SUBJECT: REFUNDING OVER COLLECTION OF UTILITY CHARGE
In discussing a refund to Mr. Ralph R. Argue, the amount overcharged
for -sewer service at 629 Paradise Lane, the City Attorney indicated
that:
a. There was no legal restraints against refunding
the full amount which has been over collected
b. That no refund was due if sanitary sewers were
available, since the date of availability.
Therefore, I suggest that the availability of sewers be double
checked, and a request for payment be prepared for the amount over-
charged. According to my calculation, Mr. Argue is due $2.00 per
billing period beginning with the June 1970 billing, through August
1974, or $52-00. 0
Please advise me of your conclusions so I may answer his letter.

Attached are ledger sheets that show Mro Argue moved into 629 Paradise Lane
April 9, 1970. On April 23, 1970 a partial biil was done, charging $1.50
U.C. From that time until September 1974 he was charged $6.00 U.C.
on billings done bi-monthly.
After a call from Mr. Argue we checked with engineering and found that
he is in fact, unavailable to sewers, therefore his September billing
reflected t1je change on coding to $4.00 U.C. Also, his December billing.
Prior to April 99 1970, Mr. Argue resided at 625 Paradise Lane. The
U.C. from January 1969 thru December 1969 was $4.80, connected rate.

SUBJECT: REFUNDING OVER -COLLECTION OF UTILITY CHARGE
REF: Attached letter from Ralph R. Argue,
629 Paradise Lane, Edmonds, Washington
Mr. Argue contacted this office sometime around September, 1974,
and indicated that he thought he was being over charged for sewer
service. In checking, I found that.he was being billed $6.00
bimonthly, the rate charged to customers connected to the sanitary
sewer system. He had stated that his house was not connected and
this proved to be correct, therefore, he should have been billed at
the rate of $4.00 every two months.
Our records indicate that he was overcharged as far back as June
of 1971, perhaps even further -- we haven't checked.
My question is: Is there any limitation of the period of time
during which he was overcharged, that can be refunded? For example,
if we find that he has been overcharged since 1965, can we
legally refund the over -collection in full?

On Tuesday, December 31, 1974, 1 talked with Mr. Ralph Argue
of 629 Paradise Lane in regards to his sewer connection. I explained
that the City Engineering Department is working on a solution to connect
his residence to the City's sanitary sewer system. Mr. Argue said he
would wait until he heard from the Engineering Department before
taking further action on the overpayments he has made on his utility
charge.

Dear Mr. Larson,
We have the listing for the sale of the property at 629
Paradise Lane, Edmonds. The ownership is the Estate of Alfred K. Man Ornum,
Deceased, Seattle—Fir3t National Bank, Executor, Trust Department, Head Office.
We also have a buyer for the same property who made application
to Seattle —First National for the financing by means of FHA loan. The FHA
appraiser referred the application to the Sanitary Engineering Department of
FHA,, without making an appraisal. It is unclear at this point why the matter was
referred to their Sanitary Engineering Department, If it is suspected that the
septic tank,,on which this property is located, is not properly operative, the
Executor will have it remedied.
However, if FHA is questioning if sanitary sewer service is
available to the property, they then would require a hook—up before insuring a
new loan.
In telephone conversation with persons in your office., who
I should mention have been most cooperative and courteous,, it is our understanding
that no sanitary sewer service is available to this property. If this is correct,
may we have your written confirmation to this fact. Your letter will then
be official confirmation for FHA, and will expedite the buyerls application for
financing.

Subject: Sewer Connection at 629 Paradise Lane
On Tuesday, December 31, 1974, 1 talked with Mr. Ralph Argue
of 629 Paradise Lane in regards to his sewer connection. I explained
that the City Engineering Department is working on a solution to connect
his residence to the City's sanitary sewer system. Mr. Argue said he
would wait until he heard from the Engineering Department before
taking further action on the overpayments he has made on his utility
charge.
