The property has frontage along Lake Ballinger which has been identified as a Class I Wetland
by the City of Edmonds Critical Areas ordinace.
Based on the above findings a Critical Areas Study is required to delineate the boundaries of the
critical area and its buffers and setbacks. A wetland biologist must identify and mark the
boundaries of the. wetland, and a licensed surveyor must create a topographic map of the site
Which indicates the location of the critical area as identified by the biologist, and identifies the all
buffers and setbacks. All studies must be completed through a three party contract according to
the requirements found in ECDC section 20.15B.
If the property owner wishes to apply for a specific development permit which they feel would
not impact the Critical Areas located on or adjacent to the site, they may submit their proposal to
the Planning Department for review. If the Planning Department finds that the proposed
development permit will not adversely impact a Critical Area or its buffers, a conditional waiver
may be issued on a project by project basis. _

Determination: Study Required
During review and inspection of the subject site, it was. found that the site appears to contain
and/or is adjacent to a Wetland pursuant to Chapter 20.15B of the Edmonds Community
Development Code (ECDC). The wetland requires a buffer from the edge of the wetland and a
building setback from the edge of the buffer.
ECDC 20.15B.050(D) and 20.15B. I 50(A) state that if a Critical Area is found on the site or
adjacent to the site, a study is required. The study must be conducted by a wetlands biologist and
a land surveyor, licensed by the State of Washington. The wetlands biologist is to perform the
following:
1. Classification of the wetland pursuant to the criteria established in ECDC Section
20.15B.060(A)(5).
2. Delineate the edge of the wetland on the site.
3. State any mitigating measures appropriate to preserving the wetland.
After the wetland biologist has delineated the wetland boundary, a surveyor licensed by the State
of Washington must create a map showing the wetland, the buffer and the building setback.
The Wetlands Biologist shall enter into a three party contract with the applicant and the City of
Edmonds as required in ECDC 20.15B. 140(D), where the applicant pays for the study. The

by the City of Edmonds Critical Areas ordinace.
Based on the above findings a Critical Areas Study is required to delineate the boundaries of the
critical area and its buffers and'setbacks. A wetland biologist must identify �nd mark the
boundaries of the wetland, and a licensed surveyor must create a topographic map of the site
which indicates the location of the critical area as identified"by tihe biologist, and identifies the all
buffers and setbacks. All studies must be completed through a three party contract according to
the requirements found in ECDC section 20.15B.
If the property owner wishes to apply for a specific development permit which they feel would

The property has frontage along Lake Ballinger which has been identified as a Class I Wetland
by the City of Edmonds Critical Areas ordinace.
Based on the above findings a Critical Areas Study is required to delineate the boundaries of the
critical area and its buffers and setbacks. A wetland biologist must identify �nd mark the
boundaries of the wetland, and a licensed surveyor must create a topographic map of the site
which indicates the location of the critical area as identified by the biologist, and identifies the all
buffers and setbacks. All studies must be completed through a three party contract according to
the requirements found in ECDC section 20.15B.
If the property owner wishes to apply for a specific development permit which they feel would
not impact the Critical Areas located on or adjacent to the site, they may submit their proposal to
the Planning Department for review. If the Planning Department finds that the proposed
development permit will not adversely impact a Critical Area or its buffers, aconditional waiver -
may be issued on a pr'diect by vroiect basis.

Re: Street Use Renewal Fee Permit #96-2
As required by City Ordinance #2972, Street Use permit renewal fees are now
collected every three years instead of yearly. The first effective billing date was 1/1/96
however, due to staff shortages, the City was unable to send out this billing for the
period 1/96 to 1/99. Please remit renewal fees in the amount of $25.00 to the City of
Edmonds, c/o Building Division, Permit Specialist, 250 5th Avenue North, Edmonds,
Washington 98020 within 15 days date of this letter.
If this permit is no longer applicable i.e., you no longer utilize that portion of the City

of the subject fence still exists. Regardless of the height of the fence if any portion of it
is located in the undeveloped City Right of way a Street Use Permit is still required.

the existing location of thefence and return with renewal fee of $25.00.
Of course you have the option to completely remove the fence and therefor the Street

We received your letter dated October 6, 1995 regarding the above subject, and although we can
empathize with yourposition, we cannot allow your fence to remain in the City right-of-way. Based
on the property pin near your gate and the state right-of-way alignment map of that area, your fence
extends approximately 20 feet into the right-of-way. As a result, the fence must be moved back to your
property line, which includes the fence along SR 104 and along the east side of your property,
regardless when the fence was constructed. The location of the fence is definitely a safety hazard, not
only to you and your neighbors, but also to the motorists that travel the state highway.
A letter has been sent to your easterly neighbor informing him4hat his fence also has to be relocated.
In addition, the post office is anticipating relocating some mailboxes between 7001 and 7701 Lake
Ballinger Way, farther behind the sidewalk than currently located. This is for safety purposes and
because access to the right-of-way must be maintained.
Please take the appropriate action and remove all fencing that extends into the City right-of-way by
October 18, 1995. If the fence is not removed by that date, we will have the city crews remove it and
the City will bill you for the work.

Dear Mr. Walker,
I am writing you this letter with regards to your letter dated 9/27/95. As your letter stated, I
have had a fence constructed ay my residence. I must apologize for the problems that it has
created with my neighbors. As I stated in our meeting last week I had made a phone call to the
city asking if the fence does need a permit and if I was allowed to construct such a fence. I
received no notification from the person that I spoke with that I was in violation in any way. The
following weekend I had the fence constructed with a gate across my parking area between me
and a neighbor., The neighbor had put up a very ugly chain and post to block off their side of the
parking area. I then did the next best thing, I built a beautiful cedar fence. Not knowing that I
was in any violation, I painted the fence the next day. I know know that the fence is not allowed
so I will remove the portion that is in violation. There is, however a section of the gate that
crosses my driveway that divides the 2 properties. The gate is exactly 18' 5" away from the
curb. I do ask at this time if I may keep the gate to enhance the front of my house and block out
the neighbors unsightly chain and post. Although, I know that the setback is 20" from the curb.
It would be very costly to relocate the one post and cut back the fence.
Also, I have a fence that is located on the opposite side of my property that was constructed when
the house was built. It was built along with my neighbors fence which is in the Mount Lake
Terrace City limits. Please re consider your request to remove that existing fence sections as to
the length of time that it has been in place. It does not block out any part of the street other that
the telephone pole and wires. It would be very unattractive to look at without my fence there.
The other side I can live without.
I look forward to hearing from you soon. I will wait to remove the new section of fence until I
hear from you.

Dear Mr. Hardan,
It has been brought to our attention that you recently constructed a wooden fence between properties and
along Lake Ballinger Way (244th St. S.W.). Upon visiting the site and researching the short plat
requirements, we noted concerns, which are listed below:
I . Short plat requirements (S-13-78) included a prohibition of shrubs or other obstructions placed or
reaching a height greater than one foot above the curb elevation across the frontage of 244th St. S.W.
within twenty (20) feet of the face of the street curb.
2. No permit was issued for the fence.
3. Fence appears to be constructed in the City right-of-way (R.O.W.) Such structures are not allowed in
City R.O.W. or state highway R.O.W.
4. Location and height of fence creates a sight distance hazard.
It is imperative that you take immediate action and remove the fence within twenty feet of the face of the
street curb. Please take the necessary steps to remove the fence by October 6, 1995. If the fence is not
removed by that date, we will direct the City crew to remove the portion in the R.O.W. and the City will
bill you for the work. In addition, there is no guarantee the fence material will be reusable. If the fence
remains on private property within twenty feet of the street curb after October 6, 1995, the City will begin
enforcement action to require removal of the fence.
