Good news! I did some quick digging and discussion with staff and it is apparent from the original building permit that
the garage at 640 Pine Street was built with the house in 1961. The parcel was zoned R-6 in 1961 and R-6 had a street
setback of 15', sides of 5', and a rear of 15'. From the building permit (315-61), the setback values shown appear to be
either 'proposed' or 'as-builts' showing the structure at 15' from the street property line, 5' from each side, and 25'+
from the rear (more accurately probably about 40'). Either way, the upshot is that the garage was legally permitted and
met setbacks at the time of construction.
That said, the front S' of the garage is now nonconforming with respect to today's RS-6 street setback requirement of
20'.' That portion of the garage can be maintained in accordance with ECDC 17.40.020 but it can't be expanded in any
way that would increase the nonconformity.
I will be adding a note to our files to make sure the status of the house/garage is clear going forward.

The Engineering Division has reviewed the information submitted
in conjunction 0 with the subject rezone request. Issues raised
in the submitted material for which the Engineering Division
can provide additional information include the following:

3. Runoff rates, amounts, r . echarge reduction, and flooding.

the Planning Commission needs additional information regarding
these topics, we suggest they identify the topics of primary

The entire Shellabarger.drainage area will be the subject of
a basin planning study pursuant to Ordinance #192.4. This study
is now scheduled for next fall.

I am the property owner at 640 Pine St., and there is a proposal to move
a house on to the I - ot - in back of us. The lot in question is in an environ-
mentally sensitive zone because it is bisected by Shellabarger Creek.

The neighbors are very concerned about this action resulting in severe
drainage problems, view blockage and loss of privacy. The proposal includes
the culverting of the stream and we feel the environmental ass�ssment was
inadequate.
The building official is set to issue the permits on March 7, 1979. 1
believe additional conditions should be attached to the permits before they
are granted.
I would like to ask for a hearing before the City Council to appeal the
decision of the building official and ask that no permits be issued until
that time.
An answer to this request would be appreciated before March 7, 1979. 1 will
be attending the Council meeting on Harch G, 1979 to discuss this matter
further. '

STATE'MENT OF REASONS POR TOWN-SAN REZONE
Lots 6,. 7, 8 and 9 of Block 5 Of Yost's First Addition to Edmonds
are considered an environmentally sensitive area of the city because
they are bisected by Shellabarger Creek. As such,
we feel the area
should be p*rotected from a-verdeVelopment by rezoning it from RS-6
to RS-12, which,will accomodate the lots as they are*cur'rently platted,
but will prevent further subdivision.
We feel that subdivision. of . this area into a potential.of 8-9
lots (as allowed in an RS-6 zone, the a'rea Is. 609000 sq. ft.) would,
result in the'permanent culverting of the entire stream, and seriously
damage the environmental health of the communitYs Maintaining the
size of the existing four lots Would enable individual property'owners
to develop their lots in such a manner as to prevent permanent culverting,
preserve the stream's natural amenities and significantly reduce the
inevitable adverse affects of watershed development..
'The adverse affects of,watershed development are clearly expressed
in a report commissioned by the U. S. Environmental Protection Agency's
Office of Research and Development entitled Performance Controls for
Sensitive Lands:_ A Practical Guide for Local Administratorst
,"Streams and creek's aff . ect th . e quantity of a comunity's water
resources. Increased runoff and sedimentation from watershed
development can cause irregular flow and choke a stream's
connection with groundwat,er formations, thus creating*low and
irregular groundwater resources.

is an occasional s ' ource of Supplementary stream flow, Streams
and aquifers form an interlocking system of surface and groundwater
..r6sources, and the Pollution or degradation of one will eventually
affect the other.'

increasing ' the rate of stream flow, and arnking it irregular --
lo . w base flows and high peak flows. Thust dependent.groundwater
reservOirs will - also.,fluctuate,,depriving a. community of,a stable
supply of water.

VIDevelopmental effects ontlie rate of peak and base flows
of a.stream also increase the level of flooding by. altering
the character of the watershed so that -too much'water runs off at
one time. Moreovery increased sedimentation, associated with
rapid runoff, is deposited in'the streambed, thus raising the
bed and the level of flood waters.
"Flooding is seldom,catastro*phic, thanks to the moderating
ef - fects of vegetation, soil and;oig'anic litter, and wetlands,
Distrubance of these moderators -of runoff -can -produce unnaturally
high and occasbnally catastrophic fl-ooding. Thus an important
part of a community's flood control program includes regulation
of development in sensitive enviornmental�areas such as hillsides,
woodlands, and wetlands."
Current plans.for a small single-famil . y residence on Lot 9'
involve the installation of impervious surfaces of 3.,000 sq.ft. or
20% of the lot. If the remaining lots are developed in similar
fashion, the -percentage of impervious surfaces of t . he entire area will
probably be no less than 20%. , 'If the ar'(!a is subdivided . and 'developed.
into 9 lots of 6,000 sq.ft. as allowed in, the current zoning, 9
similar single-family developments I of 3,000.sq.ft will increase the
percentage of impervious surfaces to 50%
As you can see from Figure 2 from the USEPA report, if . the lots
are developed asthey are, the % of increase I j_n peak fl I ow of mean
annual flood will be 225%. If the RS-6 zone is maintained, and the
lots are developed at 6,000 sq,ft., the % inccrease-in peak flow
of Mean annual flood will increase to 325',',',.
If E * dmonds wants to maintain a stable surface and groundwater
supply.as well as minimize the damages of flooding, It must regulate
development in the watershed so that protective soils, vegetation,
and wetlands are maintained and -runoff is not significantly increased
by too many impervious surfaces.
Development near creeks and streams affects the quality as well
as the quantity of our water as well.
"Increased sedimentation has serious results. It may increase
the tur ' bidity -- -the amount of susoended particles in the water
cutting down the light reaching lower parts . of the stream and thus
killing many species of.plants and animals. such organic dej)ris,
including that added by more runoff.but not flusdied out' by stream
flow, increases the number of decomposing bacteria which use up
the.a . vailable oxygen, contributing even more to stream pollution.
The. result is an algae -choked, biologically depleted stream..
"Increased sedimentation of a stream bed can force the
stream to seek a new channel, resulting in additional:'erosion and
problems from sedimentation.

the site and reduce impervious surfaces, cuts and fills".
Streams.and creeks are sensitive areas. Developmental activity
within'and adjacent to the watercourse . has. profound effects on stream
hydrology, channel geometry, and water quality. We recognize that '
development of private property cannot be denied. However', development
can be sensibly controlled to minimize'the adverse affects in
environmentally sensitive areas merely by implementing the polic . ies
stated in the Edmond's Policy Plan.
Several factors have been sited by the state S . upreme court as
being of -paramount concern in any rezone consideration. This rezone
applicatio . n s-ii-tisfies all of the.criteria e,stablished.
"l. Does the proposed zoning change conform with the comprehensive
plan?"
Ye , s. The -Comprehensive plan indicates,this area should be used for.*.
single family.reside.nce.* The plan also states that areas identified on
the environmentally sensitive areas map should be zoned in large lot
sizes to reduceimpervious'surfaces, cuts and fills . . Since.the area
in.question is identified as an environmentaILy sensitive area., this
rezone action will serve to promote the policies of the comprehensive
plan, which thecurrent zoning does not.

The existing zoning of the surrounding property is R
S 6 and RS-12.
However', the.surrounding land use is predominantly RS-12. Over
.51% of the lots in the area are over 121000.sq.ft. Only 15% of the
owners of large lots have subdivided and sold them as small 6,000 sq.ft.

One of the lots'in question is currently being de . veloped with a
single family residence. Theimpact on the current environment is
significantly negative to arrouse community concern'over the
affect 'of-7 or 8 additional developments. For instance, this develop-
ment.has culverted 40 or 50, of the creek for access.- Multip
ly this.
by 7 or 8 similar situations and it is clear that. the entire stream
will end up culverLed. Moreover, increcised-runaff erosion and
sedimentation from development above this area has'already created
a serious enough drainage* problem for the northern end of the area
tocause one,fence to collapse, concrete foundations included.

imposed upon the individual owner-,,
The gain -to the public is unquestionable given the decrease . d potential.
for erosion, sedimentation and flooding. Zoning for a lower density
will also ' protect the existing open space, privacy, and 'Views of the
current neighborhood.. It hasIbeen demonstrated'that� the individual'
owner will suffer no economic loss. The pr*evious owner was able to
sell all of lot 9 for twice as -much as she.was asking for half of
lot 9. The owners of the-property'can realize the same profit from
selling the * lots as they now exist as they can from selling them
subdivided.
"5. The extent to whicth the'diminuation of values (in the case of
a downzone) promotes the Public health, safety, morals or welfare;"
Thore is no diminuation of values. In fact, by maintaing the
environmental quality of the land, the property will probably
increase in its value. The gain*to the,pu

This rezone does not preclude the use.of.this p roperty for any purpose
to which it is reasonably adapted. On the cont I rary, it facilitates
the reasonable use..of.this land in a manner which is equally as
pofit . able.to the owner asthe current zoning allows.
Oponents of this rezone action will argue thaL this is a
spot zone". If a "spot zone" means a parcel of land which has been.'
,zoned differently from its surrounding area, than every zone in this-'
City would be considered a.11spot zone".. There is no zone on the
Edmonds zoning map'that is not zoned differently from its surrounding
areas
The true meaning of a "Spot zone" is a 'parcel of land that is
zoned differently from iLs.SUrrounding area for completel I y, arbitrary
and indefensible reasons. Clearly, the rezoning of this propoerty is
based upon very real and significant reasons-, and in no way constitutes
a "spbt zone".
We would like to urge the. city togive this rezone action
its full attention and consideration.

Afterreceiving complaints, the Engineering Division staff
of the Public Works Department made a field inspection. We
found a fence located in the public right-of-way in the alley
between "A" Street and Seventh Avenue south of Pine Street.
There is no permit on file for the fence. This installation,
therefore, is a violation of the City Code. It is requested that
you contact the Engineering Division, Public Works Department,
,at 775-2525, extension 220, and Mr. Harry Whitcutt of the Building
Division, Community Development Department, 775-2525, extension 253,
immediately upon receipt of this letter so the,problem can be
resolved. Our office hours are from'8:00 a.m. to 5:00 p.m.,
Monday through Friday.
Since this matter could involve damage to property and

Thank you for your letter dated March 26, 1979. The
property in question is not an easementbut a platted right-of-
way which allows access to the rear of the properties on either
side. Until there.is a demand or request for the use of the
alley, we generally allow the adjacent property owners to use
and maintain it. This controls the weeds and benefits both the
home owner.s and the City..
We have received a complaint from one of your neighbors who
now desires to use the alley. We must respond to the request
by either issuing a "Street Use Permit" to you or requiring you
to remove any obstruction which'you have constructed.
I have enclosed an application for your convenience. If
you desire to keep your fence, you will need to complete the
form and obtain the signatures of your neighbors whose properties
abut the alley between Pine and Fir Streets. Otherwise, it will

ks I explained to you personally., the fence referred to in your letter
was installed in 1964 by Liumbermenta. I naturally asumed they took out the
necesaoxy permit if needed. It is,possible., as you mentioned., that permits
for fences were not required in 1964. .
Before the fence was:installed.$ I called on the City Engineer., ( Iassume
it was Leif Larson) in person to secure approval for installing the fence on
city property. The City Engineer approved and actually recomended the in-
stallation of the fence.9 He stated that the City preferred to have neighbors
adjacent to the sewer easement use the property because in so doing, the City's
property would be weeded., mowed,, and taken care of resulting in saving money
for the City which it would otherwise have to spend for maintenance.
The City Engineer told me further that the City had a,15 ft. sever ease-
ment extending from Pine St. to Fir St, I questioned the City Engineer as to
what would happen if after the fence was installed,, the City wanted to repair
or clean out the sewer, He stated that if the City wanted to get into the
sewer where the fence was located,, the City would remove and replace the fence
at its expense,
. I 'With this assurance and approval from the Engineering Dept,., the fence
was installed. In addition I installed a birch tree., shrubs., razzberI7 plants.,
and an underground sprinkler adjacent to the fence.
My neighbor directly to the East of our property leveled the ground and
instal -led shrubs on his side of the fence, Together we have mowed the grass..
cut weeds., and maintained the City's easement for the past 15 years.
I trust that you -will honor the commitment made to me by your department
in 1964.
