Your file has been forwarded to me for review and resolution. Our
records indicate that the City has contacted you numerous times to
serve notification that your building may not be occupied until a final
occupancy inspection has been performed and a Certificate of Occupancy
has been issued by the Building Official. The City has displayed great
tolerance in an attempt to resolve this issue without the need for
official action, but, as of this date, we have received no response to
our request.
Therefore, the City is now prepared to take action to complete the
unfinished work on your project if no resolution or agreement is
reached within the stipulated time. To avoid seizure of your cash
bond, you must take the following action by May 31, 1990:
1. Completion of the connection of the drainage detention tank
to an approved drainage system; or, reach a signed agreement
with Bob Alberts, City Engineer, for the completion of that
system within a reasonable period of time.
2. Schedule and pass a final building inspection.
If conditions listed above are not satisfied by May 31, 1990, it is the
intention of the City to complete the work required by the Engineering
Department and to assess the cost against your bond. The City has
verified that the performance bond funds held by Family Savings are
available for takeover by the City. If the cost of the work should
exceed the amount of the bond, you will be responsible for the
difference.
