WIEEREAS, the owners of real property are located adjacent to City property described
herein which separates the privately owned property from public right of way; and
W11EREAS, no easement exists for the property owners to cross the public property in
order to access the City right of way; and
WHEREAS, a process has been initiated by the property owners to acquire either an.
easement I or the public property as surplus to the needs to the City in consideration of payment
of appropriate but as yet undetermined compensation to the City; and
WHEREAS, the City wishes to confirm the existing passage of the property owners
across the public property by this revocable license prior to and in anticipation of actual t�ansfer
of the property for its fhir market value;
NOW, THEREFORE, the City of Edmonds, Washington (hereinafter "City") does hereby
transfer to the owners of certain real property, their heirs, successors and assigns (hereinafter
"Owners") a revocable license for access over and across the public property as described herein
for, but only for the uses specified in this license:
1 . Benefited and Burdened PropgAies. The license shall lie on and over certain real
property owned by the City and described in the attached Exhibit A and referenced herein as the
burdened property. The license is shown or described on the attached Exhibit B. The license
shall benefit certain real property with a street address of
6915 - 174th §t. S.W. and legally described as:
Beginning at the SW coiner of Tract 144, Meadowdale Beach, as recorded in
Volume 5 of Plats, Page 38, records of Snohomish County' WA; thence N
0*22'42" W along the West line of said tract, 160.00 fe;t; thence S
89*32'21" E, 80.00 feet; thence S 0*22'42" E, 160.00 feet to the South line
of said tract; the N 89*32'21" W along said South line 80.00 feet to the
point of beginning. Also known as Lot C of City of Edmonds Short Plat
S-3-76 as recorded under Auditor's File No. 7607010216., records of
Snohomish County, WA.
The above described private property shall constitute the real estate benefited by this revocable
license.
2. Revocation. No consideration has been provided for this license other than the
promise of the Owners to initiate a process to, acquire. by purchase from the City as surplus
property an easement or actual ownership in fee of all or a portion of the burdened property.

This license shall therefore be revocable at the sole discretion of the Edmonds City Council upon
ten (10) days written notice.
3. Sole Aareement Amendment. This agreement is the sole agreement between the
parties. Any understanding, writing or oral, shall be deemed merged with the provisions of this
license. This license shall be amended only in writing with the express written consent of tht
parties hereto.
.4. InteWretation. This agreement shall be interpreted in accordance with the laws
of the State of Washington. Nothing herein shall be interpreted to waive any right possessed
by the City; which specifically reserves the right to revoke this license or exercise any other
lawful authority available to it. The property.owners shall not bejustified in r�liance upon this
license except for temporary access pending ac4uisition of an easement or a fee in all or part of
the burdened estate. No structural improvement of any kind or nature shall be placed on the
licensed area other than an appropriate driveway surface installed in accordance with City
ordinance and the approval of the City Engineer.
