Logan described the property and the surrounding area. He said a year ago, tir. ?Mattison requested RtML zoning on this same property and it was approved by the Planning Commission. However, his request was later rejected by the Council. The property is surrounded on three sides by business and apartment zoning;. He stated the south line of the property lies within 100' of 196th Street S. 1.1. and the City has established a strip of apartment zoning generally 300' deep along 196th Street S. 14. He recommended that the application be approved. Mr. Mattison, 19003 80th W., said granting, of this application would not be detrimental ! to the value of adjoining property as his duplexes would be valued at about $40,000 each. ° He felt the need exists for duplex property and his propertv is close to service station, s shopping center, medical and dental clinic, and the library. I The public hearing was closed and the Commission discussed the various aspects of the request. Mr. Hayes made a motion that R-9-69 be approved because it lies in an area zoned ;for :apartments. The motion was seconded by fir. Gustayson and passed unanimously: The secretary was instructed to draft a Resolution to the City Council. j i P-1-67 'Talbot View" (Stan Bernhold) - Request for an extension of time for recordin!* of final plat (RS-20 zone) Mr. Logan said this was the second request for an extension of time. He said this plat initiated b neighboring. Court case was i was first approved in January of 1967, and a ur Y residents froze the plat development for about one year. He stated during 1968,.the City worked toward the establishment of a local improvement district for sewers in this area and these were installed durin'- 1969. He said had the plat been developed during these two years, the builder would have wasted considerable money to construct septic tanks which would have been used only a short time. He recommended the one-year exten- sion be allowed on the basis of these two delays. The public hearing; was opened; however, no one in the audience participated. The Commission reviewed the history of the zoning in the area and discussed the Platting' Ordinance which allows a two-year extension of approval. ttr. Brooks moved that P-1-67 be granted another one-year extension due to the year's loss i in getting action. This motion was seconded by 'Mr. !Maxwell. kFurther discussion concerning the Court action was made,,and tir. Murphy explained some i' of the legal questions involved. On a call for the question, the motion for arantina the extension was unanimously app. S-34-69 Satterwhite, Dallas- 2-lot subdivision - intersection of Driftwood Lane ana 9th Avenue N. (RS-12 Zone) tir. Logan described the two lots and their areas. lie said that the engineering require- ments call for an 18' dedication on the west side of 9th Avenue instead of 10' as shown on the Official Street trap. Because of the small street area involved, the increased request -was made. A special study by Reid -'Middleton & Associates showed that if an 18' right-of-way were dedicated, the west side could be alined better. The property would still have enough area for two legal lots. The dedication should be made within 90 days. The staff recommended approval on these conditions. Plo one participated from the audience. A motion was made by Mr. Dailey that S-34-69 be approved with the required street dedica- tion to be made within 90 days. The motion was seconded by Ir. Hayes and carried unani- mously.
