They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area, the critical areas report will also contain a mitigation plan. You have the option of completing the portion of the study that classifies and delineates the critical areas and waiting until you have a specific development proposal to complete the study. You may also choose to submit the entire study with your specific development application. Please review the minimum report requirements for all types of Critical Areas that are listed in ECDC 23.40.090.D. Note that it is important for the report to be prepared by a qualified professional as defined in the ordinance. STUDY REQUIREMENT - LANDSLIDE HAZARD AREA It appears that this property contains or is adjacent to a Landslide Hazard Area. A Landslide Hazard Area is any area with a slope of forty percent (40%) or steeper and with a vertical relief of ten (10) or more feet (except areas composed of consolidated bedrock). * Landslide Hazard Areas are further defined and illustrated in ECDC 23.80.020.B. In addition to the general requirements for Critical Areas reports referenced above, specific Critical Area report requirements for Landslide Hazard Areas are provided in ECDC 23.80.050. DEVELOPMENT PROPOSALS ASSOCIATED WITH LANDSLIDE HAZARD AREAS Development is restricted within a Landslide Hazard Area and its buffer. • Projects that will intrude into these areas will require a report by a licensed Geotechnical Engineer. • The criteria that are applied depend on the amount that the buffer is reduced. • The buffer can be reduced to a minimum of ten (10) feet (with an additional 15' building setback per ECDC 23.40.280) if a report is prepared that meets the standards listed in ECDC 23.80.050. The alteration must also meet the requirements listed in ECDC 23.80.060. • In addition, proposals to reduce the buffer to less than ten (10) feet must comply with the design standards listed in ECDC 23.80.070.A.3. STUDY REQUIREMENT — EROSION HAZARD AREA It appears that this property contains or is adjacent to an Erosion Hazard Area. Erosion Hazard Areas include: • Those areas with Alderwood and Everett series soils on slopes of 15 percent or greater. • Any area with slopes of 15 percent or greater and impermeable soils interbedded with granular soils and springs or ground water seepage. Areas with significant visible evidence of ground water seepage, and which also include existing landslide deposits regardless of slope. DEVELOPMENT PROPOSALS ASSOCIATED WITH EROSION HAZARD AREAS Development within an Erosion Hazard Area must meet additional criteria. For erosion hazard areas with suitable slope stability, the only critical area study needed is an erosion and sediment control plan prepared in compliance with the requirements set forth in Chapter 18.30 ECDC as part of the construction documents. This option is at the director's discretion, per Edmonds Community Development Code section 20.80.050.G. N/A I have had the opportunity to visit the site, review the environmental checklist, and the grading plan, a copy of which are filed in the official file for this permit. Based on my review of all available information and adopted policies of the City, I recommend that a Inifleated determination of nonsienificance. be issued. SITE DESCRII'TION The site is a flag lot of approximately 20,000 square feet of area and is developed with a single family residence. The site is generally forested with the exception of the building site and the driveway. The terrain slopes down to the north and to the east with the house located near the highest point on the lot. The applicant has filled an area on the west side of the property about 10 to 15 feet wide, and 100 feet long. This area of fill is apparently an access to the lower portions of the lot. When the area was filled the root systems of several trees were buried. SEPA ANALYSIS Short Term ImDacts The City of Edmonds Building Official has determined that the fill material is not in danger of immediate failure. In addition the work is completed, therefore there will be no truck traffic impact or noise created in the immediate future. Long Term Impacts The City Building Official has determined that the danger of slope failure is small. In addition the Building Official has determined that the fill is not located in the proximity of any structure, so that if the slope did fail, it would not effect any structures. In addition the area Page 3 of 5 of fill is small enough that a slope failure would not likely effect the vegetation or wildlife in the area. The fill material placed on the site has buried the root systems of several trees. It is the Cities opinion that if the root system of trees is buried deeper than one or two inches, that the stress on the tree is so great that the tree will not survive. Since the area is generally forested, the loss of several trees will great both an aesthetic impact and a wildlife impact to the property, and the surrounding area. Traffic The proposal will not create any traffic impacts. Parking The proposal will not create any parking impacts. Conclusion The proposal will result in the loss of trees, therefore will result in an environmental impact, however, with the mitigating conditions listed below, no significant impacts to the environment. Based on my review of all information and adopted policies of the City, I am recommending that the proposal be changed or clarified to include the following mitigating measures so that an MDNS can be issued. All mitigation's refer to the site plan, dated 2/25/92. Recommended Mitigation Measures: I . Remove the fiffled soil from around the trees to preserve the root systems of the trees. This recommendation is based on adopted policies of the City as found in the Edmonds Community Development Code, Title 15. ECDC 15.15.020(B)(1) states that the removal of trees should be minimized when they are located on steep slopes or hazardous soils ECDC 15.15.020(B)(3)Grading should be restricted to building pads and roads. Vegetation outside these areas should be preserved. These policies directly support the above mentioned, mitigation measures and require these measures in order to fully mitigate the impacts created by the proposal.
