A site inspection confirmed the presence of a.stream, Shell Creek, on or adjacent to the west side
of the property. Prior experience with this reach of Shell Creek lead the City to believe it is a
oot buffer from
category 2 stream that bears salmonids. This category of stream requires a 50 f
the banks of the stream and a 15 foot building setbackis required from the edge of the buffer.
Adjacent to the stream, the site is covered with blackberries and other vegetation to the point
where it is impossible to determine if there are any wetlands associated with the stream. No
permits will be issued for this property until the.appropriate study(ies) have been completed.
In this case, the study is a two part document:
• First, a three party contract with a wetland biologist or another. qualified consultant must
be completed to confirm the presence or absence of any wetland on the property. This
consultant will also be responsible for delineating the stream bank and the edge of any
wetiand as described by 20.1513.060. If there is a wetland on the property, the biologist
will also need to classify the wetland based on the criteria listed in that same section.
• The second part of the Critical Areas Study is a site plan prepared by a licensed surveyor
locating the stream and any wetland. The required Critical Areas buffers and 15 foot
building setback must also be shown on the plan.
After receiving City approval, you will need to gain the approval of the State Department of Fish
& Wildlife (DFW Mill Creek office) through an Hydraulic Permit Approval (HPA) and comply
with any recommended mitigation measures to ensure protection of the stream proposed by the
DFW.
if the property owner wishes to'apply for a speciric development permit which they feel
would not'impact the Critical Areas located on the site,, they may submit their proposal to
the Planning Department for review. If staff finds that the proposed development permit
win not adversely impact a Critical Area of its buffe P1 a conditional waiver may be issued

The subject property, located at 690 Melody Lane, Edmonds, Washington (Figure 1), was
purchased by Mr. Jamie Schwartz, owner of Silver City Construction Co. as a residential single home
development site. Following the purchase of the property, a wetland delineation was performed on the
site. A small emergent wetland was identified at the western end of the property along the bank of Shell
Creek, which runs north -south across the property. The wetland and stream are located in the flat, low
area along the western portion of the site and are currently protected from construction activities onsite by
a silt curtain placed along the wetland boundary. A 50-ft buffer was established for the wetland and all
design activities were planned to the east of the buffer area. During preliminary activities to prepare for
the exterior terrace and landscaping in early 2004, the landscaping contractor. Mistakenly cleared the area
designated as wetland buffer. Although no wetland area was disturbed, the majority of vegetation within
the wetland buffer was mechanically removed, with the exception of one mature red alder tree. The City
of Edmonds (City) requires the buffer to be restored at a 1: 1 ratio. This memorandum identifies the area
that was cleared and proposes mitigation to restore the wetland buffer; As discussed with the City, this
mitigation effort does not require a planting plan.
ExiSTING BUFFER CONDITIONS
The buffer is located on a gradual westerly slope grading down to Shell Crdek. Prior to clearing,
vegetation in the buffer consisted of approximately 90 percent dense Himalayan blackberry (Rubus
procerus) that stood approximately 6 to 9 ft tall as reported by Mr. Schwartz. The blackberry extended
beyond the buffer to the east into the upland areas designated for future landscaping. Soils within the
buffer area, observed during two site visits in early and late spring 2004, consist of well -drained sandy
Soils.
Following the clearing, the area was allowed to re -vegetate naturally throughout the spring. As expected,
the Himalayan blackberry has started to re -grow in the cleared area, with some stinging nettle (Urtica

ciioica) growing under the remaining large red alder (,41nus rubra) at the south end of the cleared buffer.
If left alone, the buffer area is expected to develop back into a densely vegetated stand of blackberry.
PROPOSED RESTORATION
Although time and nature would repair the buffer back to its pre -cleared condition, the City has
agreed that this modified restoration plan would not only repair the cleared buffer area, but allow for
some habitat improvements to this system. Landau Associates recommends planting a series of trees in
the cleared area in order to shade out the blackberry. Both big -leaf maple (Acer inacrophyllum) and
lodgepole pine (Pinus contorla) are expected to tolerate the sandy, well drained soils. These species will
improve the habitat in the area and should provide enough shade to help control the spread of blackberry
on the property. Planted trees will need to be well established and of sufficient height (8-10 ft) to provide
immediate shade to the growing blackberry.
As shown on Figure 2, the cleared buffer is 3690 W. The existing red alder provides shade to
approximately 25 percent of the buffer area. The remaining area should be planted with the maple and
lodgepole pine approximately 20 ft on -center throughout the cleared buffer. This will require a total of
nine to eleven trees to be planted. Additional trees could be planted at smaller intervals, providing greater
shade to control the blackberry; however, some tree removal would be necessary in future years as they
mature.
I Nine to eleven trees will provide immediate shade to the buffer area and slow the development of
the Himalayan blackberry, although periodic maintenance of the blackberry will need to occur for
approximately 3-5 years.
To help establish the planted trees through the upcoming surnmer months, a temporary irrigation
system wfll need to be installed. The irrigation system needs only to be a drip line, aboveground system.
Due to the gradual slope of the property, the drip system will allow water to drain from the upper portion
of the buffer to the trees in the lower buffer. Periodic visual inspection of the trees following planting
will help determine if the flow of the drip system is providing enough water. Wilted or burned looking
leaves and needles are an obvious sign that the flow needs to be 'increased.
The City requires only trees to be planted on the Melody Lane property to compensate for
clearing the bu",ger. A list of native shrub species is provided below, at the City's request, to allow future
homeowners to plant the buffer with appropriate buffer species, if desired. Planting additional shrub
species will increase the habitat functions of the buffer and will serve to further shade the Himalayan
blackberry. All of the listed species occur frequently in wetland buffers throughout the area. The species
below have been chosen not only on their ability to tolerate the site conditions, but also for their ability to
provide wildlife forage and habitat, and aesthetic appeal.

The proposed shrubs would provide a greater variety of shrub cover than that originally present in
this area, replacing dense thickets of Himalayan blackberry. As long as the specified plants are used,
shrubs are planted in the early spring or late fall, the blackberry is cutback at least twice a year for a

minimum of three years, and the new plantings are watered regularly during the first two growing seasons
after installation, shrub plantings within the buffer are expected to be successful.
CONCLUSION
The City has agreed that this modified mitigation plan will compensate for the accidental clearing
of 3690 ft' of wetland buffer at 690 Melody Lane. Landau Associates suggests the planting of nine to
eleven trees in the cleared buffer to help shade out the returning Himalayan blackberry and increase the
habitat value of the buffer and adjacent wetland system. Given the well -drained, sandy soils on the slope
of this site, big leaf maple and lodgepole pine are expected to do well. If additional planting is desired by
Silver City Construction or future homeowners, a list of acceptable shrub species has been included 'in
this document. These species would assist in reducing the growth of Himalayan blackberry as well as
provide forage and habitat for wildlife.
