LEGAL DESCRIPTION: See Exhibit 2 IV. STAFF FINDINGS AND CONCLUSIONS: A. Description Of the Sub The subject property is located on the northwest corner of Durbin Street and Dayton Streets. The lot contains approximately 9,900 sq. ft. of area. The site is developed into one large office building (Building A) and a smaller office building (Building B)in the northwest corner of the lot. These two offices were allowed under CU-44-79 and CU-40-80. The Applicant is seeking a conditional use permit to add 574 sq. ft. of office area onto Building A. In addition to the conditional use permit, the Applicant is seeking a variance to reduce the total required number of parking spaces from nine to eight spaces. Surrounding develop-nent is a mixture of single family and multiple family residential uses. The Edmonds public library is located directly east, across Durbin Street. Special Privilege The proposed variance does not appear to represent a grant of special privilege. 3. comprehensive Plan The Comprehensive Policy Plan map designates the subject property and surrounding area as Low Density Residential . and High Density Residential. The proposed variance, does not appear to conflict with the purposes of the Comprehensive Plan. 4. Zoning ordinance The subject property, as well as the surrounding area, is zoned RM -1.5. The proposed variance does not appear to conflict with the purposes of the zoning ordinance or the RM-1.5 zone district. 5. Not Detrimental The proposed variance does not appear to pose any significant impact to the public or to any near by private property or improvement. 6. FOR APPROVAL OF A VARIANCE AND A CONDITIONAL USE PERMIT DECISION: The variance and conditional use permit as requested are granted subject to conditions listed. INTRODUCTION Ronald Walker, Jr., 22906 Park Road, Edmonds, Washington, 98020, and hereinafter referred to as Applicant, has requested approval of a variance to reduce the number of required parking spaces at a profes- sional office at 627 Dayton Street, Edmonds, Washington. In addition the Applicant has requested a conditional use permit for the allowance of an addition to a *professional office at 627 Dayton Street, Edmonds, Washington. A hearing on the request was held before the Hearing Examiner of the City of Edmonds on August 7, 1986. FINDINGS OF FACT 1. The subject property is located on * the Northwest corner of Durbin Street and Dayton Street. It is a lot of approximately 9,900 square feet. The lot is developed with two office buildings. (Staff report) 3. The subject property is zoned RM-1.5. Two office buildings were de- veloped pursuant to conditional use permits issued in 1979 and 1980. (Staff report) 4. it is the intent of the Applicant to'constructC-an additional 574 square feet of office area onto Building A. it is for this addition that the Applicant seeks a conditional use permit. (Block testimony) 5. With the proposed addition to office A the zoning code of the City of Edmonds requires that an Applicant have nine parking spaces. The Applicant is seeking a variance from this requirement and proposes eight parking spaces. .(Block testimony) 6. In order for a conditional use permit to be granted within the City of Edmonds, the criteria as set forth in Section 20.05-010 (ECDC) must be satisfied. These criteria include: A. The proposed use must be consistent with the Comprehensive Plan. B. The proposed use and its location must be consistent with the zoning ordinance and the purpose of the zone district in which the use is located and the proposed use must meet all applicable requirements of the zoning ordinance. C. The proposed use must not significantly be detrimental to the public health, safety a ' nd welfare nor to nearby private proper- ties or improvements. (ECDC) 7. In order for a variance to be granted within the City of Edmonds, the criteria as set forth in Section 20.85.010 must be satisfied. These criteria include: A. Because of the special circumstances relating to the property, the strict enforcement of the zoning ordinance would deprive the owner of use rights and privileges permitted to other properties in the vicinity with the same zoning. B. The approval o f a Variance would not be a grant of special privileges to the property in comparision with the limitations upon other properties in the vicinity with the same zoning. C. The approval of a variance will be consistent with the Comp- rehensive Plan of the City of Edmonds. a Findings and decision of the Hearing Examiner of the City of Edmonds Re: V-22-86 & CU-28-86 Page 3 D. The.approval of the variance will be consistent with the pur- poses of the zoning ordinance and the zone district in which the property is located. E. The variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and welfare, or injurious to the property or improvements in the vicinity and same zone. F. The requested variance is the minimum necessary to allow the owner the rights enjoyed,by other properties in the vicinity with the same zoning. (ECDC) 6. The Applicant intends to use the additional space in building as a conference room. Also, offices within the office building will be redesigned for better use of available space. There will be no additional personnel retained as a result of the proposed ex- pansion. (LaFon testimony) 7. Parking standards within the City of Edmonds require that the size of Building A have at least nine parking spaces. The Ap- plicant is proposing eight spaces. If a ninth space were developed the parking stall would result in the removal of an apple tree and lawn area that is*located behind Building A. However, because no additional personnel are proposed to be employed at the site, there appears to be no need for additional parking. (Staff report, LaFon testimony) 8. The proposed variance will not be the grant of a special privilege. (Staff report) 9. The Comprehensive policy Plan Map of the City of Edmonds designates the subject property as low density residential and high density residential. The requested variance does not conflict with the Comprehensive Plan. 10. The proposed variance does not impact the public nor other private properties or improvements in the area. 11. The requested variance for the reduction of parking stalls does represent a minimum variance request. 12. The requested conditional use permit should be transferrable. 13. The Planning Departmen�t of the City of Edmonds has recommended approval of the conditional use permit and variance subject to the following conditions: 1. comply with architectural design board requirements. Findings and decision or the Hearing Examiner or the City of Edmonds Re: V-22-86 & CU-28-86 Page 4 2. The Applicant shall file a covenant, approved as to form by the City Attorney, that states that, in the event of a resulting parking problem, the one parking stall shall be installed or if the City amends its community developement code to allow payment of money into the in -lieu parking fund offices in RM zones, whichever comes first. (Staff report) 14. The City submitted that the Applicant was willing to buy a parking stall and participate in the parking fund program. However, because the subject property was located in a residential zone, the property does not qualify for the parking fund program. Condition No. 2 of the City's recommendation allows for participation should offices in RM zone be included as part of the program. (Block testimony) 15. No adverse testimony was received in this matter. CONCLUSION 1. The application is for the approval of a conditional use permit for the addition of 574 square feet of office area on a building located at 627 Dayton Street, Edmonds, Washington. Requested variance is for a reduction of the required parking spaces of nine for the parking lot that is adjacent to the building. The requested reduction is for the allowance of eight spaces. 2. The requested variance satisfies the criteria as set forth in Section 20.85.010. 3. Special circumstances exist for the granting of the variance. i Because there will be no increase in the number of employees on site and because the additional parking space will require removal of lawn area and an apple tree, special circumstances exist for the granting of this variance. 4. The granting of a.variance is not a special privilege. 5. The granting of a variance is consistent with the comprehensive policy plan map designation of the subject property and also the zoning destination of the subject property. The requested variance is consistent with the purposes of the zoning ordinances of the City of Edmonds. 6. The requested variance is not detrimental to the public health, safety, and welfare, nor to nearby private properties or improve- ments. 7. The requested variance is the minimum necessary for the Applicant to enjoy the property. 8. The requested conditional use permit satisfies the criteria of Section 20.05.010. (ECDC) 4 9. As noted the requested variance is consistent with the zoning ordinances of the City of Edmonds and the Comprehensive Plan of the City of Edmonds. 10. . The conditional use permit would not be detrimental to the public health, safety and*welfare, nor to nearby private properties or improvements. 11. Also -a variance to reduce the required number of parking spaces from nine to eight for the parking lot at 627 Dayton Street, Edmonds, Washington, is granted. Both the variance and the conditional use permit are subject to the following conditions: 1. The Applicant is to comply with all architectural design board requirements. 2. The Applicant shall file a covenant that is to be approved as to form by the City'Attorney. The covenant shall state that in the event of a parking problem onsite, the Applicant shall provide an additional stall onsite. If at the time the parking stall is needed and the City has amended its community Development Code to allow offices in an RM zone to be part of the parking fund that is made available in7lieu of construction of parking, the Applicants may elect to do so. 3.
