Hi Jim,
I got your voicemail but wanted to respond here with some additional info/attachments. 624 Edmonds Way
was rezoned in 1981 from RS-6 to BN (see attached). The agreement notes the required 15' landscaped buffer
adjacent to the R-zoned property (#2 and Exhibit C). This requirement is also found in the BN code itself
(httr)://www.mrsc.org/mc/edmonds/Edmondsl6/Edmondsl645.html#16.45.020). 1 can't say why the parking
area was permitted to be reconfigured in 2001/2005 - what was approved was clearly not in keeping with the
requirements of the zone and should not have been allowed.
The concept we discussed at the counter last week (attached) likewise does not satisfy the 15' landscaped
buffer requirement from the southern property line since it is adjacent to an R-zoned parcel. Whatever is
proposed for the 1,885 square foot building will have to satisfy the parking space requirements in ECDC 17.50
(http://www.mrsc.orci/mc/edmonds/Edmondsl 7/Edmondsl 750.html# 17.50.020) and re-establish the 15'
landscaped buffer at the southern property line using Type I landscaping
(http://www.mrsc.ora/mc/edmonds/Edmonds20/Edmonds2Ol3.html#20.13.030).
I know this is not what you were hoping for but the code is clear on this one. As we discussed at the counter, a
variance request would be an uphill battle given the layout of the site and its location adjacent to R-zoned
property.

AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING THE OFFICIAL ZONING MAP
OF THE CITY OF EDMONDS, WASHINGTON, BY
CHANGING THE ZONING CLASSIFICATION OF CER-
TAIN PROPERTY LOCATED WITHIN SAID CITY FROM
SINGLE FAMILY RESIDENTIAL (RS-6) TO NEIGH-
BORHOOD BUSINESS (BN) AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT AND COVENANTS,
PURSUANT TO PLANNING COMMISSION RESOLUTION
NO. 667
WHEREAS, the Edmonds Planning Advisory Board has
held a public hearing and has forwarded its recommendations
to the City Council, and
WHEREAS, a public hearing was called by the City
Council of the City of Edmonds, Washington, and after con-
sidering the Planning Advisory Board's findings and recom--
mendations, the City Council determined the following:
1. That the findings of fact and conclusions of
the Planning Advisory Board contained in Planning Advisory
Board Resolution No. 667 are correct and the same are
hereby adopted by the City Council and incorporated by this
reference as if set forth in full.
2. That the proposed rezone, as limited by the
concomitant zoning agreement tendered to the City by the
owners of several parcels, will allow development which is
compatible with adjoining uses and is appropriate for the
area.
3. The proposed zoning change, as limited by the
concomitant zoning agreement, bears a reasonable relation-
ship to the zoning and uses of the surrounding and nearby
properties and will not be detrimental to adjoining prop-
erties or uses.
4. That in accordance with the findings of the
City's responsible official, there will be no significant
adverse environmental impacts, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. The official zoning map of the City of
Edmonds, Washington, is hereby amended by changing the
zoning classification of certain parcels of property situate
in the City of Edmonds, Washington, from Single Family
Residential (RS-6) to Neighborhood Business (BN) whose legal
description is set forth in Exhibit A and incorporated by
reference as if set forth fully herein.
Section 2. The Director of Planning and the
Director of Public Works are hereby authorized and directed
to effectuate the necessary amendments to the official
zoning map of the City, pursuant to this ordinance.
Section 3. The Mayor is hereby authorized to
execute and the City Clerk to attest that certain document
entitled "Agreement and Covenants Constituting a Contract
Rezone" consisting of 3 typewritten pages which was
executed by the owners of the subject property on the 29th
day of , May , 1981, and tendered to the City. The

the Snohomish County Auditor as a covenant running with the

AGREEMENT AND COVENANTS CONSTITUTING
A CONTRACT REZONE
THIS AGREEMENT is made this date between GARY BOLDMAN and
NOMA SZALEY, hereinafter referred to as "Owners" and the CITY OF EDMONDS
WASHINGTON, hereinafter referred to as "City".
WHEREAS, the Owners possess certain property located in the
City of Edmonds and more particularly described as set forth herein and,
WHEREAS, owners have applied for a change in the zoning
classification of the property from Single Family Residential (RS-6) to
Neighborhood Business (BN) and,
WHEREAS, the City has caused the application in its entirety
to be reviewed by its Planning and Engineering Departments and its Plan-
ni ng Advisory Board and has fully considered their recommendation made
after said review and the recommendations which the City finds to.be ap-
propriate as set forth herein and,
WHEREAS, the Owners are willing to implement the following
conditions in 1:he course of the proposed development and have tendered
this contract to the City, now therefore,
IN CONSIDERATION of the City's reclassifying the property
described herein from RS-6 to BN and for so long as the property remains
so classified, Owners covenant and agree as follows:
1. Owners possess those certain parcels of real property hereinafter
referred to as "subject property", situate in the City of Edmonds,
Washington and legally described as set forth in Exhibits A and B
attached hereto and incorporated by this reference as if set forth
in f V11.
2. Notwithstanding any other provisions of the Edmonds City Code, as it
now exists or may hereafter -be amended or recodified, the Owners
agree that before issuance of any business license and/or occupancy
permit on I:he subject property, a joint driveway will be installed,
together with the required on site parking and a 15-foot landscape
buffer adjacent to the R-zoned properties, all as set forth irNO SALES TAX

Exhibit C, attached hereto and incorporated in full. by this refer-
ence. All construction shall be in accordance with applicable City
standards. The existing driveways shall be removed upon completion
of the new driveway. The installation of these improvements is sub-
ject to review and approval. by the City.
If compatible with the public heal-th, safety, and general. welfare,
the City will cause the necessary ordinance to be enacted to rezone
subject property from RS-6 to BN.
4. Amendments to this agreement may be made by the Owners or the City
upon application filed in the same manner as a rezone application;
provided, however, no application shall be made by the Owners or the
City to amend this agreement for a period of two (2) years from the
date of this agreement. Thereafter,, either the Owners or the City
may, upon application, apply to amend or terminate the provisions and
covenants of this agreement or to change the zoning on the subject
property or any portion thereof. Said application to change or ter
minate this agreement or to rezone the subject property shall be
heard in the normal manner at appropriate public hearings as any
other application for a rezone of property in the City of Edmonds.
5. The City shall be under no obligation to issue to Owners or their
successors or assigns building permits, occupancy permits, use per-
mits or other permits or approvals for improvements on or use of
the subject property unless such improvements'or uses lie within the
terms of this agreement and the applicable City ordinances at the
time of any application for such permit or approval.
6. This agreement, and each part of it, shall be considered a covenant
running with the land covered hereby and shall be binding upon the
Owners, their successors and assigns, and the City. This agreement
shall be recorded with the Snohomish County Auditor in the Grantor/
Grantee Index, with the Owners being listed as Grantors and the City
as Grantee. All costs of such recordation shall be paid by Owners.
Such recordation and payment or costs shall be a condition precedent to
the Owners exercising any rights under the terms of' this agreement.

7. The terms of this agreement may be specifically enforced by the City.
If either party brings suit to enforce any of the provisions of this
agreement, the prevailing party shall be awarded reasonable attorney's
fees and litigation costs in such amounts as are set by the Court.
