Lpt. .In response to your memorandum of inquiry of July 71 1976, concerning a claim for damages filed by Mr. Buckman this office had already been advised.*by the insurance carrier that they were taking the position that there was no coverage in this instance and accordingly proceeded to view the site and conduct a preliminary investigation as to the basis of the claim. This was accomplished during the week of June 28, 1976. There are two Douglas Fir trees underneath the PUD lines at the,-locati.on in question ' which are probably 25 feet in height. The western -most tree had limbs removed from its north side apparently by sawing to a height of approximately five feet. The eastern -most of.the two trees had the ends of limbs trimmed to about the same extent. My office was contacted by Mr. Buckman who at the time of the telephone conversation advised me that one tree had been killed and the other one was sure to die and that while he had claimed $2,000 he would accept some amount less than that. FILE .90 A I After viewing the scene and discussing the circumstances w ith Don Burton, it appears to me that permission was sought to trim these limbs and was given to the personnel involved by the resident in the particular house. It subsequently turned out that the resident is only a tenant.who*is now apparently disavowing either having given permission or a version in a similar vein. .Needless to say, neither tree is dying nor would it appear that either one is going to die. 0 Mr. Ron Whaley July 9,*.1976 Page Two I felt Mr. Buckman was overreaching and frankly,,in- my opinion, was asking for damages which probably are not warranted. Subsequent to my conversations with Mr. Buckman, I have had in the past week two conversations with an attorney rep- resenting Mr. Buckman who, during the second conversation, made a non-negotiable" "rock bottom" offer of $200.00 to settle stating that Mr. Buckman intended to remove the trees and plant two new ones. I advised the attorney that I felt Mr. Buckman had rather blatantly misrepresented his case to the City and quite possibly to his attorney also, that I felt he had not sustained any damages and further ' that I felt the tenant had given our public works personnel permission to go upon the premises for the pur- pose as stated of trimming the limbs and that the limbs did impair sight distance to the east for traffic attempting to enter Casper Street at that particular intersection, I. told him that I would advise the City notto pay any money under any circumstances. The conversation ended on the note that if Mr. Buckman wanted the trees taken down, I could recommend to the City that the trees be removed without any cost to Mr. Buckman. The attorney askedif he would hear from me concerning the $200.00 offer and I advised him that I saw no reason as to why he should expect to hear from me as my recommendation would be not to pay Mr. Buckman any money under the circumstances of this case. There is a box culvert under the roadway; adjacent to the box culvert were some trees and some shrubs that were causing a sight distance problem. About -a week later, we did receive a document - we received it on June 18th, It's a right of way study on Casper Streeto 3rd to 9th, Edmondso Washington is the title of the drawing,p but it indicates to us that the public right of way on the south -side of Casper Street in the area of where the Buthman property ISO the public:,: -right of way 16 15 feet wide. It is not the normal 30 feet* With the public right Of way being 60 foot$ normally, there Is 30 feet north and south of the center line. This is true In most every property from 3rd to 7th and on up to 9th with the exception of this one piece of property$ we did assume we had the public right of way and the trees were In the right of wayg but I didg in fact, go to tile people and got verbal permission from who I talked with, the owners at the timep just to make sure we were doing the right thing. Oksy* STREET FILE SUMMARY OF EVENTS REGARDING THE INTERSECTION OF 7TH AVENUE & CASPERS ST. Engineering Dept. received a citizen complaint from Mrs. Collins who resides at 730 Brookmere Dr. indicating that the trees located At the N.E. corner,of the intersection are a traffic hazard. Also, Mr. Lester Johnson, 342 Caspers St. called or came into the Engineering Dept. office on different occasions to register his concern over trees and brush near the intersection causing a sight problem. The traffic accident records indicate that 8 accidents occurred at the intersection since 1972. 6/9/76 City Engineer directed the staff to investigate the complaints and take action required. 6/10/76 Bill Nims, Assittant Engineer for Field and Office, checked the area of the intersection with Bobby Mills, Street Dept. Foreman. It was determined that vegetation did cause a sight obstruction at two locations. The first location was at the S.E. corner of the intersection, two trees. The other location was brush in the right-of-way at the Shell Creek box culvert location about 100' west of the intersection. At that time, Bill Nims went to the property at the S.E. corner of 7th Ave. and Caspers St. and asked for and received verbal permission for the City of Edmonds to trim the trees from the occupants. The City Street Dept. staff trimmed the trees. 6/11/76 Mr. Buckman, owner of the property at 706 Caspers Street, came to the Engineering Dept. to file a claim for damages for the loss of two trees on his property (see copy of attached claim). Bill Nims suggested a meeting at the site to view the trees. A meeting was held with Mr. & Mrs. Buckman at their property with the following city staff in attendance. Abe Blandin, Street Dept. Supt. Bobby Mills, Street Dept. Foreman Bill Nims, Engineering Dept. Don Burton, Park Dept. Supt. A - t the meeting,,Mr. Buckman said he felt that theF�trees.were.mutilated beyond repair. It was the Verbal opinion of -Don -Burton, Park Dept., that the trees would not -die and that they would grow back to original condition in about a year (see photos taken by Don Burton at that meeting). The claim for damages was filed with the City of Edmonds, acknowledged by City Council, and forwarded to the insurance carrier. 6/24/76 The insurance carrier (Mr. Dave Hopkins at the Seattle Office of St. Paul Insurance, Phone #525-8414) recorded a statement by Bill Nims regarding the subject claim.
