ZO-12-78 Amendment to Section 12.15.100 of .the Zoning Code to allow for the restoration of nonconforming residential buildings damaged in excess of 50% actual valuation, if such buildings were legal at the time of original construction. Mr. LaTourelle indicated the proposed amendment would apply only to residential structures, both single family and multi -family. It had been brought to his attention that problems had arisen in financing reconstruction of multi -family structures because insurance proceeds were required to be used for rebuilding the damaged building but the City Code required that buildings which had been nonconforming would have to be reconstructed in conformance with all regulations. In some cases, because of recent Code changes, where there may have been a multi- family structure, the number of units permitted under reconstruction would be reduced. In the case of a condominium there would be the problem of whose units could not be rebuilt, as well as other unusual problems. Mr. LaTourelle pointed out that the incidence of situations such as these would be very low. He felt that the remedy currently required if a . nonconforming residential structure were destroyed was unnecessary overkill in that complete abatement of the building would be required. The proposal would not allow any increase in the degree of nonconformity, but would allow a nonconforming residential building, if conforming at the time of original construction, to be reconstructed to that nonconforming state. The public portion of the hearing was opened, no one wished to speak, and the public portion was closed. Commissioner Smith commented that this was a long overdue amendment. Commissioner Walker congratulated the Staff on this proposal, feeling it reflected progressive thinking. Commissioner LaBelle agreed, discussed several of the points, and asked for reasoning behind the requirement that the reconstruction be commenced within one year of the date of damage. Mr. LaTourelle noted that in most cases if the owner intended to rebuild he would do -so immediately, but without the time limitation a person could hold a piece of property for 10-15 years and then decide to rebuild when it might then clearly be an affront to the neighborhood. The intent was to modify an existing single family dwelling and establish an insurance office there for the applicant and several other professional offices within the building. The applicant had proposed a contract rezone. to BN for office use as specified by Section 12.13.150(2) or residential uses as specified by Section 12.13.150(3). No retail sales would be allowed but mixed residential/office uses could be allowed. The site has no unique topographic or natural features. The Comprehensive Plan shows the general area to be commercial with RML around it.
