This office represents a dumber of citizens involved in
1i-tigation concerning a proposed land development within
.the jurisdiction of the city of Edmonds.
The project is
being pursued upon the application of a private developer,
Sierra West Construction, Inc., and consists of a P-R-D type
development of some 29 townhouses.
We understand that the city attorneys office for the city of
Edmonds is the office of Ogden, Ogden & Murphy, attorr-:.-�ys at
law, 1411 Fourth Avenue Building, Seattle, Washington. A
deputy city attorney by the name of Wayne Tonaka is handling
this particular matter.
My purpose in writing is to request that your respective
offices investigate the propriety of the expenditure of city
funds for certain aspects of the city's legal defense of
this matter. Specifically, it would appear that on certain
occasions the city attorneys office has expended considerable
time on matters thatiseem to be the exclusive interest of the
developer and of questionable public or city interest.
To cite a specific example, recently the city has devoted
substantial legal time to an argument, that the plaintiffs in
this action must post a bond to indemnify the developer
}
