This letter will confirm my oral offer to Mr. Hovey to purchase a
permanent subsurface utility easement and a temporary
construction easement. The permanent easement would lie along
your southerly property line and would be 6 feet x 57 feet. The
temporary.easement would lie immediately adjacent to it and would
be 10 feet x 57 feet. My offer, which will remain ope . n until
noon, Tuesday, February 27, 1990, is to pay the total sum of
$2,000. This amount was reached by taking the calculations
below, and facto ring in the sum of $600 which frankly represents
the additional costs which the City would necessarily incur if it
pursues the condemnation process.
The permanent subsurface utility easement is proposed to be 342
square feet. Since that area lies entirely within the side yard
setback area for your house, your use of the property is already
limited by City ordinance. While the easement would prevent the
erection of permanent structures over the easement, in affect
that limitation is already in place due to City. zoning
ordinances. Appraisers normally apply a rule of thumb that. a
subsurface utility easement should be worth one-half of the
square foot value of the property; in situations where its use is
limited as yours is, a figure of 30% is more typical. Therefore,
multiplying a square footage of the permanent easement times $8 a
square foot times .3 gives a total, of $820.80. In this c I ase, I
rounded our offer up.
The typical rule of thumb for appraising a temporary construction
easement is to determine the rental value of the property. A 10
x 57 square foot area (570 square feet) has an approximate value
of $4,560. The rental value is usually considered to be 10% of
value per year. Although the City would only require use of the
property for six months, I have applied the full 10% which gives
an approximate rental value for 570 feet at $.80 per square foot
of $456. Again, I have rounded up. The City"s basic offer

therefore considers a value of $1,000 for the perman . ent
construction easement and $500 f or the temporary easement. As
noted, the acquisition of an appraisal suitable . for presentation
in a condemnation proceeding would cost us about $500. There-
fore, I have made a limited offer of $2,000, which must be
a ccepted by noon, Tuesday, by execution of a tempoirary and
permanent construction easement. Unless accepted, this of f er
will be automatically , withdrawn. Our offer will . then be one
Thousand Two Hundred Seventy Six Dollars and Eighty Cents
($1,276.80).
I should note that the of f er also contains the promises made to
you by Mr. Atherton to restore the stream bank, completely
restore the surf ace area of the easement and the other promises
made to you by him in past communications.
.If you have any questions regarding this offer, please contact me
at your earliest convenience. I believe that the City's offer is
a very fair one. As I have noted, if we are required to pursue
condemnation, our offer will be lower at -the actual appraised
value, taking into consideration the additional costs which the
city will incur.

I tried unsuccessfully several times ' to reach you by telephone to
discuss the proposed storm drainage easement you and Mr. Lee Atherton
have been negotiating. Mr. Atherton has indicated you have been
given an easement form with the proposed description but, for whatever
reason, you are uncomfortable in granting the easement. I would like
to discuss with you what your reservations are.
The City has identified a need to replace and upgrade the system which
exists under 6th Avenue South and across a portion of your property.
Under the City's existing budgetary constraints, the City would not
pursue replacing this system for several years. The proposed
development by Mr. Atherton put the City in a position to have the
developer install the system at no cost to the City or the taxpayers.
Another option is to let the development proceed at this time and the
City install the system at a later date. We would prefer to have the
developer install the system at this time. This would require granting
of the easement at this time.
I ask you to seriously consider granting the easement and give me a
telephone call at 771-3202 to discuss any problems or concern.

undersigned, Robert Y. Hovey and Beverly A. Hovey (husband and wife),
hereby grant to- the CITY OF EDMONDS, a Municipal Corporation, a
permanent easement for the installation, operation and maintenance of a
culvert over, across, through and below the following described
property; and the further right to remove trees, bushes, undergrowth
and other obstructions interfering with the location, construction and
maintenance of said utility, together with the right of access to the
easement at any time for the stated purposes.
