SUBJECT: DRAINAGE OF SPA TO GROUND
Dear Mrs. Hurley:
Per our conversation on April 26, 1995 regarding the proper procedure for draining your
hot tub, I have enclosed the City Ordinances. Hopefully this will assist you in complying
with the city's needs in the future. I have also enclosed the pertinent U.P. code of which
the city has adopted as standards unless otherwise superseded by the Development Code
for the city.
Note that all hot tubs shall be drained to the sanitary sewer when it presents a risk of health
or physical damage to adjacent property. When approved by the Public Works
Water/Sewer Supervisor, waste will be allowed to drain to any surface area (Sec. (e) of
U.P.C.).
As per our discussion, you stated that in the future you will drain the hot tub to your
shower stall located downstairs which will be acceptable.

BackGround: Recently there has been some confusion about who has
the responsiblity to deal with waste* water from pools and spas and
who is to insure the State and Local codes are satisfied. Because
to the confusion, it seem no one has been reviewing applications to
determine if the waste water issue has .been addressed. I hope to
clarify the.procedure through this policy.
Section
Spa and
states:
310- (Waste Water Disposal) of the Uniform Swimming Pool',
Hot Tub Code as adopted by Section 19.55.000 of the ECDC
Sec. 310-Waste Water Disposal
(a) Swimming pool waste shall be disposed of as hereinafter
set forth in this sedan and the type of disposal proposed shall
be approved by the Administrative Authority prior to the
commencement of any work. A means of disposal of the total
contents of the pool (periodic emptying) without surface runoff
shall be established to the satisfaction of the Administrative
Authority.
(b) No direct or indirect connection shall be made between
any storm drain, sewer, drainage system, seepage pit,
underground leaching pit, or sub -soil drainage line, and any line
connected to a swimming pool.
(c) When the waste water from a swimming, pool is to be
disposed of through a public sewer, a minimum of three (3) inch
P trap shall be required. The tail piece from the trap shall extend
a minimum of three (3) inches above finished grade and below
finished floor grade. Traps need not be vented when located on
the exterior of the building. The connection between the filter
waste discharge piping and the P trap shall be made by means
of an air gap.
EXCEPTION: Spas & hot tubs under 750 gallons shall not be
required to discharge into a trap.
Plans and specifications for any deviation from the above
manner of installation shall first be approved by the
Administrative Authority before any portion of any such system
is installed. When waste water disposal is to a seepage pit
installation, it shall be installed in accordance with the approval
granted by the Administrative Authority.
(d) Except as provided in paragraph (e) when a public sewer
or storm drain of adequate capacity is available for use,
swimming. pool waste water shall be discharged thereinto and
permission shall be obtained in writing from the proper authority
to do so. A copy of such permission stating the maximum size of
the waste line between the receptor and the sewer, and other
specific requirements, shall accompany and applications for a
permit made to the Administrative Authority.
(e) Where space and conditions are such that no hazard,
nuisance or insanitary condition is evidenced, swimming pool
waste water may be used for irrigation by surface or sub -surface
spreading.
(f) When no other means of waste water disposal is available,
a drywell maybe installed. Each such drywell shall be
constructed in the manner prescribed for cesspools in the UPC,
and drywells receiving only filter backwash shall have a capacity
of at least twice the amount of effluent discharged during one (1)
normal backwash operation, but shall in no case have less than
a five (5) foot (1.5m) vertical sidewall. When pool emptying or
other drains are proposed, the size and leaching capacity of
such drywell shall be proportionately increased to the
satisfaction of the Administrative Authority. No waste water other
than that from"swimming pool shall discharge into any such
drywell and no waste water from any swimming pool shall
discharge into a private sewage disposal system.
Policy: Pursuant to Section 310 of the Swimming Pool Code, the.
"Administrative Authority" (the Building Official) will require the
applicant to show how they propose to dispose of waste water from
a Pool,. Spa or Hot Tub. The Permit Coordinator will route the
permit application to the Water/Sewer Department (the "proper
authority") for their review as provided in 310(d). The Water/Sewer
Department will review for compliance with 310(d) and/or any other
applicable codes adopted by the City and will approve the proposed
design or make comment in writing if correction are needed.
19.55.040
19.55.040 NUISANCES
No loud, unnecessary or unusual noises by pool users shall be
allowed to disturb or annoy others. Yard lights shall be
shielded from neighboring property.
19.55.050 RESPONSIBILITY OF POOL OWNER
The pool shall be maintained in a clean and sanitary condition,
and all equipment maintained in a satisfactory operating
condition when the pool is in use. Adequate supervision shall be
maintained at all times when the pool is in use, so that no
person will be injured or drowned.
19.55.060 VIOLATIONS, PENALTIES AND EXPIRATIONS
Section 1.11 of the Uniform Swimming Pool Code, as heretofore
adopted, is hereby amended to read as follows:
A. Any person, partnership., firm, corporation or other
organization or entity violating any provision of this Code
shall be deemed guilty of a misdemeanor and upon conviction
shall be punishable by a fine and/or imprisonment, or by both
such fine and imprisonment, as set forth in Section 5.45.020
of the Edmonds City Code.
B. The issuance or. granting of a permit or approval of plans and
specifications shall not be deemed or construed to be a
permit for, or an approval of, any. violation of any of the
provisions of this Code or other ordinance or law. No permit
presuming to give authority to violate or cancel the
provisions of this Code or other ordinance or law shall be
valid, except insofar as the work or use which it authorizes
is lawful.
C. The issuance or granting of a permit or approval of plans
shall not prevent the Building Official from thereafter
requiring the correction of errors in said plans and
specifications or from preventing construction operations
being carried on thereunder when in violation of this Code or
of any other ordinance or from revoking any Certificate of
Approval when issued in error.
D. Every permit issued by the Building Official under the
provisions of this Code shall expire by limitation and become
null and void, if the work authorized by such permit is not
commenced within one hundred eighty (180) days from the date
of issuance of such permit, or if the work authorized by such
permit 'is suspended or abandoned at any time after the work
is commenced for a period of one hundred eighty (180) days.
Before such work can be recommenced a new permit shall be
first obtained, and the fee shall be one half the amount

19.55.070 EXEMPTIONS
Section 1.9 of the Uniform Swimming Pool Code is amended to read as
follows:
No permit shall be required for:
1. Hot tubs or spas associated with single family
residences, which are of less than 2000 gallons
capacity and completely supported by the ground.
2. Repair work, such as the stopping -of leaks in
drains, soil, waste or vent pipe, provided,
however, that should any trap, drainpipe, soil
waste or vent pipe be or become defective and it
becomes necessary to remove and replace the same
with new material in any part or parts, the same
shall be considered as such new work and a permit
shall be procured and inspection made as herein
before provided. 'No permit shall be required for
the clearing. of stoppages or the repairing of leaks
in pipes, valves or fixtures, when such repairs do
not involve or require the replacement or
rearrangement of valves, pipes or fixtures.
