Mrs. Block indicated this application was in connection with the
previous Conditional Use Permit application. She said gas pumps are
allowed to be placed-15' from the road in the CG zone, but this is a
BN zone. She noted that many of the structures along the street are
not in conformance with setback requirements because they were built
prior to SR104 being constructed. Placement of the pumps 40' from
the right-of-way could make access to the pumps difficult and crowd
the use at the rear of the property. Only the canopy, which is up in
the air, would project into the setback. This layout had been approved, by
the Amenities Design Board with additional plantings being required.
Mrs. Block recommended approval. The public portion of the hearing was
opened.
Grant C. Maurer, the•applicant, felt the required setback ,would cause
a safety hazard -in driving and would therefore be detrimental to him
and to his customers. He said he planned to offer free holding tank
dumping at the -rear of the site and if he had, to set the pumps back
further he would have to eliminate that service. The public portion

Mr. Roy asked -to be excused from this hearing because of a potential
conflict of interest He left the rostrum but did not leave the Council
Chambers.. Mrs. Block displayed a vicinity sketch and site plan. She
showed slides of the property which indicated the distance between this
and the adjacent property. There is -an existing garage in the side yard
setback and the applicant proposed to build a bedroom over the garage.
Mrs. Block said the variance request did not appear to be detrimental to
the neighbors and would be generally in harmony with the Zoning Code, and
she recommended approval. The public portion of the hearing was then
opened.
Judith Aldridge, one of the applicants, said the large, flat roof had
caused expenses during the last few years because they could not keep it
from leaking. Architect Wade James had suggested a peaked roof be placed
over the flat roof, and Mrs. Aldridge said that was what they were proposing
to do. She said it would not be detrimental to the views .of neighbors
because the site is secluded by trees. She said her neighbor, Max Gellert,
had given his verbal approval. The•public portion of the hearing was
then closed. MR. HOVDE MOVED, SECONDED BY JiR. LERAAS, THAT V-20-77 BE
APPROVED AS IT WAS COMPATIBLE WITH THE NEIGHBORHOOD AND DID NOT APPEAR TO
BE DETRIMENTAL TO THE HEALTH, SAFETY, AND MORALS OF THE NEIGHBORHOOD.
