Just an FYI
There's been a septic system failure at 625 Paradise Lane, and the Snohomish Health Department contacted us
to verify the unavailability of a public sewer system before they issue a permit for the repair. The only nearby
sewer is an abandoned force line in the right-of-way, and the nearest sewer MH is uphill of the home. A similar
event occurred last year at 619 Paradise Lane where we apparently allowed the repair / upgrade of their septic
system, and for those reasons, we'll similarly allow a repair here. I'll contact the Health Department and inform
them of this, but also inform them that we will not undertake the inspection of the system, that our acceptance of
the system via a sewer permit will be conditioned on the Health Department's acceptance of the repaired system.

I am writing to inform you of problems our neighborhood is having as a result of a
"Street Use Permie, the city of Edmonds has with the Washington Credit Union. I have
enclosed a copy of the letter regarding this matter that was sent to the Edmonds Director
of Community Services, Mr. Paul Mar. I have also enclosed a copy of a letter sent to the
planning board.
The Washington Credit Union received the "Street Use Permit" before they were open
for business. I was told by Gordon Hyde that the Washington Credit Union would not
lease the property without getting the use permit for the extra on street parking spaces.
The neighbors were not contacted or made aware of this application for the "Street Use
Permit". I'm sure the regulations do not require notification, however several of us in the
neighborhood had spoken at the Planning Board and Architectural Board meetings
regarding this very property and parking problems prior to the Washington Credit Union
making application to use the right of way for parking. The former owner/tenant of this
property had full knowledge of the parking problem and the neighbors objections to
having parking that backs out onto Paradise Lane. The city was also aware of the
neighbors feelings through the testimony process at the Board meetings mentioned
above.
Washington Credit Union now has 18 on -site parking places that receive only 5-10
percent or less use by the bank patrons. One space is used by an employee. At least 90
to 95 % of all the bank patrons use the 7 1/2 spaces in the area gained by the Street Use
Permit. This has caused a hazardous traffic problem for the local ' residents driving to
their homes or while out walking. With nearly all the 18 on -site spaces sitting empty, the
7 on street spaces are in constant use. The Bank was not required to show need to gain
this area for parking only desire to have the space. It is apparent that the bank patrons
could easily use the on -site parking with no problem and no possibility of not having
enough spaces available. I suggest the "Street Use Permit be revoked to remove the
traffic hazard that exists due to the on street parking.
I suggest that 2 parallel parking spaces could take the place of the on street pull in
parking. This could be for and limited to use by employees. This would keep the on -site
parking for the bank patrons and completely eliminate the hazard caused by the backing
out of cars onto the narrow street of Paradise Lane.
I am also concerned about the increase in crime to our area with the 2 armed bank
robberies at Washington Credit Union. When I discussed this with the Edmonds Police
the officer I spoke with, Officer Perry, suggested the site might be less attractive to bank
robbers if there was no access to parking on Paradise Lane. This alone may be enough
reason to revoke the use of parking gained by the "Street Use Permit". I understand
Edmonds had averaged 1 bank robbery every 3-4 years. Now we have had 2 in 3 months.
Anything that can be done to keep this property from looking good to the criminal
element should be considered. Community safety should the first priority.
Because of our frustration with this traffic problem it occurs to me that the new
"Neighborhood Business" zone proposed to comply with the comprehensive plan should
also carry a recommendation that if any business applies for a "Street Use Permit" other
properties in the area should be consulted. Perhaps the locals know best if the "Street
Use Permit" will cause any unusual problems when businesses are located near a
residential area. I also feel that if a business wants a "Street Use Permit" to increase their
parking they should be required to show need and not just desire.
I want to thank you for taking the time to read these letters and I hope you will give some
serious consideration to my suggestions. I look forward to hearing from you regarding
your feelings and any action you may take concerning these matters.

Dear Mr. Mar:
I am writing to you to request an Initiation of Review of a Street Use Permit with the
Washington Credit Union. This falls under Edmonds Community Development Code sections
20.100.040 Review of approved permits. My neighbor, Ardell Morgan and I met with Gordy
Hyde Monday, December 2, 1996 to find out what could be done to eliminate the hazardous
condition this street use permit has caused. After looking at the plan that had been signed we
found that the Washington Credit Union had added 1 1/2 more parking places than were shown
on the plan signed by the city officials.
The Washington Credit Union has provided 18 on -site parking spaces. The majority of the 18
spaces are seldom used by bank patrons or bank employees. The vast majority (estimate of 90%)
of bank traffic uses the parking places allowed by the Street Use Permit. These cars use Paradise
Lane to gain access to the parking places. These are pull in spaces and require backing out onto
Paradise Lane to exit. The spaces are narrow and them is no way cars can back out without
backing across one or both lanes of traffic on Paradise Lane.
This is a very popular walking area for many Edmonds seniors and this area is also used by local
school children as they walk to and from school. Not only is this parking hazardous to passers-
by, the local neighborhood cars are being exposed to cars backing into traffic lanes. This permit
with the Washington Credit Union was signed before they were actually open for business. It is
now apparent that the Washington Credit Union has more than enough on -site parking to
accommodate their patrons and employees. They do not need the spaces gained by the Street Use
Permit.
When I spoke with Edmonds police officer Perry, I was told the Washington Credit Union has
had 2 armed robberies in dme months. As we talked the officer suggested that the bank may not
be so attractive to crime if there was no parking access on Paradise Lane, as bank robbers am
looking for a quick exit from the area. If all the bank parking was on -site, the exit might not look
so quick and easy to the criminal element.
We have lived in our home for 26 years and we are feeling very uncomfortable with this type of
crime in our neighborhood. I ask you to review the street use permit and recommend that the
permit be revoked. This action will help return our street and neighborhood to a safer less
hazardous area.
I look forward to your response regarding the review of the Street Use Permit. On behalf of our
family and our neighbors in the Paradise Lane area I thank you in advance for your help with this
matter.

zone classification. We feel you have done a good job including protections and
limitations for possible uses. I would recommend that special considerations be given to
granting " Street Use Permits" to businesses in this category. I suggest that if any
business ask for this type of permit, before one could be granted the other properties in
the area should be consulted. Since we have recently experienced a negative situation
with such a permit given to a neighboring business with out consultation we now can see
how this can be a serious problem.

Bobby to develop a standard answer that we can all use.
For the last couple of months, our Sewer Department has been trying to
work with Mr. Mazzuca to install a sewer for him. They have determined
that it is beyond their authority, and recommend that an LID be formed to
sewer the six or seven houses in the area. Mr. Mazzuca was given a LID
application, and he is going to speak with his neighbors to see if they
wish to participate. It requires a majority to petition for 'a LID.
I have spoken with Olympic View Water District, and there is no way that
we can get the sewer constructed during the time they are placing their new
water line.
Mr. Mazzuca seems happy with our suggestion. I will call him again next
week to determine how he is progressing with the LID petition and keep you
informed.

home.

The City has several requirements for extending overhead
utility services. It appears that none of these requirements
would prohibit upgrading your electrical service to 200 amperes.
Current City code will allow the new service to be either overhead
or underground.
You indicated that the additional electrical service would be
required to move your business into your home. Prior to expending
money for the electrical service, I recommend that you obtain
approval for the residential business. A residential business
requires a home occupation/conditional use permit. This permit
has several stringent requirements, including the potential need
for a public hearing.
I recommend that you visit our Planning Department to obtain
the necessary information and application for the home occupation/
conditional use permit.

The water/sewer utility provides for the operation, maintenance and
development of:
• Water Facilities
• Sanitary Sewer Facilities
• Storm Sewer Facilities
The present rate structure is based upon the cost of operation, maintenance
and development of those facilities that service the customers. Under the
present rate structure, the cost associated with these facilities is borne
by those customers who receive benefit from these facilities.
The sewer rate has two components:
Unconnected charge which covers the cost of operation, maintenance
and development of storm sewer facilities.
Connected charge which covers the cost of operation, maintenance
and development of both sanitary and storm sewer facilities.
Since those customers who are not connected to sanitary sewer receive a
benefit from the storm sewer facilities, they are charged the cost asso-
ciated with storm sewer facilities. Those customers who are connected to
sanitary sewer receive benefit from both sanitary and storm sewer facilities,
and as such, are charged for -both the sanitary and storm sewer.

SUBJECT: REFUNDING OVER COLLECTION OF UTILITY CHARGE
In discussing a refund to Mr. Ralph R. Argue, the amount overcharged
for -sewer service at 629 Paradise Lane, the City Attorney indicated
that:
a. There was no legal restraints against refunding
the full amount which has been over collected
b. That no refund was due if sanitary sewers were
available, since the date of availability.
Therefore, I suggest that the availability of sewers be double
checked, and a request for payment be prepared for the amount over-
charged. According to my calculation, Mr. Argue is due $2.00 per
billing period beginning.with the June 1970 billing, through August
1974, or $52.00. 1
Please advise me of your conclusions so I may answer his letter.

Attached are ledger sheets that show Mr. Argue moved into 629 Paradise Lane
April 9, 1970. On April 23, 1970 a partial bill was done, charging $1.50
U.C. From that time until September 1974 he was charged $6.00 u.c.
on billings done bi-monthly.
After a call from Mr. Argue we checked with engineering and found that
he is in fact, unavailable to sewers, therefore his September billing
reflected the change on coding to $4.00 U.C. Also, his December billing.
Prior to April 9, 1970, Mr. Argue resided at 625 Paradise Lane. The
U.C. from January 1969 thru December 1969 was $4.809 connected rate.

SUBJECT: REFUNDING OVER -COLLECTION OF UTILITY CHARGE
REF: Attached letter from Ralph R. Argue,
629 Paradise Lane, Edmonds, Washington
Mr. Argue contacted this office sometime around September, 1974,
and indicated that he thought he was being over charged for sewer
service. In checking, I found that he was being billed $6.00
bimonthly, the rate charged to customers connected to the sanitary
sewer system. He had stated that his house was not connected and
this proved to be correct, therefore, he should have been billed at
the rate of $4.00 every two months.
Our records indicate that he was overcharged as far back as June
of 1971, perhaps even further -- we haven't checked.
My question is: Is there any limitation of the period of time
during which he was overcharged, that can be refunded? For example,
if we find that he has been overcharged since 1965, can we
legally refund the over -collection in full?
