Dear Mary Lou:
As you know the developer of Parkside West Condominiums
sent a letter to.the Mayor prior to e.he June 8, City Counbil.
meeting requesting an extension of the building.permit for
these condominiums. This letter was in response to a letter
from your department to the developer informing them that the
building permit would expire on June 16 unless further
construction was commenced as required under our code
Although one extension is permitted in such a situation under
our code, it was the general understanding that the building
permits for this project had already been extended once*
Given this general understanding of the facts, when this
matter came up before the City Council on June 8 the advice
was that the developer must begin construction before June 16
unless the City Council decided to amend the requirements of
the building code to permit a second extension. The City

Council declined to amend the code.
Now that there has been time to carefully examine the
file and determine what the history of these permits has
been, it appears that what was taken to be a'prior extension
of these permits was in fact a reissuance of the permit and,
therefore, there has been no extension of time to commence
construction permits. This means that an extension at this
time is permissible so long as it is for no longer than 180
days and so long as it is the only extension.
Section 19.00.01OF of the Community Development Code
requires that every building permit shall expire after one
year requiring the issuance of a new permit. The principle
