Ms. Charleson said this plat was zoned CG except for Lot 7 which is
zoned RML. She said the applicants had indicated they would like to
rezone Lot 7 to BN which is the same zoning as that of the Dairy Queen
property adjacent to to it, but the rezone was not a part of this appli-
cation. She said she had received calls from some of the neighbors to
the south inquiring as to what the use of the Jots will be, but at the
present time the applicant was only asking to subdivide to sell them.
The.proposal would provide that the subdivided lots meet Code standards
and that streets and drainage meet Code standards. Individual reviews
will be accomplished when the building permits are applied for on the
separate lots. The applicants had proposed a street going in from 212th
and exiting on 72nd with a cul-de-sac at the interior. A 50' right-of-way
was proposed and sidewalks will be installed. She said the City was
requesting a 25' perimeter setback where the site abuts residential zoning
and when the buildings are constructed a minimum of a 10' planting strip will
be required for buffering of the residential zoning. Assistant City
Engineer Dick Allen said the upper area of the site is along 212th and
the interior drops down. He said storm drainage and sanitary sewers are
in the area. He said commercial street standards call for a 60' right -of -
way -with 40' of curbed streets and sidewalks on both sides, but because
of the shortness of this street it appeared the commercial street standard
did not apply, so -he recommended a reduction of the right-of-way from 60'
to 50' and a street width of 36' with sidewalks on both sides. He said
the site was generally satisfactory as to soil conditions, but he was
concerned with the stability along the ridge areas at the backs of the
lots. He was concerned regarding the stability of the retaining wall
and embankment relative to new construction being placed on the sites.
He felt there was a high probability that it could be proven by a soils
specialist that the soils would be satisfactory, but he recommended a
soils :report be accomplished prior to final plat approval. He said
streets in the area were adequate to service the property and there
would not be a major impact on streets and utilities, assuming certain
standards. Regarding drainage, he said it is a large area and will have
a lot of impervious surfaces but there is a method of designing storm
drains so the storm sewers on 72nd will hardly notice the impact. He
said all the sewage in the area flows to a pump station which is near
its peak capacity, mainly due to various peak loads being placed on it
at specific times. He anticipated that the City would be revamping
that pump station. He saw no problems at this time in developing the
property and concurred with Ms. Charleson in recommending approval.
Ms. Charleson then showed slides of the site. She said when buildings
are constructed on Lot 9 the slopes will be watched closely, and that
a stability report had been requested on the retaining walls. She felt
the design was very good, noting that it was a difficult site. She
felt they had proposed a road that would adequately serve the property
and would be attractive. She said they met all Zoning Code standards and,
if drainage and grading plans conformed to City standards, she did not
feel there. would be a significant adverse environmental impact as 212th
and 76th were capable of handling the increased traffic and, although
there would be an increase in air pollution, she did not believe it would
be significant. She felt the proposal would certainly increase the
aesthetics of the site.
Allen Morgan of Reid, Middleton & Associates said they had done some
preliminary work in regard to access, sewers, and water. He said they
intended putting in a loop water system connecting with the existing 8"
water mains on 212th and 72nd with adequate fire hydrant circulation.
He said they have adequate sanitary sewer facilities. Also, that the
