Our records indicate that you are the owner of the property at 7125 176th St SW. We have
noticed that the vegetation on your property is obstructing the Stop Sign (R1-1 per Manual on
Uniform Traffic Control Devices) at the corner of 72nd Ave. W and 176th St SW. This is in
violation of City code, from which the following is excerpted:
9.25.010 Violations.
A. It is unlawful for any person who either owns or has the right to possession, or both, of abutting real
property to permit the erection or maintenance of any sign, device, structure or vegetation in the following
circumstances herein set forth, and in the event of circumstances presently existing which by reason of
this section are now in violation of the Edmonds City Code, said person shall immediately remove the
same:
1. In such manner that it obscures or conceals any traffic control sign, signals or other device as
to interfere with the full and effective use and visibility of the same to the motoring or pedestrian public;
In order to reduce the hazard and enhance public safety, the City of Edmonds directs you to cut
back your trees to allow full visibility of the sign for westbound traffic on 176th St. SW.
Please complete the modification and trimming by September 12th, 2008. Your cooperation in
bringing your vegetation into compliance is appreciated. Please feel free to call me with any

Wayne Tanaka called today and indicated that he has
discussed the subject item with Stan Sorenson by phone.
Mr. Sorenson is representing Mr. Elder in the matter.
We had asked the City Attorney to reply to Mr. Sorenson's
letter and Wayne feels that he has done enough by the
telephone call. Wayne feels that he has conveyed the
fact that the City is not responsible for the problem since
it occurred before the property was inside the city limits
and many years have also passed.

P.S. This matter has come before the City before in a claim
filed by Keith Elder in 1975. A copy of that claim is attached.
I believe either you or Jim Murphy will recollect this situation
of the driveway access to the garage being eliminated through the
grading of 72nd Avenue West. The garage was apparently built on
fill which was not compacted properly causing cracking and
sloughing of the soil. There is no significant erosion observed
at the present time concerning the safety of abutting property.

Gentlemen:
I am informally representing Mr. Elder regarding the above
property as I have for more than a year.
He continues to be deprived of use of his garage and erosion
takes place along part of his 72nd Street boundary. Whether
the fault lies with Snohomish County, sub -dividers, or the
City, we feel that the latter should rightfully take respon-
sibility.
Proper and ordinary use of property should not, and I believe
legally cannot, be subject to restrictions due to jurisdict-
ional transfers. The U.S. Supreme Court has just ruled that
municipalities may be sued for infringement on constitutional
rights. Certainly this would include a right to property use.
Annexed are current photographs of the problem. We trust that
the City of Edmonds will correct it.

The damage started in 1966. There was a road put in through the west side
of my property. The road is right next to my house and was cut very deep.
There never was a retaining wall of any kind rut up. Since 1966 and through
today trucks of fill dirt and a lot inconvience have been put up with. The
inconvience I could stand but the damage to my home is serious and costly.
I have lost the complete use of my garage since 1966. My back yard and patio
is cradked and slipping away. My house has cracks in the foundation, stucko,
and frame. These cracks are in the middle of the house and are a direct
result of the road cut. My sidewalk along the house is slipping away. At
the present rate my home could be totaled out because of what was started
when the road was put in. The damages I am asking are not excessive in
view of the anquish and damage. that .has been caused.
