Dear Mr. Anderson,
The City has received a complaint regarding a third dwelling unit created at the subject
property in the lower eastern section of the residence.
As was noted by the City of Edmonds in your original duplex application in 1979 (CU-
14-79) with Snohomish County, "(3) Edmonds does not allow multi family in single-
family zones with a Conditional Use Permit. (4) This will be a nonconforming use if this
area is annexed into the City, which would result in the applicant being allowed only
limited improvements to this property. Any improvement would need to be reviewed by
the Architectural Design Board. "
Edmonds Community Development Code (ECDC) states:
ECDC 17.40.010 Nonconforming uses.
A. Definition. A nonconforming use is one which was once allowed by applicable land
use regulations, but is no longer allowed, due to the passage or later change of this zoning
ordinance and where applicable its predecessor.
B. Continuation. A nonconforming use may continue, unless required to be abated by
subsection C of this section, but it may not be expanded in any way, including additional
lot area, floor area, height, number of employees, equipment, or hours of operation except
as otherwise provided in ECDC 17.40.050. (underline added)

A building remodel permit is also required for any conversion of residential space to a
kitchen facility or from a shop space to habitable space. A compliance or remodel
building permit application, fees, and penalty fees would be required for a kitchen
conversion or shop conversion prior to permits at the subject property. Your scope of
work will determine the type of permits required.
Corrective actions required:
• Please contact me at 425-771-0220 x 1716 at your earliest convenience by July 25,
2003 to respond to the complaint.
• A triplex is not a permitted use in the RS-8 Zone and must be discontinued by
August 31, 2003. The upper duplex portion is -a legal nonconforming use and
may be continued but not expanded.
• Please provide a scope of building work including but not limited to a lower floor
kitchen and bathroom conversion that may have taken place by August 13, 2003
and acquire necessary building permits or demolition permit to remove the
dwelling unit as appropriate to your scope of work.
• An expedient method to confirm that a remodel and third unit do not exist at this
location would be to schedule an inspection at the subject property. If you prefer
an inspection please contact me by July 25, 2003 to schedule a time.

The City received your response letter on August 4, 2003 (enclosed) regarding the additional 3" 1 dwelling
unit developed at the subject property.
In response:
• An extension is granted to October 31, 2003 to complete this transition.
• It is noted that the stove, hood and vent will be removed by October 31, 2003.
• There will be unobstructed interior access to the primary dwelling from the lower eastern section
of the residence.
• Please call for an inspection upon completion or before November 10, 2003.
Please note the following additional requirements per our conversation:
• The "Statement on Accessory Dwelling Units" will need to be completed and notarized. Edmonds
Development Services will file it with the Snohomish County Auditor by October 31, 2003.
• A remodel permit will need to be acquired by August 31, 2003 for the bathtub and other remaining
remodel construction.

lower rear portion (3rd apartment in basement) of your home at the subject property on
November 14, 2003. The purpose was to confirm that the portion was no longer used as
a third apartment. Inspection confirmed that no one was living there and the oven/range
and vent had been removed.
