The -subject property is currently zoned RM-2.4 per an approved rezone (R-1768). The dental'clinic was
allowed under an'approved Conditional Use Permit (CU-31-68). If the building on'the subject lot . was.
destroyed, its useas a dental clinic could continue as long as the use and structure did not expand bey6nd
the approved Conditional Use Permit. If the use and/or structure are expanded, a new Conditional Use
Permit would be required.
If the building conforms to the setback -requirements at the time of de�truction, it could be rebuilt to the
same parameters. If the building does not conform to the setbacks but is defined as legal nonconforming,
it could be restored to r the same parameters if destruction does not encompass more than 50% of its
replacement cost at time of destruction. Jf destruction is more than 50% of it rep 14cement cost, the
building would be required to meet the setbacks of thic�code at the time of reconstruction.
