The parties desire to create and hereby do create a formal agreemeht to establish an easement to constr6ct,, improve, maintain and repair a subsurface pipline for the conveyance of 412190 161 Pipeline Easement Agreement effluent (commonly called a "side sewer"),, having not more than a , 6 inch inside diameter, across, under and upon the following described portion of Parcel A: From a point on the north west corner of the two properties there shall be a 5 foot wide easement beginningat a point 15 feet east from the north west corner beginning at tile northern property line and extending south for 38 feet and then extending in a south-west direction at a 45* angle to the property line adjoining the two properties. - A portion of this pipeline easement Shall be ' a single pipline used in common by the parties from a point of juncture at NA on Parcel A to the public trunk sewer line lying alongside the NA boundary of Parcel A and a portion shall be ' used separate I ly by the parties consisting of branch lines f rom said point of juncture, to the respective residences of the parties o-i Parcels'A and B. The Grantor may make all normal residential uses of the surface of said easement area and construct fencing and.' landscaping. The Grantee(s), may pass over said easement area to cause repairs and extensions as necessary, provided that full restoration of landscaping improvements is effected. The parties wish to formally dedicate and confirm in writing the establishment of said easement and to state the terms and conditions of its use and maintenance in a man ner that will meet the needs of each of the parties and apportion the obligations of the parties in a reasonable manner. 3. Grant of Easement. The parties agree that the easement described above shall be forever a pipeline easement for the joint and mutual use and benefit of the parties as owners of their respective properties or. for their heirs, successors or assigns. Grantor hereby grants and conveys to Grantee all such easement rights, privileges, authority and interests in the above described portion of Parcel A as is necessary to carry out the purposes of this agreement. Maintenance. The reasonable cost of any necessary maintenance, repairs or upkeep of the improvements or facilities located on the described easement pursuant to the purposes of this agreement shall be shared or allocated between the parties,as follows: (a) As to all common portions, the use'of which is shared by the parties,, the cost shall be shared equally. (b) As to portions which serve and benefit only one parcel or the other the cost shall be borne solely by the party whose property is so served and benefitted. (c) As to any improvements and modifications to the facil- ities that are desired by one of the parties but not agreed to by the other party,"such expense shall be the sole obligation of the party desiring same.
