outdoor seating will be added between the building and 5th Avenue with additional landscaping provided
in that area as well. The site is zoned Downtown Business (BD-3).

Design Review Process and Criteria
Due to the location and type of project (SEPA determination not required), district -based design review
by staff is required according to Edmonds Community Development Code (ECDC) 20.12 (a Type I
decision). There are no specific design standards for the BD-3 zone so the proposal is reviewed against
the policies and objectives of the Downtown Activity Center contained in the Comprehensive Plan.
Analysis
1. Comprehensive Plan Compliance.
a. Goals, Policies and Objectives. The goals, policies and objectives for the Downtown Activity
Center (Downtown Convenience) are located on pages 55 — 60 and are intended to encourage the
development of high quality, well -designed projects that reflect the values of the citizens of
Edmonds. The proposal satisfies the intent of following goals, policies and objectives of the
Comprehensive Plan:
i. "Improve streetscape character to enhance pedestrian activity in downtown retail, general
commercial, and residential areas." (page 5 6)
ii. "Create an active, safe and lively street -edge." (page 56)
iii. "Improve the visual andphysical character and quality ofDowntown Edmonds." (page 59)
2. Edmonds Community Development Code (ECDC) Compliance
a. ECDC 17.50 — Off-street parking.
According to ECDC 17.50.010.C, "[a]ll existing and new uses in existing buildings are
considered to comply with the parking requirements setforth in this chapter of the code." While
no parking spaces would be required for the proposed use, two existing spaces are being retained
on the frontage between the building and the sidewalk along 5h Avenue using access from an
existing curb cut.

b. ECDC 17.75 — Outdoor dining.
According to ECDC 17.7 5.0 10, [I]imited outdoor seatingfor outdoor dining is herehy allowed as
a permitted secondary use ... in the BD — downtown husiness zone.... Seating shall he limited to
an additional 10 Percent of the existing interior seating of the estahlishment or eight seats,
whichever is greater, and shall he located outside ofpuhlic rights -of -way. No additional parking
stalls shall he requiredfor outdoor dining usage." The site plan indicates that eight (8) seats will
be located in the area immediately outside the existing building between it and the sidewalk along
5th Avenue. No food or beverages will be prepared or stored outside.
3. ECDC 20.13 — Landscaping.
A planter area is to be installed within an existing area of pavement between the proposed
outdoor dining area and the sidewalk along 5th Avenue. This planter will be an attractive addition
to an existing area of pavement and provide some buffering from pedestrian and auto traffic along
5'h Avenue South.
Findings and Decision
Based on the facts and analysis of this report, staff finds that the Baicha Tearoom proposal satisfies the
applicable criteria and standards in the Comprehensive Plan and zoning ordinance as required in section
20.12.030 ECDC. Therefore, the design of this project (File No. BLD-2011-0457) is APPROVED with
the following conditions:
1. No more than eight (8) seats associated with the restaurant may be located outside without an
approved conditional use permit as described in ECDC 17.75.020.
2. No food or beverages shall be prepared or stored outside except as approved pursuant to ECDC
17.75.040.
3. All signage for the site shall be under separate permit and must meet the requirements in ECDC
20.60.

Elementary
was directed at informing the Council of their particular use of the
School. There was a proposal submitted by the Senior Services of Snohomish County
for $9,907 to fund a part-time employment specialist and secretarial services, and
the goals for the Edmonds Office were reviewed. There was also a proposal for
a transportation coordinator for a Park and Ride Lot, the lot to be located at the
United Methodist Church of Edmonds, and the grant requested was $1,500. Community
Development Director John LaTourelle recommended that if the Council was receptive
to that proposal, that it be accomplished by means of the General Fund, rather than
as a HUD block grant proposal. Lou O'Neill, Nutrition Director for the Senior
Services for Snohomish County, was present to answer any further questions regarding
the Meals on Wheels proposal which had been presented December 13. There was no
further discussion from the audience, and that portion was closed.
Councilman Carns said he would like to see the City of Ed monds support other cities
in the County in their programs. He felt that by keeping the Edmonds' request down
to only the Meals on Whpels program it would be indicating the City's support for

In answer to your letter of December 11. 1972, we have itt-.
vestigated the situation and.,discussed the solutions with,..
Xr.,Sako. The present situation in outlined*in the sketch
attached.shoving a 22-foot driveway opbning to a small asphalt
area. This arftngement requLive patrons of the Cleaners to
back out onto Sth Avenue, an undesirable feature on -an arterial
street.
There is another problem due to the fact that the building
is only 10 feet from the proper-ty-line., This.would create
a parking problem should sidewalks be extended in front of,
tho building.
As a temporary measure. -I suggested -that two driveway open-
ings be installed, by Mr. Sako' each being 15 feet In. width
to allow a modified U-shape driveway*' Mr. Sako indicated
that he would proased In that manner.
For the,. Iluture,-,0. we are planning to. eliminate the NO PARKING
restrictions on, the west side. -,of 5th Avenue as soon an SR.104

Dear Leif:
It has come to my attention that one of our local
merchants is suffering to some degree a hardship case in
the ingress and egress to his property. I speak to the
case of Mr. Yoshiaki Sako of 622 - 5th Avenue South,
Edmonds, who owns and operates Van's Drive In Cleaners.
Mr. Sako is the victim of a very short curb -cut
which was possibly an oversight of the State Highway
Department when they widened Sth Avenue. The most obvious
remedy for this hinderance would be to afford him a curb -
cut the full length of his property.
Leif, if you would be so kind as to inves * I
both at the City and State level and then report back to
me your suggestion to remedy this situation, I would greatly
appreciate it.
