INTRODUCTION: The applicant has proposed to convert a portion of the lower level of an existing daylight rambler at 7119 165`h Place SW to an ADU. Approval of an ADU requires compliance with Edmonds Community Development Code (ECDC) Chapters 16.20 and 20.21. B. tE,SI COMPLIANCE WITH P ' J�,._.�.i_k,, i -•ire ECDC CHAPTER f!I 16.20: The purposes of the RS — Single -Family RS-' 0 „ 1 Meadow dale Residential zone are to 71s w Pia reserve and regulate areas FIddS primarily for family living in single-family dwellings Site and to provide for additional non-residential City of Edmonds Zoning Map, December /4, 2007 uses which complement and are compatible with single-family dwelling use. Per ECDC 16.20.010, an ADU is an allowed secondary use with a conditional use permit. The proposal is required to comply with the purposes of the single-family residential zone and the criteria outlined in ECDC 20.21, Based on the review of the specific ADU criteria (as described in Section C of this report), staff feels that the proposal is in compliance with the purposes of the single-family zone. C. COMPLIANCE WITH ECDC CHAPTER 20.21: Section 20.21.030 of the Edmonds Community Development Code provides the criteria describing how an accessory dwelling unit is to be reviewed. In order for the permit to be approved, all of the criteria must be met. The criteria for Pernard / Simpson File No. PLN-2007-0099 Page 2 of 5 approval are as follows: (1) Land Use Permit; (2) Number of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light, Ventilation, Floor Area, and Similar Factors. The ADU criteria were established to ensure that accessory dwelling units would comply with Chapter 16.20. Detailed explanations of staff review of these criteria follow. 1. Land Use Permit Required: Per ECDC 20.21.030.A, a land use permit is required for approval of an attached accessory dwelling unit. A complete application for a land use permit was submitted to the City on December 27, 2007 (Attachment 1). The applicant also submitted the required Covenant to be filed with the County Auditor (Attachment 2). 2. Number of Units: The proposal will result in only one (1) ADU. This is in compliance with the number of units allowed per ECDC 20.21.030.B. 3. Size: The applicant has indicated that the ADU will be approximately 675 square feet. The existing two-story residence totals 3,327 square feet. As a result, the proposed ADU would comprise 20% of the total livable floor area of the primary dwelling (see Attachments 3 - 5). The following table describes both the maximum size that Accessory Dwelling Units are allowed to be as well as the proposed dimensions for this application: Maximum Allowed Proposed 40% of livable area of the primary dwelling 20% of livable area of the primary dwelling 2 bedrooms 1 bedroom 800 square feet (sf) 675 square feet s 4. Location and Appearance: Existing Conditions: A 3,327 square foot daylight rambler sits on the parcel. There are currently separate entrances to the lower and upper levels as well as access to each level through the garage. How the Proposal Meets the Location and Appearance Criteria: According to Chapter 20.21.030.13 of the Edmonds Community Development Code: The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be incorporated into the design of the principal dwelling unit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single-family residence using matching materials, colors, window style, and roof design. Because the ADU will be incorporated into an existing structure, there will essentially be no change from what is seen there today. Structurally, there will be no visible changes to the exterior of the existing house. The ADU on the lower level will use the existing entrance on the west side of the house. The primary dwelling unit on the upper level will use the entrance on the east side of the house. Both spaces will retain access through the garage. 5. Parking: ECDC 20.21.030.E states that an accessory dwelling unit requires one (1) off-street parking space in addition to the parking spaces normally required for the principal dwelling. As a result, a total of three parking spaces are required for this proposal. According to the applicant and plans submitted, there are three parking spaces in the garage and two uncovered parking spaces onsite.' Pernard / Simpson File No. PLN-2007-0099 Page 3 of 5 6. Occupancy: ECDC 20.21.030.F states the homeowner must provide an affidavit attesting to his/her occupancy of one of the units for a minimum of six months of each calendar year as a condition of approval. The applicant has submitted such notarized affidavit (Attachment 6). 7. Safety, Light, Ventilation, Floor Area, and Similar Factors: ECDC 20.21.030.G states that -as a condition of approval, the applicant is required to apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. Any conditions or corrections resulting from the inspection must be complied with per code requirements. Any approval of an accessory dwelling unit should be conditioned to require compliance with the Building Department's inspection requirements. This has been made as a condition of approval. D. TECHNICAL REVIEW: The Engineering and Building Divisions as well as the Fire Department and the Department of Public Works have reviewed the application. The Building Division submitted comments (Attachment 9) which must be addressed during the building permit application. E. PUBLIC COMMENTS: Two public comment letters were received during the review of this proposal which are included as Attachments 7 and 8. 1. Allan and Debra Coleman (7111 165'h Place SW) questioned whether the homeowners will be living at the subject site and objected specifically to the additional traffic generated by the use and generally to the potential change to the single family area. Staff Response: According to the ,2006 Comprehensive Plan (see below), accessory dwelling units are an important component in providing additional housing choices while building residential capacity within existing single family residential zones in Edmonds. Given the limited supply of vacant land within the city, capacity estimates were not calculated strictly on the amount of vacant buildable land, but also on increased densities and intensity of development within various areas of the city. Two methods of development were targeted to provide additional residential capacity: accessory dwelling units (ADUs) and mixed use development. (p. 19) Housing goals are directed toward providing housing opportunities for all segments of the city's households; supporting existing neighborhoods and preserving/rehabilitating the housing stock; maintaining high quality residential environments; and providing assistance to developing housing for elderly, disabled and low-income households. These goals are supported by policies which include review of regulatory impediments to control of housing costs and affirmative measures to support construction of housing for protected groups; encouraging expansion of the types of housing available, including accessory dwelling units, mixed use, and multi family housing; flexible development standards; and review and revision of development regulations, including assessing the feasibility of establishing time limits for permitting; consolidating permitting; implementing administrative permitting procedures and instituting preapplication hearings. (p. 104, emphasis added) Chapter 20.21 of the Edmonds Community Development Code implements the goals and objectives of the Comprehensive Plan with respect to Accessory Dwelling Units and specifies Pernard / Simpson File No. PLN-2007-0099 Page 4 of 5 how they must look and function. Specifically, Section 20.21.030 outlines a number of criteria that must be satisfied in order to approve an accessory dwelling unit (see C.1-7 above). Each criterion must be met or the ADU is denied. Regarding occupancy, as part of the approval process, the applicant must sign a statement indicating they agree to the occupancy conditions established in the Code. Failure to meet the occupany requirements results in revocation of the permit. In addition, there is a limitation on total occupancy -of a given site. No site shall be occupied by more than one family as defined in ECDC 21.30.010. This limitation exists to ensure that the approval on an ADU does not increase the overall density above what is normally allowed in a single family residential neighborhood. In effect, this limitation also serves to minimize off -site impacts such as traffic. Robert and Elizabeth Moeller (7124 1651h Place SW) indicated their objection to changing the single family residential nature of the subject site. Staff Response: See above. F. DECISION: Approved with the following conditions: 1. This permit shall expire automatically if any of the following issues arise: a. The ADU is substantially altered and is thus no longer in conformance with the plans and drawings reviewed and approved by the permitting authority and building official. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the ADU, the owner- oEcupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025.A.I I. 2. A Compliance Permit must be obtained from the Building Division and final inspection must be made and occupancy approval granted by the City Building Inspector prior to the lower level being used as an ADU. Specific comments from the Building Division will be addressed during review of the Compliance Permit. One requirement will be for a separate thermostat for the ADU. 3. If determined necessary by the Building Division, a revision to the issued building permit for the single-family residence must be submitted. 4. A single-family dwelling may have no more than one (1) accessory dwelling unit per lot. 5. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor. Prior to occupancy of the accessory dwelling unit, the applicant must either: Provide the City recording fee charge of $15 plus the County recording fee of $42 for one page, for a total of $57 plus $1 for each additional page, and the City will record the covenant for you; OR b. Take the covenant to the County and record it, and return a copy of the recorded document to the Edmonds Planning Division. 6. The Accessory Dwelling Unit permit shall not be transferable to any site other than the subject site described in the application. The permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above; however, the new Pernard / Simpson File No. PLN-2007-0099 Page 5 of 5 owners must file a new notarized Accessory Dwelling Unit Affidavit with the City of Edmonds Planning Division. Timeframes The time limits for Reconsiderations and Appeals run concurrently. All inspections must be made and final occupancy approval granted by the City Building Inspector prior to the area being used an ADU. R311.4.2 Requires one exit door to be 3' x 6'8" side -hinged and can not exit through the garage. Sliding glass door does not meet this requirement. R310 Requires each sleeping room to have one winndow with a minimum net clear opening width of 24", height of 20" but not less than 5.7 square feet. Also, maximum sill height is 44".
