Code Enforcement has been contacted regarding the cutting/topping of trees in the critical area at the western area of
your lot. Planning Division mapping (enclosed) indicates this area as a Critical Area (wetland or wetland buffer, steep
slopes). This would preclude any activities/impacts that degrade the function and value of the critical area as follows:
ECDC 23.40.320 "Alteration " means any human -induced action which changes the existing condition ofa critical
area or its buffer. Alterations include, but are not limited to: grading;.filling; dr&dging,- draining; channelizing;
cutting, pruning, limbing or topping, clearing, relocating or removing vegetation; applying herbicides or pesticides or
any hazardous or toxic substance; discharging pollutants; paving, construction, application ofgravel; modifyingfor
surface water management purposes; or any other human activity that changes the existing landforms, vegetation,
hydrology, wildlife or wildlife habitat value of critical areas.
23.10.1310 General regulations — Environmentally sensitive areas and critical areas.
A. Locati . on.
1. Environmentally sensitive areas include steep slopes; marshes,.bogs, and swamps; floodplains; streams; spawning
beaches; and other areas exhibiting serious constraints on development andlor significant possibility of biotic
productivity.
2. Critical areas include fish and wildlife habitat conservation areas; frequentlyflooded areas; geologically hazardous
areas; streams; and wetlands.
B. Development Limitations. All uses, developments, and activities on sites containing environmentally sensitive areas
andlor critical areas must comply with all applicable local, state, andjederal laws pertaining to development in these
areas. In addition, the site must be specifically designed so that the hazardsfrom or impact on thegnvironmentally
sensitive area andlor critical area will be mitigated
C Additional Authority. In addition to any other authority the city may have, the city is hereby authori zed to condition
or deny a proposed use, development, or activity.or to require site redesign because of hazards associated with the use,
development or activity on or near an environmentally sensitive andlor critical area, andlor the effect of the proposal
on the environmentally sensitive area andlor critical area. [Ord. 3318 § 3, 2000].
Corrective actions required:
Please note that cutting or topping of trees in a critical area requires Planning approval pjigr to cutting.
Please contact the Planning Division prior to any alterations or if you have any questions regarding the
application of Critical Area regulations.
