The agreement notes the required 15' landscaped buffer adjacent to the R-zoned property (#2 and Exhibit C). This requirement is also found in the BN code itself (httr)://www.mrsc.org/mc/edmonds/Edmondsl6/Edmondsl645.html#16.45.020). 1 can't say why the parking area was permitted to be reconfigured in 2001/2005 - what was approved was clearly not in keeping with the requirements of the zone and should not have been allowed. The concept we discussed at the counter last week (attached) likewise does not satisfy the 15' landscaped buffer requirement from the southern property line since it is adjacent to an R-zoned parcel. Whatever is proposed for the 1,885 square foot building will have to satisfy the parking space requirements in ECDC 17.50 (http://www.mrsc.orci/mc/edmonds/Edmondsl 7/Edmondsl 750.html# 17.50.020) and re-establish the 15' landscaped buffer at the southern property line using Type I landscaping (http://www.mrsc.ora/mc/edmonds/­Edmonds20/­Edmonds2Ol3.html#20.13.030). I know this is not what you were hoping for but the code is clear on this one. As we discussed at the counter, a variance request would be an uphill battle given the layout of the site and its location adjacent to R-zoned property. Let me know if you have any other questions. If compatible with the public heal-th, safety, and general. welfare, the City will cause the necessary ordinance to be enacted to rezone subject property from RS-6 to BN. 4. Amendments to this agreement may be made by the Owners or the City upon application filed in the same manner as a rezone application; provided, however, no application shall be made by the Owners or the City to amend this agreement for a period of two (2) years from the date of this agreement. Thereafter,, either the Owners or the City may, upon application, apply to amend or terminate the provisions and covenants of this agreement or to change the zoning on the subject property or any portion thereof. Said application to change or ter minate this agreement or to rezone the subject property shall be heard in the normal manner at appropriate public hearings as any other application for a rezone of property in the City of Edmonds. 5. The City shall be under no obligation to issue to Owners or their successors or assigns building permits, occupancy permits, use per- mits or other permits or approvals for improvements on or use of the subject property unless such improvements'or uses lie within the terms of this agreement and the applicable City ordinances at the time of any application for such permit or approval. 6. This agreement, and each part of it, shall be considered a covenant running with the land covered hereby and shall be binding upon the Owners, their successors and assigns, and the City. This agreement shall be recorded with the Snohomish County Auditor in the Grantor/ Grantee Index, with the Owners being listed as Grantors and the City as Grantee. All costs of such recordation shall be paid by Owners. The terms of this agreement may be specifically enforced by the City. If either party brings suit to enforce any of the provisions of this agreement, the prevailing party shall be awarded reasonable attorney's fees and litigation costs in such amounts as are set by the Court.
