Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or maybe
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,

Court order to move property line between 701 and 711 Cedar Street
During inspection of an addition on the property addressed 701 Cedar Street (approved
under BLD-2006-0043), it was found that the addition did not meet the minimum
required 5-foot side setback from the eastern property line. The property owners at 701
and 711 Cedar Street brought the property line dispute to court, and a court order was
issued moving the southern 79.09 feet of the property line separating these two properties
to the east by 1.40 feet. The addition at 701 Cedar Street (under BLD-2006-0043) now
meets the minimum required 5-foot side setback from the eastern property line; however,
the original house continues to be nonconforming because it still does not meet the 5-foot
side setback from the eastern property line.

We spoke the other day regarding a boundary line dispute between two neighbors in Edmonds.
You have proposed using the provisions of RCW 58.04.007 to resolve the dispute. Our
conversations have regarded the City's role in such a process.
As you are aware, RCW 58.17.040 (6) exempts from the platting statute boundary line
adjustments which do not create an additional lot and which contains sufficient area and
dimension to meet minimum requirements for width and area of a building site. These
provisions are mirrored in ECDC 20.75.050 (C)(2) and (3) which prohibit approval of a lot line
adjustment which would produce setbacks below the minimum required or reduce lot width or
lot size below the minimum required for the applicable zone.
Therefore, any adjustment made by your clients would be required to be approved by the City
through a boundary line adjustment process. Failure to do so would create illegal lots -- that is,
the structures and lots would not be entitled to nonconforming use rights because they were not
permitted by an action of the City. The difficulty, of course, is that the City cannot approve the
agreement between your parties because of the limitations of its ordinance and of state statute.
Please note a recent decision of the Court of Appeals, Division I in Mason v. King County.
Decision # 56341-6-I, 206 WL 2467912 (Wash. App. Div. I). This decision published August
28, 2006 is on all fours with our situation. King County attempted to avoid the statute by
arguing that the application should be concerned only with a "minimum lot area for
construction." The Court, however, held that a boundary line adjustment must meet the
minimum size and width requirements. Because one of the newly created lots would not meet
the minimum width requirement, it could not be approved.
As I have indicated, if the parties take a stipulation disposition to Superior Court and the Court
determines where the boundary line is based on adverse possession, the City is required to accept

the court order. Unfortunately, you cannot utilize the City's processes to obtain that same
approval. To do so would jeopardize the legal nonconforming status of existing structures to the
extent that they exist.

A water quality discharge problem was brought to my attention on May 14, 1996. Milky white
water was -spotted in the storm drain system downstream and was traced to its origination at your
property located at 736 Cedar Street in Edmonds, Washington, where Olympic Paving was
conducting work. The storm drain system flows directly to the Shellabarger Creek system and
then to the Union Oil Marsh and finally to Puget Sound. The system is intended for storm runoff
only and the water receives no treatment downstream, which means that fish and wildlife habitat
are impacted by any pollutant discharges.
The discharge of untreated wastes to waters of the State constitutes a violation of RCW
90.48.080 of the Washington State Pollution Control Law and could be subject to enforcement
actions. However at this time, we would only like to solicit your assistance and cooperation in
preventing the situation from reoccurring. I hope that the attached public education information
can be helpful in your, understanding the impacts of the pollutant discharge. A separate letter is
being sent to Olympic Paving.

2. The answer is c). Vegetation acts to stabilize the streambanks preventing erosion
and sedimentation of the streams, which is harmful to fish. Native vegetation requires
less chemical therapy (pesticides and fertilizers) that can also be harmful to fish. Trees
shade the stream, keeping the temperature cool and more tolerant for salmonoids.

build houses, rain striking the ground has fewer places to soak in gradually, and runoff is
faster and more violent causing erosion and flooding. Conversely, in dry weather

belonging to the people of the state and managed by the state for the maximum benefit
to the public. Water rights permit applications. are administered by the State Department
of Ecology, to ensure the proper allocation and management of Washington's water

Controls
Stormwater runoff from developed land
transports pollutants to receiving waters.
Runoff picks up contaminants such as oil -that
leaks from vehicles and the pesticides or
fertilizers used in lawns and gardens.
Construction site erosion, and the resulting
sedimentation, is another source of pollution.
Source controls are the most effective means of
preventing stormwater. pollution and protecting
water quality. Source control best management
practices (BMPs) keep pollutants from entering
stormwater in the first place. Source control.
BMPs are aimed at preventing or minimizing
pollutants through performing routine work in a
way.that eliminates, or greatly reduces, the
likelihood of contaminants getting into
stormwater.
Stormwater treatment BMPs, such as
infiltration and detention basins, remove
pollutants from stormwater. Source control
BMPs are preferred to treatment BMPs because:

pollutants without taking up precious space,

the event of a spill, specific clean-up
instructions for different materials, and the
chain of command for implementing the plan
and notifying the appropriate authorities. See
the Technical Manual for details on these items
and other BMPs that may apply to your specific
project.
Overall, source controls must be selected based
upon the type of activities occurring on the site,
and the types of pollutants being handled or
stored.'
Source Controls For Public
and Private Activities
Many effective stormwater BMPs have been
developed for use by public agencies and.
private businesses on a permanent basis. Some
permanent source controls that are routinely
carried out by public agencies include integrated
pest management programs, maintenance of
storm drainage facilities, and regular street
sweeping.

practices to keep in mind, and carry out as
needed.
"Alter the operations. The preferred option for
preventing stormwater pollution from business
activities is to alter the practices that may
contaminate surface or ground waters. This
may include stopping production and/or use of
the product, or controlling it through other
means — for example recycling used oil rather
than dumping it down a storm drain.
Enclose the activity. If the practice cannot be
altered, the next best solution is to enclose the
activity. This keeps rain from coming in contact
with the pollutant. Indoor drains should .
discharge into a treatment facility. If the
activity cannot be enclosed in a building, a less
expensive roof or overhang structure may be
used. Drains should be connected to the
sanitary sewer, not the storm drain,•to collect
and wash down water and any runoff that may
enter the area. Whenever possible, activities
that generate pollutants should be separated
from other operations.
Divert discharges. Runoff from areas of
significant pollution sources should be diverted
away from other stormwater runoff and
discharged into a treatment facility. These
facilities can include:
® Individual process wastewater treatment
systems
Public sanitary sewers
Dead-end sumps
Discharging into a sanitary sewer.requires the
appropriate approvals and permits from the
local sewer authority. Discharges to sewers
should be limited to those frequent, low flow
storms that contain the highest concentrations of
pollutants. Larger runoff events should bypass
treatment and discharge into the storm sewer.
Dead-end sumps should be used when the other
options are not available. Dead-end sumps need
to be pumped out regularly, and the waste must
be disposed of properly.
Emergency Spcseanup Plans. Owners -of
facilities engaged in storing, processing, or
refining oil and/or oil products, or businesses
that produce Dangerous Wastes are required by
federal and state law to have an Emergency
Spill Cleanup Plan. In general, the plan should
contain:
V Description of the facility, nature of
activities, and types of chemicals used
e Site plan showing location of storage
areas, storm drains, slopes, and spill
control devices
V Notification procedures in case of a spill
7 Cleanup procedure instructions
The plan must include employee training,
describe immediate spill response, and on -site
equipment for cleanup.
...In Summary...
Source control BMPs are designed to prevent
pollutants from entering stormwater by
eliminating the source of pollution or by
preventing contact of pollutants with rainfall
and runoff. Source control BMPs are generally
the most cost-effective because they reduce the
need for treatment BMPs, and they are usually
less elaborate and less expensive to implement.
They are specific to the type of land use and
types of pollutants being controlled. ,
Source control BMPs include erosion control
(e.g. covering disturbed soil), covering storage
or work areas, directing wash water and similar
discharges to the sanitary sewer or a dead-end
sump, eliminating illicit discharges, and other
good operation and maintenance practices.
In addition to protecting water quality,
implementing source controls can save the
owner/developer money by avoiding
maintenance costs for more costly treatment
BMPs and avoiding potential liability and
cleanup costs for contaminated sediments.
