'TW CRITICAL AREAS CHECKLIST
The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
deter. -nine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).
An applicant, or his/her representative, must fill out
the checklist, sign and date it, and submit it to the
City. The City will review the checklist, make a
precursory site visit, and make a determination of the
subsequent steps necessary to complete a development
permit application.
Please submit a vicinity map along with the signed
copy of this form to assist City staff in finding and

Subject: Platform constructed within a critical area buffer

This letter is in response to your conversation with Rob Chave, Planning Manager, with regard to the
platform that was constructed within a required critical area (CA) buffer. Although the platform does not
meet the definition of a structure, our Critical Areas Ordinance still requires you to maintain the 25 foot
buffer area around the stream from the top of bank. After reviewing the Critical Areas Ordinance and
thorough discussion among staff, it appears that your options are as follows:
1. Relocate the platform so that it is 25 feet away from the top of bank as identified on the survey
submitted with the Critical Areas Checklist. The 5-foot side yard setback must also be
maintained from the platform to all the property lines, in addition to the critical area buffer of 25-
feet.
Apply for a Critical Areas Variance to reduce the buffer area. The variance process costs
$1,000, plus an additional $200 for an Environmental review, and there is no guarantee that it
will be approved. Attached to this letter is a copy of the Critical Area Variance criteria and an
Environmental Checklist. If you decide to apply for the variance, you have the burden of proof
to illustrate that there are special circumstances on the site eliminating all other possible
locations for the platform.
Because this was brought to us as a complaint, we need to know what your intentions are to resolve the
violation within 2 weeks, or no later than Wednesday, April 5, 2000. If you have any other questions or

RE: Deck constructed within a designated Critical Area

The purpose of this letter is to inform.you of the City's decision with regard to the deck constructed near
the top of stream bank on property you own at 710 Fir Street. It is my understanding that you have had
numerous conversations with Jason Tourtellot regarding this matter and have cooperated on every request
made by City Officials. Mr. Tourtellot is no longer with the City but this letter will outline others who
will assist you in resolving this matter.
As you are aware, a Critical Areas Determination was made on 12/1/99 and determined that the property
is designated on both the City's Critical Areas Map and Environmentally Sensitive Areas Map due to the
existing stream. Shellabarger Creek is a Class 2b steam and requires a development buffer of 25 feet.
Decks less than 30 inches to grade are exempt from permit requirements unless they are located in a
critical area. The deck you constructed impacts the established critical area buffer and is in violation of
the Critical Areas Ordinance. In order to keep the deck a critical areas variance would be required. I have
met with the Planning Manager, Rob Chave, and he has indicated to me that the City would not support
such a variance request. Also, he believes it would be highly unlikely that the Hearing Examiner would
grant the variance.
Therefore, the following deadline is established: By March 17, 2000 you must decide on whether you
will pursue applying for a variance or remove or relocate the deck elsewhere on site (provided that
required setbacks can be met). If you choose to remove the deck please contact me with a date for deck
removal; if you choose to relocate the deck please meet with Kate Galloway, Planner to determine other
locations on site which meet critical area setbacks and zoning setbacks; if you choose to apply for a
variance the City must have a complete variance application and double application fees (including a
complete building permit application and double permit fees) by March 31, 2000.
If you have any questions please feel free to contact me at 425-771-0220. If there are extenuating
circumstances that will prevent you from meeting these deadline please contact me immediately. Also, be
advised the City has a Civil Penalties Ordinance that may be instituted to gain code compliance whereby
fines are imposed for failure to respond to City permit requests.
