Dear Ms. Coustene-Hardy,
I have reviewed the above building permit application on behalf of Planning Division and while I
have approved the permit, I wanted to bring one concern to your attention regarding the proposed
remodel. In reviewing the plans, I noticed that a wet bar is to be installed in the updated
basement area. Wet bars are certainly allowed as part of entertainment areas, rec rooms and the
like, but their inclusion in a remodel can indicate the possible intent to use a space as a 'mother-
in-law' type unit. This building permit does not allow the use of the downstairs space as an
Accessory Dwelling Unit (ADU). If you plan to use the downstairs at some point as an ADU, a
separate ADU permit is required according to Edmonds Community Development Code Chapter
20.21.

I have reviewed the site located at 704 Fir street. There is a mapped class 2b stream crossing the southern
portion of the property just off the site. The required 25 foot buffer and the required 15 foot setback appeared to
encroach into the building area of the subject property. Therefore the applicant was required to provide the City
with a survey delineating the stream bank and showing that the house would meet the required stream setback.
Ile survey creating the subdivision was made on 5/16/91. At the time of this survey the City required that the
surveyor delineate the location of the top of the stream bank. The applicant provided the City with a copy of this
survey and a copy of a site plan showing how he would meet the setback requirements. Therefore the required
study has been completed.
I recommend that the following condition be required with the approval of a building permit for the subject site:
1. The applicant provide the City with a Landscaped Green Belt Easement for the portion of the property within
25 feet of the stream bank. This easement must state that no construction or alteration of the 25 foot stream
buffer is allowed. This easement must be recorded with the Snohomish County Recorder's office prior to the
issuance of a building permit.
2. The applicant must provide the City with an easement stating that no structures are allowed to be built within
15 feet of the 25 foot stream buffer. This easement must be recorded with the Snohomish County Recorder's
office prior to the issuance of a building permit
3. The applicant must provide the City with a Landscape Plan and with a statement that the area within 25 feet
of the stream will be landscaped with native vegetation prior to the final occupancy approval of the building
permit. The landscaping plan must also state that the building setback will be landscaped with erosion
resistant plants prior to final occupancy approval of the building permit.
4. The applicant shall retain the filter fabric fence along the west property line until the completion of all
construction and landscaping.
5. The applicant shall provide the City with a two year maintenance bond for the maintenance of the landscaping
within the stream buffer area. This bond shall be provided prior to the final occupancy approval of the
building permit.
6. If the applicant is granted a variance on the subject lot, the preceding conditions should be modified to meet
the requirements of the variance.

I understand from the Council comments during the June 23rd meeting that there may still be some
questions about the status of Mr. Arnim's project and the effect of the city's critical areas
ordinance. I hope the following will summarize the situation as it stands today. I would be happy to
answer any fiirther questions either individually or in a more formal presentation to the Council.
Mr. Mike Arnim appeared before the Council atits May 18th meeting and presented a situation in
which he felt he had been "caught" by the new critical areas ordinance. Mr. Arnim had undergone
SEPA review as part of the process of obtaining approval for his short plat, and had even reserved
the buffer that the critical areas ordinance now required. However, because of the critical areas
ordinance requirement of an additional building setback, he needed to obtain a variance from this
critical areas standard before being able to obtain a building permit. Mr. Arnim applied for the
variance, but brought the issue to the Council to see if another remedy could be found.
In response to Mr. Arnim's concern, staff brought back a set of recommendations for the Council
to consider at its June 9th meeting (this was a committee meeting night� but the issue was discussed
by the full Council before adjourning to committees). 'Me Council supported the staffs proposal to
exempt plats that had undergone SEPA review and were approved in the year prior to adoption of
the Critical Areas Ordinance. This revision of the vesting provisions was drafted as a code
amendment and was approved by the Council at its June 16th meeting (Ordinance 2885). The
effective date of the ordinance was June 26th.
As a result of the adoption of the new vesting provisions, Mr. Arnim's entire plat on Fir Street is
now exempt from the Critical Areas Ordinance; he does not need to undergo critical areas review
or obtain any critical areas variances to proceed with his development (he still needs to obtain the
usual building permits, however). Mr. Arnim withdrew his variance request, and his application fee
was refunded. We began finalizing his building permits, although we could not legally approve the
permits until the effective date of the ordinance which exempted him from the critical areas review.
On June 27th, Mr. Arnim picked up his approved building permit for his lot at 708 Fir Street, the
lot which had originally needed the variance but was now vested and exempt from the critical areas
ordinance.

I believe all concerned, including the Council, stA and Mr. Arnim, felt that the revised vesting
provisions were a reasonable solution to the problem that Mr. Arnim's case highlighted. On balance
I think the City responded very rapidly to the problem and implemented an appropriate solution
within a very short period of time.
During the discussion at the Council's June 9th meeting, staff also alerted the Council that there
were other provisions in the Critical Areas Ordinance that we felt needed to be examined. The
Council concurred that these and any other critical areas concerns should be referred to the
Planning Board for review. Ilese items are being placed on the Board's extended agenda, and will
be reviewed after we get through our pending public meetings on the Comprehensive Plan (the
public open houses) and other scheduled business.
In surn, Council and staff agreed during the adoption process for the critical areas ordinance'that a
trial period was needed to gain experience with this type of regulation. In fact, a sunset proivision
was adopted so that there would be certainty that the ordinance would be reviewed (the sunset date
is July 1, 1994). The reason that Mr. Arnims case received immediate attention was that it pointed
out a problem that needed immediate attention, and was clearly consistent with the intent of the
ordinance. We would be happy to consider any similar problems that need immediate attention; in
any case, we will soon begin the process of working with the Planning Board to identify provisions
of the critical areas ordinance that need adjusting but are less urgent in nature.

As promised I am following up on your letter of July 9, 2002 regarding the proposed pedestrian bridge adjacent your
property and street vacation. Funds for the construction of the pedestrian bridge are currently available within the
Parks Department budget. The bridge has been designed by City engineering staff. I am arranging a meeting with
the State Department of Fish and Wildlife to determine hydraulic perrrdt requirements

Technically the: street vacation does not have to be completed first before the construction of the traillbridge. There
is sufficient room to construct the bridge and trail given the existing pedestrian easement and right-of-way. For
consistency purposes, I now believe the city should retain a 10 foot pedestrian easement but the trail may be less
than that width.
The steps in the street vacation process are summarized as follows:
• The City Council passes a motion initiating the street vacation.
• The City Clerk will schedule a public hearing.
• After the public hearing, the City Council would, assum . ing they concur with vacating the right-of-way,
adopt a resolution to vacate by ordinance provided that within 90 days payment for the vacated property
is made to the city.
Attached for your information is a copy of Chapter 20.70 of the Edmonds Community Development Code (ECDC)
which contains the exact code language. If the street vacation is approved you will not be required to re-record your
short plat map. All required easements will included in the recorded street vacation ordinance. Your property taxes
should not be impacted. The City will record the ordinance.
Because your proposed fence is located within a critical area buffer, you will needa critical areas alteration permit
along with a fence permit. Star Campbell has been assigned from the Planning Division to be your contact on the
critical areas perrrdt. Once the critical areas permit this is completed, you can apply for your fence permit consistent

As promised I am following up on your letter of July 9, 2002 regarding the proposed pedestrian bridge adjacent your
property and street vacation. Funds for the construction of the pedestrian bridge are currently available within the
Parks Department budget. The bridge has-been designed by City engineering staff. I am arranging a meeting with

the State Department of Fish and Wildlife to determine hydraulic permit requirements
Technically t4 street vacation does not have to be completed first before the construction of the trailibridge. There
is sufficient room to construct the bridge and trail given the existing pedestrian easement and right-of-way. For
consistency puiposes, I now believe the city should retain a 10 foot pedestrian easement but the trail may be less
than that width.
The steps in the street vacation process are summarized as follows:
• The City Council passes a motion initiating the street vacation.
• The City Clerk will schedule a public hearing.
• Afterthe public hearing, the City Council would, assuming they concur -With vacating the right-of-way,
adopt a resolution to vacate by ordinance provided that within 90 days payment for the vacated property
is made to the city.
Attached for your information is a copy of Chapter 20.70 of the Edmonds Community Development Code (ECDC)
which contains the ex , act code language. If the street vacation is approved you will not be required to re-record your
short plat map. All required easements will included in the recorded street vacation ordinance. Your property taxes
should not be impacted. The City will record the ordinance.
Because your proposed fence is located within a critical area buffer, you will need a critical areas alteration permit
along with a fence permit. Star Campbell has been assigned from the Planning Division to be your contact on the
critical areas permit. Once the critical areas permit this is completed, you can apply for your fence permit consistent
with youqo�approved critical areas plan.

WHEREAS, in response to a petition of property owners, the City Council
ordered vacation of the northerly 120 feet of 7h Avenue South, south of Fir Street, and,
WHEREAS, only the western one-half of the right of way was ultimately vacated

because of the failure of the property owner adjacent to the east side of the right of way to pay
compensation as required by the City Council, and
WHEREAS, a request has been made by the planning staff to again consider
vacation of the eastern one-half of the previously approved but unconsummated street vacation,
now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Council hereby imitiates the review and consideration of a
request to vacate the easterly half of the northerly 120 feet of 7h Avenue South, south of Fir
Street in Edmonds, Washington. By the passage of this resolution, the City Council takes no
position regarding the vacation, but rather has initiated the petition pursuant to the requirements
of state statute and ECDC 20.70.050.
Section 2. Pursuant to the requirements 'of ECDC 20.70.070, the City Council
hereby sets a public hearing on the proposed street vacation. The hearing is set for 7:00 PM on
