HISTORY AND SUMMARY STATEMENT:
The land -owners, Thomas and Janis Kane, at 641 Edmonds Way,need.access to City
sewers to construct an addition to their house. In return, they are willing to
agree that it will be a temporary connection and will support a L.I.D. when one
is formed in their neighborhood. At that time, they will disconnect and
reconnect to the new L.I.D. installed sewer.

AGREEAIENT FOR TEMPORARY SEWER HOOKUP
WEEREAS, the undersigned owners of property in the City of Edmonds, Washington
desire to connect to the sewage system of the City of Edmonds;
WHEREAS, the City is willing to permit a temporary hookup to its system but requires
thata more permanent connection be made at the date and in conjunction with the extension of
permanent City -sewers to the a= in which the subject tract is located;
WBEREAS, as a condition of temporary hookup the property owners acknowledge the
temporary nature of the connection with the understanding and stipulate that they will participate
in a future local improvement district for the extension of sewers and that the right to such
temporary connection shall expire automatically at the date that such district is formed or a
permanent sewer hookup is made available through the local.improvement district;
NOW, THEREFORE, the undersigned owners of real estate (hereinafter "property
owners") and the City of Edmonds, Washington (hereinafter "City") do enter this Agreement
under the terms and conditions set forth herein:
1. Subject Tract. This Agreement for a temporary sewage connection relates to
certain real estate located in the City.of Edmonds, County of Snohomish, Washington, more
particularly described on the attached Exhibit A which incorporated by this reference as fully
as if herein set forth.
2. Run with the Land. This Agreement for a temporary sewer connection and its
expiration touches and concerns the subject tract described in Paragraph I above and shall run

with the land inuring to the benefit and subject to the obligations created to future owners of the
property, their successors, heirs and assigns.
3. Limited Right to TemRQma Sewage Connection. In consideration of the
expiration of the temporary sewage line, the benefits to accrue to the public health, safety and
welfare and the agreement of the property owners to participate in a future local improvement
district,, the City has agreed to extend temporary sewer service under the terms and conditions
set forth herein. The temporary'connection shall be constructed in accordance with standards
developed by the City engineer of the City of Edmonds. The connection is a temporary line in
that the right to utilize such line is a connection to the sewage system of the City of Edmonds_
shall expire as provided herein at the date a permanent sewage line is extended whether at the
cost of utility or by local improvement districts or six months from the date of formation of a
local improvement district or utility local improvement district, which ever shall first occur, at
which time the property owner shall pay all charges and fees associated with such connection
and participate in such local improvement district in accordance with the laws of the State of
Washington.
4. No Benefit Implied by Temp2raU Extension. In the event that a sewer line is
extended through a local improvement district or a utility local improvement district at some date
in the future, the property owners on behalf of themselves, their.heirs, successors and assigns
do hereby stipulate and agree that due to the temporary nature of the line they shall not be
deemed to have received a benefit from the temporary sewer treatment line and in the. event that

a permanent sewage treatment system is installed by or through a local improvement district or
utility local improvement district, the property owners stipulate that they shall be specially

benefitted in the same manner as neighboring properties which are not currently served by a
temporary sewer connection. This Agreement is � not a "No Protest Agreement" and the owner
shall maintain any rights that they may have at law to challenge the amount of the special
assessment, if any, or protest the formationof a local improvement district or a utility local
improvement district, provided, however, in the event of such a formation of a local
improvement district or a utility local improvement district, the right to their temporary line shall
expire six -months from the date of formation from the district at the date a permanent sewage
treatment line is available to thernP whichever shall first occur.
5. Entire Agreemen . This Agreement is the entire written agreement between the
parties. Any other understanding written or 'oral is deemed merged with this Agreement,
provided, however, that this Agreement shall. not be deemed to amend or limit any right or
obligation created by City ordinance or state law.and generally applicable to the City or to its
utility patrons including, but not limited to, ordinances relating to sewer hookup fees, rules
relating to cutoff and other regulations relating to utility patrons which. are of general
applicability.

SUBJECT: SEWER.LINES-FOR SR-104 AND-6th AVENUE
On January 24, 1983 at 7:30 a.m., Marty Burns and I investigated
the ESR files to find if any sewer lines had been put in around
619, 625, 629, 639, 641, 643, 645 and 651 Paradise Lane. When
we found nothing in the ESR files, I looked up the Paradise
Lane addition in the blue filing cabinets -and found a proposed
map that showed an 8" sewer line with one M/H and two C/0's.
(See attached map.)
At this time, we went out to the field and investigated the area
by trying to locate the M/H with the metal locater and visually
seeing into M/H 268-12 where the sewer line was suppose to come
into, but could not see any 8" line into the M/H. We decided
to smoke test from M/H 280-12 to find out if the residences
at 619 and 625 Paradise Lane were connected into the line
that comes in off 13th Way, but found out they were not
connected in. We then smoke tested from M/H 268-12 to see if
629, 639, 641, 643, 645, or 651 Paradise Lane were connected.
We found only two houses connected in, 639 Paradise Lane
and 651 Edmonds Way (Dental Clinic). These were connected
up with a 6" line that runs into the trunk line just before
M/H 268-12 and runs down the alley between the two addresses.

trying to get sewer lines�lin there because she has been paying
for them and they aren't there. Also she said she has constant
problems with her septic tank backing up, so we advised her. -
that we were looking into the problem and would try our best
to get something done.
