Dear Resident:
It has just come to our attention that you as well as two of
your neighbors have been billed for water by the City of
Lynnwood instead of by the City of Edmonds.
At the time of annexation of the area to the City of
Edmonds, your water account was not transferred to the City of
Edmonds although you receive water from Edmonds. It still was
not detected when your property was connected to the sewer and,
therefore, you were not charged for sewer service in your
regular utility bill.
To correct this situation, we are working with the City of
Lynnwood to transfer the accounts to Edmonds. This may not be
accomplished before the next scheduled meter reading by
Lynnwood, but be assured that you will not be double charged
during the transition. It is noted that we will not backcharge
for the sewer service charges, but we will commence this charge
when the first billing comes from Edmonds.
Since water and sewer service rates differ from the City of
Lynnwood, you may contact the City of Edmonds Utility Billing
Office at 771-3051 for rate information.

If the permit is not issued prior to that date the plans and.permit
application will be destroyed and the plan check fees of $64 will

AGREEMENT AND COVENANT APR 2 8 1996
WHEREAS, the undersigned are owners of certain
property located in the City of Edmonds, Washington, more
particularly described hereinafter, and
WHEREAS, owners, or their authorized agents, have
applied for permits and/or approvals from the City of Edmonds
to subdivide and/or construct improvements upon said real
property, and
WHEREAS, duly enacted ordinances of the City of
Edmonds require said owners to provide certain off -premise
improvements as a condition of receipt of said permits
and/or approvals, said improvements include but are not
limited to streets and sidewalks, and
WHEREAS, in lieu of constructing said off -site
improvements or posting sufficient bonds or other security
with the City as authorized by duly enacted ordinances,'
owners desire to execute this Agreement and Covenant to
assure completion of the improvements as required by City
ordinance, and
WHEREAS, owners expressly acknowledge that but for
the execution.of this Agreement and Covenant the City, under
its duly enacted ordinances, could not issue the permits
and/or approvals sought by owners, now, therefore,.
IN CONSIDERATION of mutual benefits and the City's
approving the permits and approvals sought for by owners, it
is hereby agreed as follows:
1. The undersigned are owners of certain real
property located in the City of Edmonds, Washington, and
legally described as set forth on Exhibit A, attached hereto
and incorporated herein by this reference as if set forth in
full.
2. Owners acknowledge that certain off -site
improvements are required under City codes before development
and/or subdivision can occur on the subject property. These
off -site improvements are set forth on Exhibit B, attached
hereto and incorporated herein by this reference as if set
forth in full.
3. Owners agree to assist in completion of the

as a deed in the Grantor -Grantee Index with owners being
listed as grantors and the City of Edmonds as Grantee.
5. The agreements and covenants contained herein.

herein. All costs of recording shall be paid by owners
prior to recording of this Agreement and Covenant. In
addition to any other remedy authorized, the City of Edmonds

specific performance. In the event the City must bring suit

construct side sewers in the public right-of-way.
w b. The side sewer contractor assumes full reponsibility for each

side sewer line.
o d. Side sewers may not be installed closer than thirty inches (30'

between cleanout. All 90 turns must be constructed of a 45° (1/8

through other than granular soil.
i. Cleanouts are required at 30"-60" from each plumbing exit line
and at minimum intervals of 100' along sewer line run.
j. Trenches within City right-of-way must be restored to original
conditions. Contractors shall be responsible for right-of-way failure
due to poor compaction of fill.
k.. Side sewer must be left uncovered until inspected and approved
by the City.
