INTRODUCTION
The purpose of this memorandum is to address stability concerns for temporary shoring along the
t 701 Cedar Street in Edmonds, Washington. Our current understanding of
eastern side of the excavation a
schedule, as indicated by JeffjSuridge, is that this temporary wall will be removed in about 1 week time
from the date of this memorandum. It should be noted that at the time of this memorandum, the current
wall has been in place about I 'week.
Landau Associates was retatined by AKA Design (now JTS Property Solutions) to per
form a
limited geotechnical investigation to identify depth to adequate bearing for the foundation of the proposed
addition and to provide during construction foundation subgrade verification. The results of that limited
investigation and subgrade rec mmendations were presented in a report dated March 2, 2006. Generally,
adequate soil bearing (2000 psf) was encountered at a depth of about 2 to 3.5 feet below the original grade
of the site.
Recently, when Landau Associates was asked to perform during construction inspection of the
footing subgrade, We noted that the footing depths and subsequent cuts for construction of the footings
were deeper than our original� assumptions, which were stated in our proposal and our March 2 report,
Our stated assumptions include; d "no significant cuts would be required."
As a result of the cuts required to construct the footings and the proximity of the neighboring
house to the east, temporary horing was placed by the contractor (Quality Improvement Company).

installation. The initial temporary shoring is reported to have consisted of a row of stacked ecology
blocks along the eastern edge of the excavation. Prior to Landau Associates commencing our first
subgrade verification visit, the i blocks fell over. The failure mechanism is not known.
After our initial subgrade verification visit by a staff engineer, a senior engineer with Landau
Associates performed a field �visit to respond to a neighbor's concern regarding the stability of the

excavation and the temporary shoring. The contractor was in the process of re -building the wall and
reportedly removed some soft ground from under the failed wall and replaced it with crushed rock prior to
re -building the temporary wall. Subsequent observation of the re -built wall indicates that the wall is
composed of ecology blocks that have been stacked 3-blocks high. The ecology blocks are generally 2-
feet wide, 2-feet deep and 6-fect long. The wall is generally in the shape of a long "L" with the long leg
oriented in a north -south direction. The south end of the wall terminates at the existing house and the
short leg of the wall is at the northern end.
Currently the first (lowest) row of blocks has been used as sacrificial form -work for the footing
such that only the top 4 to 6 inches of the block is exposed. Because of the previous instability of the
slope behind the wall, we recommend the bottom -most row of blocks remain in place to reduce the
potential impact of wall removal to the slope and it is our understanding that the bottom row of blocks
will be left in place.
The configuration of the soil on the back side of the wall varies from the north end to the south
end. At the north end, the soil contacts the back side of the wall about 3 feet below the top of wall, is
inclined at about 60 degrees measured from the horizontal with the top of the slope about 4 feet above the
top of the wall. At the south end of the wall, the soil contacts the back side of the wall about I foot below
the top of the wall and is inclined at about 45 degrees with the top of slope about 3 feet above the top of
the wall. All dimensions, depths and estimates of slope behind the wall were reported to Landau
Associates by Jeff Suridge and have not been surveyed to confirni accuracy.
The static stability of the temporary shoring was analyzed for three wall configurations. The first
two conditions are for the wall and slope configurations described above. The third configuration
assumes soil to the top of the current wall with a 45 degree backslope. This corresponds to the possible
geometry of the slope/wall at the south end of the wall if the soil behind the wall sloughs to the top of the
wall.
Although the engineering properties of the soils on the slope, behind the wall and under the wall
are not known, it is our opinion that they will be remain stable for the next week, presuming they are
protccted from the elements and from surface water run-off. Soil properties of the retained soil were
estimated based on our observations of the soils under the black tarp currently covering the slope and our
experience on sites with similar soil types.
Based on our analyses, the current configuration of the wall is considered stable with a calculated
factor of safety of about 1.5. As is typical with temporary shoring, the wall was not analyzed for seismic
loading. If the soil behind the wall were to slough against the wall, we estimate the factor of safety would
be reduced to about 1.3.

It is important to note that these calculations are based on our understanding of the soil and wall
conditions at the time of this report. If conditions change, Landau Associates should be retained to re-
evaluate the stability of the wall.
Even though the static analysis indicates factors of safety above 1.0, it should be noted that the
slope and temporary shoring configuration do not meet the standard requirements of Part N of Chapter
296-155 of the Washington Administrative Code (WAC) for Excavation, Trenching and Shoring.
Because the slope and the shoring configuration do not meet the requirements, Section 296-155-66109 of
the WAC requires that
"The registered Professional Engineer shall inspect the work site at the beginning of each
shift, after any change in weather conditions and after any change in the circumstances of
adjacent property,
The Professional Engineer shall make a written report of each inspection, the report shall
be kept on file at the work site, and the report shall be made available to the director or
the authorized representative of the director upon request.

and soil conditions shall be followed.,,
Additional safety recommendations include:
Maintaining the plastic sheeting over the slope to reduce the potential for soil sloughing. The
sheeting should be placed such that surface water and rain water are both kept off of the slope.

CRITICAL AREAS RECONNAISSANCE REPORT: STUDY REQUIRED (CA-2005-118)
During review and inspection of the subject site, it was found that the site may contain or be adjacent to
critical areas, including an Erosion Hazard Area and Stream pursuant to Chapter 23.40 of the Edmonds
Community Development Code (ECDC).
GENERAL CRITICAL AREAS REPORT REQUIREMENTS
Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject property that
may qualify as critical areas. They also assess these areas and identify any potential impacts resulting
from your specific development proposal. If a specific development proposal results in an alteration to a
critical area the critical areas report will also contain a mitigation plan. You have the option of completing
the portion of the study that classifies and delineates the critical areas and waiting until you have a specific
development proposal to comple ' te the study. You may also choose submit the entire study with your
specific development application,
Please review the minimum report requirements for all types of Critical Areas which are listed in
ECDC 23.40.090.D. There ate additional report requirements for different types of critical areas (see
below).
Note that it is important for the report to be prepared by a qualified professional as defined in the
ordinance. There are options on how to complete a critical areas study and an approved list of
consultants that you may choose from. You may contact the Planning Division for more information.
General Mitigation Requirements for all Critical Areas are discussed in ECDC 23.40.110 through
23.40.140.
STUDY REQUIREMENT — EROSION HAZARD AREA

Areas report requirements for Fish and Wildlife Habitat Conservation Areas are provided in ECDC
23.90.020.A to C and additional technical information requirements for streams are listed in ECDC
23.90.020.D.
DEVELOPMENT PROPOSALS ON A SITE WITH A STREAM
Development proposals that encroach into streams or their buffers or building setbacks may be allowed
through the approval of certain processes.
The width of a stream buffer may be reduced through buffer enhancement if through the review of a
Stream Buffer Enhancement Plan that meets the specific requirements referenced in ECDC
23.90.040.D.2. The maximum amount that a buffer can be reduced through buffer enhancement is
50%.
A buffer may also be modified through a process called buffer averaging. The criteria applied to
buffer averaging are listed in 23.90.040.D.2. The maximum amount that the buffer width can be
reduced at any single location through buffer averaging is 50%.
Development proposals that propose encroachments into buffers beyond what is a ' I ' lowed through the
above methods require a Critical Areas Variance or a Reasonable Use Exception. If you think that
you have a proposal that may require one of these process I es, please contact a Planner for more
information.
ALLOWED ACTIVITIES
Certain activities are allowed in or near critical area buffers as specified in ECDC 23.40.20. If you have

Court order to move property line between 701 and 711 Cedar Street
During inspection of an addition on the property addressed 701 Cedar Street (approved
under BLD-2006-0043), it was found that the addition did not meet the minimum
required 5-foot side setback from the eastern property line. The property owners at 701
and 711 Cedar Street brought the property line dispute to court, and a court order was
issued moving the southern 79.09 feet of the property line separating these two properties
to the east by 1.40 feet. The addition at 701 Cedar Street (under BLD-2006-0043) now
meets the minimum required 5-foot side setback from the eastern property line; however,
the original house continues to be nonconforming because it still does not meet the 5-foot
side setback from the eastern property line.

We spoke the other day regarding a boundary line dispute between two neighbors in Edmonds.
You have proposed using the provisions of RCW 58.04.007 to resolve the dispute. Our
conversations have regarded the City's role in such a process.
As you are aware, RCW 58.17.040 (6) exempts from the platting statute boundary line
adjustments which do not create an additional lot and which contains sufficient area and
dimension to meet minimum requirements for width and area of a building site. These
provisions are mirrored in ECDC 20.75.050 (C)(2) and (3) which prohibit approval of a lot line
adjustment which would produce setbacks below the minimum required or reduce lot width or
lot size below the minimum required for the applicable zone.
Therefore, any adjustment made by your clients would be required to be approved by the City
through a boundary line adjustment process. Failure to do so would create illegal.lots -- that is,
the structures and lots would not be entitled to nonconforming use fights because they were not
pen-nitted by an action of the:City. The difficulty, of course, is that the City cannot approve the
agreement between your parties because of the limitations of its ordinance and of state statute.
Please note a recent decision of the Court of Appeals, Division I in Mason v. King County.
Decision # 56341-6-1, 206 WL 2467912 (Wash. App. Div. 1). This decision published August
28, 2006 is on all fours with our situation. King County attempted to avoid the statute by
arguing that the application should be concerned only with a "minimum lot area for
construction." The Court, however, held that a boundary line adjustment must meet the
minimum size and width requirements. Because one of the newly created lots would not meet
the minimum width requirement,it could not be approved.
As I have indicated, if the parties take a stipulation disposition to Superior Court and the Court
determines where the boundary line is based on adverse possession, the City is required to accept

the court order. Unfortunately, you cannot utilize the City's processes to obtain that same
approval. To do so would jeopardize the legal nonconforming status of existing structures to the
extent that they exist.

Landau Associates completed a critical areas site reconnaissance for the property located at 701
Cedar Street (subject property) in the City of Edmonds, Washington (City). A residence on the property
and an associated driveway Itie approximately 10 to 40 ft, respectively, from an unnamed stream. This
stream originates from a spring that is located to the east on a neighboring property. This letter report
summarizes our findings of the site reconnaissance and provides technical information required by the
Edmonds.Community Development Code (ECDC) for critical areas, adopted February. 2005.
Before the site reconnaissance, Landau Associates biologists reviewed information from readily
available public domain resourc6s. This information was used to gain a general understanding of
potential critical areas 'issues on and near the project site. These resources included the Catalog of
Washington Streams and Salmon. Utilization, Puget Sound (Williams et al. 1975), the Digital Coastal
Atlas [Washington State DepartrPent of Ecology (Ecology) 2005], City of Edmonds' critical areas
inventory maps (City of Edmonds 2005), and appropriate ECDC sections pertaining to streams and
critical areas (ECDC 2005).
After completing the data-gatherting task, a biologist from Landau Associates conducted a site
reconnaissance on September 23, 2005, to document the existing site conditions.
REsum OF INFORMATION REVIEW AND SITE RECONNAISSANCE
The Catalog of Washington Streams and Salmon Utilization, Puget Sound does not mention this
unnamed spring or stream. Ecology 's Digital Coastal Atlas also does not show the spring, stream, or any
other environmental concerns on or around the subject property. The City of Edmonds' critical areas
inventory maps indicate that the subject property is within an erosion hazard area.
The site recotmaissance included visual observations of adjacent properties and interviews with
adjacent property owners. From this effort, it was determined an unnamed spring surfaces cast of the

subject property along the north side of 711 Cedar Street. The property owner at 711 Cedar Street has
created a pond (without a recirculating pump system) to control the flow of the,spring before it leaves his
property to the west and enters the subject property at 701 Cedar Street. Once on the subject property, the
small stream flows toward the west approximately 40 ft through a defined channel. At the west side of
the property boundary, the stream enters a below-gro und culvert and finally into a series of catch basins.
Both ornamental and invasive plant species are present near the streambank, including common
horsetail (Equisetum arvense), rhododendron (Rhododendron sp.), evergreen blackberry (Rubus
laciniatus), bracken fem (Pterid um aquilinum), swordfern (Polystichum munitum), 'morning glory
(Convolvulus arvensis). Several other grass and tree species were observed in the northeastern portion of
the subject property, where the.strearn enters the site. Mowed grass is present on the remaining
streambank on the property. Within the stream channel itself, vegetation is limited to common horsetail,'
common velvetgrass (Holcus lanatus), watercress (Rorippa nasturtium-aquaticum), and birdsfoot trefoil
(Lotus corniculatus).
EDMONDS COMMUNITv DEVELOPMENT CODE
Section 23.90.0 10 of the ECDC, adopted February 2005, defines four types of streams in Edmonds,
as follows:
"Streams shall be classified in accordance with the Washington Department Of
Alatural Resources water typing system (WAC 222-16-030) hereby adopted in its entireti,
by reference and summarized as follows. -
a. Type S: streams inventoried as 'shorelines of the state' under Chapter 90.58
RCWand the rules promulgated pursuant to Chapter 90-58 RCW,-
b. Type F.- streams which containfish habitat,-
c. Type Np: perennial nonfish habitat streams,- and
d Type Ns: seasonal nonfish habitat streams.
All streams included on the inventory that are known to exist within the City of
Edmonds do not meet criteria
for 'shorelines of the state' but contain fish habitat and,
thus, meet designation, criterid for Type F waters pursuant to WAC 222-16-030.
However, not all Edmonds streams support anadromous fish populations or have the
potential for anadromous fish occurrence because of obstructions, blockages or access
restrictions resultingfto�m existing conditions. Therefore, in order to provide special
consideration of and increased protection for anadromous fish in the application of
development standards, Edinonds streams shall befurther classified asfollows:
A nadromous fishbearing streams: streams existing in whole or in part within the'
City of Edmonds in which anadromous fish are known to occur. As of 2004, Edmonds
fishbeari,ng streams are known to include Villow Creek, Shellabarger Creek, Shell
Creek-, Hindley Creek, Perrinville Creek, and Lunds Creek and
Nonanadromousfishbearing streams. streams existing in whole or in part within
the City of Edmonds which do not suppoi-tfish populations and do not have the potential
forfish occurrence because of barriers tofish passage or lack ofsuitable habitat.

Streams with anadromousfish occurrence were identified in the Edmonds Stream
Inventory and Assessment, a 2002 report of Pentec Environmental which is incorporated
by this reference as ifterein setforth. "
Section 23.90.040 of the ECDC describes standard stream buffer widths as
follows:
"The following shall be the standard buffer widths for streams based upon the
Washington State Department of Natural Resources water typing system and further
classification based upon fish presence (fishbearing vs. nonfishbearing) for the Type F
streams existing in the City of Edmonds:
a. Type S.- 150feet;
b. Type F anadromous fishbearing stream adjacent to reaches with anadromous
fish access: 100feet;
c. Type F anadromous fishbearing. stream adjacent to reaches without
anadromousfish access.- 75feet;
d. Type F nonanadromousfishbearing stream: 75feetl-
e. Type Ap: 50feet;
f Type Ns.- 25feet. "
Based on the information collected during our background review and site reconnaissance, we
have concluded that the unnamed spring and stream would be classified Type Np — perennial nonfish
habitat stream. Although the surface water produces a defined channel, which demonstrates evidence of
water passage, the portion of the strearn that originates from the spring at 711 Cedar Street and flows west
through the subject property, where it enters a series of catch basins, does not contain any resident trout or
anadromous salmon because of the presence of impassable- fish barriers. Based on this stream rating, a
50-ft buffer from the ordinary high water mark of this stream would be required on the subject property.
STREAM MITIGATION
The ECDC allows for a reduction of the buffer of up to 50 percent, provided that a stream buffer
enhancement conclusively demonstrates that enhancement of the stream buffer will not degrade the value
of the buffer area in terms of fish, stream, and wildlife protection. Stream buffer enhancement plansraust
meet the specific requirements of ECDC 23.40.110, 23.40.120, 23.40.130, and 23.90.040 D 2a-d. The
ECDC also allows for stream buffer averaging, pursuant to ECDC 23.90.040 D I
A list of native shrub species is provided in Table I so that future homeowners can plant the
buffer with appropriate species. According to the ECDC, shrubs should be planted at a density of no less
than 3 ft on center, trees should be planted at no less than 8ft on center. Planting additional shrub and tree
species will increase the habitat functions of the buffer. All of the listed species below occur frequently
in wetland buffers throughout the area. These species have been chosen not only for their ability to

tolerate the site conditions, but also for their ability to provide wildlife forage, habitat, and aesthetic
appeal.

The proposed trees and shrubs would provide greater species variety over existing conditions in
this area, replacing the grass ground cover. Shrubs and trees should be planted in the early spring or late
fall and the new plantings are -to be watered regularly during the first three growing seasons after
installation. To help establish the planted trees through the summer months (June -September), a
temporary irrigation system will need to be installed. The irrigation system needs only to be a drip line,
above -ground system. Periodic visual inspection of the trees following planting will help determine if the
flow of the drip system is providing enough water. Wilted or burned -looking leaves and needles are an
obvious sign that the flow needs to be increased
The planted buffer area will need to be maintained for a minimum of three years. Any plant
specimen that fails to thrive in the buffer area and dies must be replaced with the same species or an
approved species of tree or shrub-.
As long as the specified plants are used, shrubs are planted in the early spring or late fall, any
blackberry or other invasive plant species is cut back at least twice a year for a minimum of three years,
and the new plantings are watered regularly during the first three growing seasons after installation, shrub
and tree plantings within the buffer are expected to be successful.
GEOLOGWALLY HAZARDOus, AREAS
Geologically hazardous areas include areas susceptible to erosion, landslides, earthquakes, or
other geological events. The house on the subject property is situated approximately 10 ft below the
grade of Cedar Street. The slope from Cedar Street at the south end of the property creates a steep slope

along the northern, eastern, and southern portion of the site. These slopes have been established by a
system of retaining walls, leaving minimal soils exposed. The small area of available soil has become
established with a combination of ornamental and invasive species, such as English ivy (Hedera helix),
evergreen blackberry, bracken fern, swordfern, rhododendron species, azalea (Rhododendron sp), and
rose (Rosa sp.).
During the planning and construction process, alteration of the retaining wall and vegetation
should be avoided. If vegetation is grubbed and removed, it should be replanted to avoid erosion. Also,
if the retaining wall is to be altered, a detailed special study report would be required, per ECDC
23.80.050. According to the ECDC 23.80.050 G, report requirements for stable erosion hazard areas and
additional procedures to limit ero sion and excess sedimentation are as follows:
"At the director's discretion, detailed critical areas report requirements may be waived
for erosion hazard areas with suitable slope stability. Report requirements for stable
erosion hazard areas may be met through construction documents that shall include at a
minimum an erosion and sediment control plan prepared in compliance with
requirements setforth in, Chapter 18.30 ECDC -
USE OF Tms REPORT
This report was prepared for the exclusive use of AKA Design for specific application to this
project. The use by others, or for purposes other than intended, is at the user's sole risk. The findings
presented herein are, based on our understanding of the 701 Cedar Street site, the City of Edmonds critical
areas regulations, and site condit : ions observed during the September 23, 2005, site reconnaissance. This
study included investigation of the potential critical areas, as requested in the City Municipal Code,
passed May 17, 2005. Within the limitations of scope, schedule, and budget, the findings presented in
this report were prepared in accordance with generally accepted sensitive area investigat ion principles and
practices in this locality at the time this letter report was prepared. We make no other warranty, either
express or implied.
Stream ratings and buffer widths recommended by Landau Associates are considered preliminary
until verified by City personnel.
