Of Public Works 713 Laurel Street Edmonds, Va 98020 May 25, 1981 On May llth I wrote a letter to Mr Jack Mitchell, Public Works regarding my water bill for the period of February 3rd to t pril lath. Sometime during the week of May llth I received a telephone call from a man named "Archie" a very foreign speaking man representing the water department. This man read me a letter that he was going to send to me. He further said that I could write to the Mayor or the City council if I didn't agree with it. Since I haven't received it as of this date and because I am upset about the erroneous bill I have decided to write to you. 11:Iayor Harrison I know how busy you are but I would appreciate it if you could do something hbout equalizing this water bill. As a long time resident of this city I find it difficult to have something like this happen and all I get is a shrug from a city employee. In early April when I received the water bill for the Feb -April period I noticed that it was more than double what it previously has been. kt first I thought it was due to the increased rates but upon further checking I noticed the consumption figures indicated the more than double usage. Since we are fairly diligent in maintaining our home and since I keep records of previous utilities it was easy to review the history of past water bills. I enclose a chart showing the consumption and costs for the six years. It is obvious when one compares the six year history for the period of February -April that something happened in 1981. I honestly and sincerely tell you that we have not used the quantity of water indicated on the bill. le have not had "guests or children" living at this residence during this period (my wife and I are the only ones occupying the house). hVe had no undergroud leaks to our knowledge nor did we do any work to the piping and water system during this period. I ask that consideration be given to adjusting this bill to a fair value consistent with previous water usage. Your complaint was that your neighbor at 807 7th Ave S was purposely diverting water into your yard, added pavement and a temporary canopy in the undeveloped right of way. On May 29, 2008, Public Works Director, Noel Miller, and Street/Stormwater Manager, Tod Moles, met with you and your son at your property to see the area in question. It was noted that the ground was wet and there was a piece of flex pipe in the vicinity that was not connected to anything. Concurrently, I had also informed the owners at 807 7th Ave S. that their added paving near the fence was in the public right of way and they needed to submit an application for an encroachment permit for review. There was no evidence of a temporary canopy over the new driveway area. The permit application paperwork was promptly submitted. It was then held for review pending the outcome of your water diversion complaint. The City's Stormwater Engineer, Jerry Shuster, Public Works Storm Lead, Mike Johnson, and I subsequently met with your neighbor to inspect his property. The Stormwater Engineer determined that the water flow from the natural stream on said property does not flow over to your property and there is no evidence of any purposeful diversion of the water. The owner's of 807 7th Ave S. have constructed a dry rock bed on the surface which takes any overflow from the stream to the pavement which then flows to the catch basin on 7th Ave. It was also determined that the ground between your property and 807 7th Ave S. is sloped away from your property so any water would flow to the north, not towards your property. The encroachment permit for the paving was reviewed and issued as it was determined the area met the requirements for encroachment into an undeveloped right of way. Mitchell Acting Director of Public Works SUBJECT: JAMES KING - 713 LAUREL We spoke to Mr. King on two occasions, checked the water meter for leaks, and we could not find a reason to adjust his water bill. We suggested that he have the meter tested at our City shops to prove to him that it was not malfunction- ing, however he was reluctant to do this. I am reluctant to make an adjustment. At this time, however, because of public relation reasons,and the time we have already spent talking to Mr. King, I would suggest, with your concurrence, that I adjust his water bill in accordance with the same usage he had last year. KING, 713 LAUREL STREET -- CUSTOMER COMPLAINT DATED 5-1-81 REGARDING HIGH CONSUMPTION After checking readings and previous consumption history, it was noted that twenty additional units of water was used by the custo- mer for the period from February 3, 1981 to April 3, 1981. It was explained to Mr. King at his home with his wife present that the meter was functioning properly and the reading on May 1, 1981 was 314, which indicated a back to normal consumption level for his household. During my conversation with Mr. King, he indicated verbally that he had house guests during the time in question which may have explained the cause for above normal consumption. Other than the aforementioned reasons I could not find any indication of a leak or misread on the meter to his residence. LEE WILLEIKSON, Meter Shop Leadman . I called Mr. King on 5/13/81 at 9:15 a.m., explained to Mr. King that the meter was working properly and if he would like to have his meter tested and it will cost $7.00. Mr. King indicated that he will not pay $7.00 for the test. I explained to him that nothing can be done to reduce his water bill. I mentioned to Mr. King if he wanted to he could write to the mayor's office or council. I thought at first it was due to an increase in the new utility rate. Upon further investigation and comparison with prior years' I found that the consumption was almost 3 times what it normally has been. I find this hard to believe since there is only my wife and I living here now. In prior years I had my children living at home, but now there is just the two of us. I have enclosed for your review the water usagg-for my home covering the past 6 years. As ..you can readily see the average for the same periods in prior years ran about 12.83(hundreds cubic feet). I know that it is hard to believe that we could use 33 hundred c/f with a reduced number of occupants. That is what surprised me. Our plumbing systems were newly installed with work completed in late November. The water meter is supposedly accurate and does not indicate any reading with non intential use. ;quite frankly I cannot explain the drastic increase, nor is there any logic nor history to hint of potential leaking problems. The consumption has a definate pattern, summer usage is higher than winter, indicative of lawn and garden irrigation. There is some unexplained error is the quanity shown in my bill. I sincerely ask if something can't be done to reduce this phenomenon figure. Any assistance you can give will be helpful and appreciated.
