Chlorine containing compounds such as PVC and CPE will generate hydrochloric acid if extensive thermal degradation is allowed. Olefin based and styrene based compounds are more.stable. All of the ingredients of which they are composed were powders, liquids, or particulate plastics (resins). Once melt processed, all of the ingredients are combined and encapsulated into a solid mass, and delivered as various sized pellets. The powders will never again appear in their original form. The liquid plasticizers and stabilizers are absorbed into the resins prior to fusion and fluxing. All of the ingredients are blended uniformly and are no longer discrete in the forms, that they were in; when listed in the "Right to Know" Hazard Communication. For dusty materials (fine particle compounds) a dust n-xask is recommended. Any pellet material handler should wear safety glasses. In order to prevent any potential skin sensitization it is good hygienic practice for material handlers to Wear work gloves. Section VII Precautions for Safe Handling and Use In case of spills, all materials can be disposed of in sanitary landfills in accordance with local regulations. Section VIII Control Measures General ventilation above the plastic processing hot melt areas is good practice. Respiratory protection is not needed. Preston PDP: lmb F 7 I FINDINGS AND DECISION OF THE PLANNING STAFF OF THE CITY OF EDMONDS IN THE MATTER OF THE APPLICATION OF DAN HARDAN FOR A HOME OCCUPATION PERMIT FILE: CU-23-87 DECISION: The application is APPROVED, subject to the conditions listed below. INTRODUCTION Dan Hardan, of 6502 208th SW #A-6, Lynnwood, 98036, and hereafter referred to as the Applicant, has requested approval for a home occupation permit to allow an office and storage for an automobile striping and molding business at 7025 Lake Ballinger Way. The residence is currently under construction; the business is proposed when the residence is occupied by the Applicant. The application was filed with the City of Edmonds on March 23, 1987. On April 21, 1987, a public hearing was held on the matter before the Code Enforcement Technician of the City of Edmonds. A notice and decision had been mailed to adjacent property owners as required by the Edmonds Community Development Code (ECDC), and the notice was posted in the manner prescribed by the Code. W. #A-6 Lynnwood, WA 98036 Exhibit 1, the application, is attached to this document. After consideration of evidence and testimony presented by the applicant, and as a result of an inspection of the subject property and surrounding areas by the Code Enforcement Technician, the following constitute the basis for the decision to approve the Conditional Use permit for the home occupation. FACTS The applicant has requested a Conditional Use permit for a home occupation to allow him to operate an office and use his garage for storage for an automobile striping and molding business from his residence at 7025 Lake Ballinger Way, Edmonds, WA. The subject property is located in an RSW-12 single family residential zone I'm May 1, 1987 Page 2 district. Home occupations are allowed in this zone district with the approval of a Conditional Use permit, per Chapter 16.020.010 of the ECDC. Home occupations must meet the criteria outlined in Chapter 20.20 of the ECDC, in order to be approved. Those criteria are: A. The area used for the home occupation shall be carried on entirely within a completely enclosed building. B. No one other than a member of the immediate family residing on the premises may be employed on the premises. C. Mechanical equipment can be used, if it is compatible with a residential environment. D. The home occupation shall not generate any more traffic than is normal for a single family residence in the neighborhood. E. No goods shall be sold or rented on the premises except instructional materials pertinent to the home occupation (e.g., music books). The display or storage of goods outside the premises or in a window is prohibited. Customers may not visit the site to view the merchandise. No unreasonable amount of dust, odor, smoke or noise shall be permitted. F. A sign is permitted if it does not exceed three square feet in size. it shall only contain the name and address of the residents. G. A home occupation permit is a special exception to the Zoning Ordinance and the applicant has the burden of persuasion that he/she comes within the stated purposes and criteria of this chapter. The following are among common reasons for denial, but are not inclusive. 1. The on -street or on -site parking of trucks or other types of equipment associated with the home occupation; 2. The littered, unkempt and otherwise poorly maintained condition of the dwelling site; 3. Noncompliance with the above criteria or the purposes of the Home Occupation chapter or the zoning ordinance; 4. The proposal cannot be conditioned to meet the criteria and findings of the home occupation chapter. The Applicant brought samples to the public hearing of the molding and trim materials to be stored in his garage. During the hearing, the Rutledges noted that they are not concerned about the use of the residence for an office. They are concerned with storage of material in the garage with respect to its flammability, visibility of the activity from their residence, and traffic activity in the area in association with the home occupation. They requested Staff to discuss the storage of material in the Applicant's garage with the Fire Marshal . In response to questions from staff, the applicant responded to the criteria for home occupations as follows: V-7, May 1, 1987 Page 3 A. No activity would be carried on outside the building. B. The Applicant has one employee, who would come to the residence each morning to load material from the Applicant's garage into the employee's vehicle. C. No mechanical equipment, other than the applicant's personal vehicle, would be used for the home occupation. C. Stock for the home occupation would be stored in the Applicant's garage. As stock is depleted for the business, the Applicant would order replacements, which would be delivered by United Parcel Service. The Applicant estimated that during some weeks, no deliveries would be made; while during other weeks, two or three deliveries would be made. D. Nothing would be sold or rented directly from the premises. No display of goods would occur. As the business is conducted primarily through automobile dealers, off the site, no customers would come to the residence. E. No sign would be installed at the residence. ANALYSIS In the matter of the neighbors' concern about flammability of the material stored in the garage in association with this home occupation, Staff checked with the Fire Marshal. At the Fire Marshal's request, the Applicant submitted samples of materials he uses, a copy of the fire code rating of the material as provided by the manufacturer, and an estimate of the volume of material he would be storing. The Fire Marshal reviewed this material, and concluded that the volume and type of inventory in the Applicant's garage would be acceptable for the home occupation. It should be noted that an inspection of the residence by the Fire Marshal will be required prior to occupancy. A fire extinguisher will be required in the garage. In addition, a one -hour fire wall separation has been built into the wall between the house and garage. Two aspects of the home occupation as noted on the application and from the applicant's testimony are of concern. They are the daily employee visits and frequency of deliveries. One of the criteria for home occupations, as noted above, states that (B) no one other than a member of the immediate family residing on the premises may be employed on thE premises. While employing others is not prohibited for home occupations, the criteria prohibit them from working at the premises. This includes the loading of goods on a daily basis, as the Applicant proposes. Another criteria as noted above (D) is that no more traffic be generated than is normal for a single family residence in the neighborhood. Deliveries several times per month in association with the home occupation are not unreasonable; more than two deliveries per week are more than is normal in a residential neighborhood. As noted above in Section (F) of the criteria, the home occupation can be denied if the proposal cannot be conditioned to meet the criteria and findings of home occupations. They are: 1. No employees shall come to the residence in the course of business. 2. Deliveries shall be limited to no more than a maximum of six per month. Further, these deliveries shall be limited to a frequency no greater than 2 per week. With these conditions, the home occupation can satisfy Criteria (B) and (D) as noted above. In order to allow the neighbors an opportunity to review this home occupation, the following additional condition has been added: 3. This application shall be reviewed in six months, if requested by 3 of the neighbors. With respect to the neighbors' concern about visibility, there is no provision in the home occupation criteria which addresses this issue. No material or goods will be stored outside the garage, and no actual striping and molding activity will occur on the premises. Although the neighbors may observe the applicant's vehicle and delivery trucks entering and leaving the property, nothing in the Code prevents this activity. CONCLUSIONS The application in question is a request for a home occupation permit to allow an office and storage for a striping and molding business out of the home located at 7025 Lake Ballinger Way. Home Occupations are allowed, per Chapter 16.20.010 (B) of the ECDC. The applicable criteria are outlined above. The proposed home occupation will be carried on inside a completely enclosed building. No materials or equipment will be stored outside the residence. There will be no signs. The type of equipment used by the Applicant can be found in a single family residence. The type and amount of material to be stored on the premises has been reviewed and approved by the Edmonds Fire Marshal. Two conditions of approval, that no employees come to the home and that deliveries be limited to six per month, at intervals of no more than two per week, have been added in order to bring the home occupation into conformance with the criteria of Chapter 20.20 of the ECDC. DECISION The basic intent of a home occupation is to allow small scale businesses to operate out of a single family residence in a manner that will not impact the neighborhood. Nothing in the ECDC prevents the Applicant from storing inventory in his garage and using a portion of his residence as an office. With the two conditions of approval, that May 1, 1987 Page 5 is, no employees at the residence and limited delivery of goods, there is no obvious detrimental impact identified with the requested home occupation. Based upon the preceding Facts and Analysis; the testimony and evidence submitted at the public hearing; and, upon the impressions of the Code Enforcement Technician at a site view, it is hereby ordered that the requested home occupation permit is APPROVED, subject to the following conditions: 1. No employees shall come to the residence in the course of business. 2. Deliveries shall be limited to no more than a maximum of six per month. Further, these deliveries shall be limited to a frequency no greater than two per week. 3. This application shall be reviewed in six months, if requested by 3 of the neighbors. 4. The Home Occupation shall meet all other criteria for approval, as noted in Chapter 20.20 of the Edmonds Community Development Code.
