After due consideration of the evidence presented by the
Applicants; evidence elicited during the public hearings; and as a
result of the personal inspection of the subject property and the
surrounding area by the Hearing Examiner, the following findings of
fact and conclusions constitute the basis of the recommendation of
the Hearing Examiner.

1. The Applicant has requested approval of an extension of 2
years of a PRD approval on property located at 68th Ave. West,
in the City of Edmonds, WA; and more particularly described as
set forth above.
2. The planned residential development that is the subject of
this hearing was originally approved by the City Council of
the City of Edmonds in 1977. This approval was made by
passage of ordinance 2082.
3. The effective date of passage for the ordinance creating the
PRD was July 30, 1979.
4. Section 20.35.120 B of the City of Edmonds Community
Development Code requires that a planned residential
development is considered abandoned if the project has not
been completed at the end of 2 years from the adoption of the
ordinance of approval.
5. The Applicant applied for an extension of the PRD on July 8,
1981, because the 2 year period expired on July 30, 1981.
Since adoption of the ordinance of approval the construction
of the PRD on the subject property has been limited to the
establishment of underground utilities, the installation of
water and the installation of storm sewage. None of these
items have been accepted by the City but they have been
inspected as of the dates of hearings.
6. The Applicant has acquired 5 separate building permits for
construction of 5 different clusters of the PRD.
