HALL MAYOR It was so nice to meet a long time resident of Edmonds. I am sure you have seen many changes in the character of the City over the years. I wish that I could offer some assistance .to you in resolving your problem, but in researching the codes I could notfind documentation that supports your case. There simply are no City codes that cover your particular situation and the work that you want done is not a service provided by the City. As I told you on the phone, your neighbors contractor, Sunflower Development, went out of business in 1988 so lam not sure if you have any recourse with that firm. As promised, I discussed. your concerns with my supervisor and we are in agreement that in order to stop the minor erosion of the bank you may want to enlist the services of a professional engineer to make recommendations for long term.slope stability. Also, you may want to consider talking with your neighbor to discuss diverting any water from the top of the bank away from your slope. Graf, Acting Building Official DATE: June 16, 1993 RE: 712 Bell Street As a followup to a telephone inquiry I received on 6/15/93 from Mrs. A. Jensen, I met her at rental property she owns located at 712 Bell Street at 2:OOpm on 6/16/93. This property is downslope from the neighbor to the east with a difference in elevation from 5 to approximatelyl5 feet going from north to south. The residence is a one story rambler and has an attached carport on the east side. The neighbors rockery, constructed in 1986 extends from the street property line south approximately 40 feet. The rockery stops at about five feet in front of the carport. I could see no evidence of a rockery or retaining wall on Mrs. Jensen's property retaining the slope to the carport, although the foilage was dense. Mrs. Jensen explained to me that she had removed overgrown blackberry bushes'against the carport and discovered that the bank was sluffing off and pushing dirt against the vinyl siding. The carport siding is about four feet in height and one panel is bowed from the dirt pushing against it. It appeared that about a foot of earth had been removed against the overall length of the carport wall, approximately one-half yard of material. I also noted that some garbage and debris were in this area as well. She told me that the problem started with the contractor who built her neighbors house in 1986. She said she had contacted Laura Hall. when she was a councilmember and had Mayor Hall come to the house and view the sluffing at that time. Ms. Hall had told Mrs. Jensen that the City had no authority to intervene and rectify the situation. Mrs. Jensen recalled a case to me where the City of Kenmore required a developer to install a rockery to protect a cut slope. I noted to her that the original contractor was probably. out of business and the City could not force her neighbor to come onto her property, make a cut along the property line, remove the excess material and install a retaining wall or rockery. She was emphatic that she did not want her neighbor to be responsible rather, the City, had the responsibility to resolve her sluffing problem. I tried to explain that the City does not provide that type of service and that she would need to obtain a permit and havethe work done herself. She agreed that she should have to get a permit for work done on her property but she feels that the City. had the responsibility to force the contractor to resolve this problem when the original work,was done and since the City failed to force this contractor it is now the City's responsibility to resolve.
