Mr. Tanaka said that he understood that the Planning Staff has distributed
copies of an opinion that came out recently from the State Supreme Court on
Parkridge vs. Seattle from their offices summarizing the case and that he
would like to call the Commission's attention to several aspects of this case.
This case involved.a development in Seattle which was a down zone case on Capi-
tol Hill. It was taken to the Supreme Court on a challenge. The Court seems
to indicate that in order for it to properly review actions of cities, it is
going to demand that there is a good discussion of the reasons for the decis-
ion. If the record is silent as to why a particular action is taken, the Court
will not uphold it. He asked the Commission to be sure and take ample.time to
delineate what findings of fact they make as regards to why an action should or
should not be taken. "It would be helpful to state your reasons why you are in
favor of it, likewise to state your reasons for being against it. When you
decide to rezone a property, it is particularly important that you specify the
changed conditions and address yourselves to the criteria which are applicable,
noting your specific reasons for the decision reached." Commissioner Hall
stated that it disturbs her to have to go into such elaborate details after the
decision has been made. Mr. Tanaka informed her that it was not.necessary to
reiterate,but to be sure that the reasons for the decisions of the Commission
are recorded.
Commissioner Goodhope noted that the City Council had made a favorable deci-
sion on the Lauri Ann Park properties. It is his feeling that this is too
controversial a matter regarding the narrowing of roads, etc. He stated that
he felt the Planning Commission and the City Council should get together on
matters of this controversial magnitude in the future.
Commissioner LaBelle inquired as to the status of Stan Kauffmann's requests to
place a tank near Laebugten Wharf. Noelle Charleson stated that we -are still
facing problems of a technical nature with this rezone. They have found that
the road, 76th, which becomes 75th is actually located on privately owned pro-
perty. The Community Development Department has requested a survey of the
site and it is hoped to have this problem resolved before this summer so that
we can eliminate the fire hazard on the wharf.

Commissioner LaBelle asked whether Councilwoman Katie Allen had anything she.
Wished to bring to the Commission's attention. She had nothing to.report at
this time. Commissioner LaBelle explained the procedures to be followed dur-
ing the meeting. .

Assistant City Planner Noelle Charleson stated that this was a
proposed subdivision north of 212th St. and east of 80th Ave. W.
The developer is planning to put in single family lots; however
the property is extremely wet and marshy. Due to drainage pro-
blems in the area, there is a possibility, of going PRD because
the owner is going to be required to put a substantial amount of
i fill in the area. She stated that the applicant was present to-
night and has agreed to withdraw from the agenda at this time
and resubmit a PRD application utilizing the west side of the
site. This plan is to come back to the commission at a later
j date for approval. The applicant stated that the marshy area
is going to be left intact.
