also that the front yard setback variance would be from a private easement which would
serve two other lots.
There was no comment from the audienc-z. It was moved by Mr. Luschen that variance
on the east line and north line at 7231 - 175th S.W. be granted as requested in File
No. V-271. The motion was seconded by Mr. Scott and carried.
V-272, R. C. Crum - Variance of 2' on the West line for garage at 324 - 3rd So. (RMH)
Affidavits of publication and posting presented. Mr. Crum was not present. It was
noted that the proposed garage would serve an apartment building, and would eliminate
three cars from street parking. Mr. Slabaugh stated that the steepness
of the site precluded maintaining the 5' rear yard requirement.
No one in the audience spoke on the variance. Mr. Blackbourn said that because of the
} unique topography, the Board was receptive. It was then moved by Mr. Scott, seconded

by Mr. Luschen, that variance requested in File No. V-272 be granted. Motion carried.
V-274 - William E. Giertz - Variance in lot area 3-lot subdivision on NW corner of

It was noted that the subdivision had been approved at the November 16th meeting of
the Planning Commission, but that because of the Planning Commission's requirement for
a dedication of 30' for street right-of-way, the lots had been left substandard in
area by about 900' each. In•their motion for approval, the Planning Commission had
recommended approval of a variance. It was moved by Mr. Luschen, seconded by Mr.
Scott, that variance requested in File No. V-274 be approved. Motion carried.

CU-267, Trygve Fiksdal - Cond. Use Permit for 50th apartment unit at 196th & Maplewood
Road (RML zone)
Affidavits of publication and poster presented. The applicant was not present. Mr.
Earl Johnson, 19221 - 88th W., felt that there should be consideration for adequate
play area and adequate parking and access for the building. It was explained that a
hearing on this Condominium apartment building had been held on October 19, 1966;that
the property was zoned for an apartment building, and that hearings were being
held
because it was a Condominium and therefore treated as a plat, allowing the City to
require full improvements of surrounding right-of-way, together with certain other
engineering requirements; and that this hearing was being held because of the provision
of the zoning ordinance which says that if 50% or more of the required land area for
an additional apartment unit is available, then that unit may be built subject to the
grant of a conditional use permit. Mr. Johnson was assured that there was adequate
parking and access, together with a central courtyard.
There was no further discussion, and it was moved by Mr. Scott, seconded by Mr.

spoke for or against the application. The application was reviewed, and it was then
moved by Mr. Luschen, seconded by Mr. Scott, that Conditional Use Permit for home
occupation of driving school be granted to Mr. Ray S. Pelling at 1041 Sprague St.
Motion carried.
