED, SECONDED BY MRS. DERLETH TO APPROVE V-28-78
AS IT MEETS THE CRITERIA FOR A -MINIMUM VARIANCE AND IT WILL
ENHANCE THE PROPERTY AND IS NOT DETRIMENTAL TO.THE HEALTH,
SAFETY AND WELFARE OF OTHERS IN THE VICINITY. PROVISION IS
TO BF MADE FOR THE REMOVAL OF THE EXISTING OBSTRUCTION IF
NECESSARY. MOTION CARRIED.
There was no further business to come before the Board and the meeting ad-
journed at 11:15 p.m.
