RELEASE OF COVENANT
WHEREAS, the undersigned ("Ownee,) own(s) the real property located at The
Sea Breeze, 633 Main Street #204 in Edmonds, Washington, legally described on the
coversheet and incorporated herein by this reference as if set forth in full ("the Property");
and
WHEREAS, the Sale Prohibition Covenant of Multiunit Residential Building, a
copy of which is hereto attached as Exhibit A, was signed by a person that was not the
property owner of the subject property at the time of execution;
NOW, THEREFORE, in consideration of mutual benefits accruing, the
undersigned Owner of the Property and the City of Edmonds hereby agree as follows:
1. Release of Covenant. For reasons noted above, the Sale Prohibition
Covenant of Multiunit Residential Building attached as Exhibit A, dated 8/25/2008 and
numbered 200808250546, never became legally effective or enforceable. And to the
extent it did, the same is hereby released and henceforth shall have no legally operative
effect whatsoever.
2. Preservation of Regulatoly Authority. Nothing herein shall be construed as
abridging or otherwise limiting the full regulatory authority of the City of Edmonds. This
preservation of authority specifically includes, but is not limited to, the -City's right to
requirethe Owner or any future owner of the Property to, as a condition of regulatory
permit issuance, execute a new covenant appropriately restricting the use of the Property.

against the title of the Property; and
WHEREAS, the recording cover sheet for the Sale Prohibition Covenant erroneously
listed the State of Washington as the Grantee; and
WHEREAS, the City of Edmonds desires to fully release the Sale Prohibition Covenant
to fullest extent permissible;
NOW, THEREFORE, in consideration of mutual benefits accruing, the undersigned
Owner of the Property and the City of Edmonds hereby agree as follows:

The City has received several complaints and claims regarding the
parking lot wheel stops next to the walkway being a tripping hazard.
The City's Risk Manager has asked for Engineering to find a solution.
The proposed solution is to remove the wheel stops and widen the
walkway using concrete with an exposed aggregate finish. The work
would be performed by the Public Works crews.
The Committee's opinion and/or concurrence is requested.

Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43.21C RC\V. requires all governmental agencies to consider
the environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be

Filter Barrier: This sediment barrier may be Constructed using
Sfanaard st Ingth synthetic filter fabric. It is designed for low
or moderate flows not exceeding I cfs.
1. The height of a filter barrier shall be a minimum of 15 inches and
shall not exceed 18 inches.
2. standard strength synthetic filter fabric shall be purchased
in a continuous roll and cut to the length of the barrier to avoid
the use of joints (and thus improve the strength and efficiency of
the barrier).
3. The stakes shall be spaced a maximum of 3 feet apart at the barrier
location and driven securely into the ground (minimum of 8 inches).
4. A trench shall be excavated approximately 4 inches wide and 4 inches
deep along the line of stakes and upslope from the barrier.
5. the filter material shall be stapled to the wooden stakes, and 8
inches of the fabric shall be extended into the trench. Heavy duty
wire staples at least 1/2-inch long shall be used. Filter material
shall not be stapled to existing trees.
6. The trench shall be backfilled and the soil compacted over the filter
material.
7. If a filter barrier is to be constructed across a ditch line or swale,
the barrier shall be of sufficient length to eliminate end flow,
and the plan configuration shall resemble an arc or horseshoe with
the ends oriented upslope
B. Filter barriers shall be removed when they have served their useful
purpose, but not before the upslope area has been permanently stabi-
lized.
Maintenance
1. Silt fences and filter barriers shall be inspected immediately after
each rainfall and at least daily during prolonged rainfall. Any
required repairs shall be made irnmediately.
2. Should the fabric on a silt fence or filter barrier decompose or
become ineffective prior to the end.of the expected usable life and
the barrier still be necessary, the fabric shall be replaced promptly,
3. Sediment deposits should be removed after each storm event. They -
must be removed when deposits reach,approximately one-half the height
of the barrier.
4. Any sediment deposits remaining in place after the silt fence or
- filter barrier is,no-longer required shall be dressed to conform
I with the existing grade. prepared and seeded.

Filter Barrier: This sediment barrier may be constructed using
standard strength synthetic filter fabric. It is designed for low
or moderate flows not exceeding 1 cfs.
1. The height of a filter barrier shall be a minimum of 15 inches and
shall not exceed 18 inches.
2. standard strength synthetic filter fabric shall be purchased
in a continuous roll and cut to the length of the barrier to avoid
the use of joints (and thus improve the strength and efficiency of
the barrier).
3. The stakes shall be spaced a maximum of 3 feet apart at the barrier
location and driven securely into the ground (minimum of 8 inches).
4. A trench shall be excavated approximately 4 inches wide and 4 inches
deep along the line of stakes and upslope from the barrier.
5. The filter material shall be stapled to the wooden stakes, and 8
inches of the fabric shall be extended into the trench. Heavy duty
wire staples at least 1/2-inch long shall be used. Filter material
shall not be stapled to existing trees.
6. The trench shall be backfilled and the soil compacted over the filter
material.
7. If a filter barrier is to be constructed across a ditch line or swale,
the barrier shall be of sufficient length to eliminate end flow,
and the plan configuration shall resemble an arc or horseshoe with
the ends oriented upslope
8. Filter barriers shall be removed when they have served their useful
purpose. but not before the upslope area has been permanently stabi-
lized.
Maintenance
1. Silt fences and filter barriers shall be inspected immediately after
each rainfall and at least daily during prolonged rainfall. Any
required repairs shall be made immediately.
2. Should the fabric on a silt fence or filter barrier decompose or
become ineffective prior to the end of the expected usable life and
the barrier still be necessary, the fabric shall be replaced promptly.
3. Sediment deposits should be removed after each storm event. They .
must be removed when deposits reach approximately one-half the height
of the barrier.
4. Any sediment deposits remaining in place after the silt fence or
filter barrier is no longer required shall be dressed to conform
with the existing grade, prepared and seeded.
