Dear Mr. Mills:
I have reviewed the above building permit application for the Planning Division and it
was found that the following information, corrections, or clarifications will need to be
addressed before review can continue:
Rear Setback:
1.It appears that the proposed new steps encroach into the 15 rear
setback. As a result, the steps are not allowed because, other than those structures
exempted, no structure may be located within a setback (ECDC 16.20.030,
21.90.020 and 21.90.150).
Likewise, the replacement of the existing deck may be subject to the Citys non-
conforming regulations (ECDC 17.40) if it encroaches into the rear setback.
Therefore, it is critical that you confirm the position of the existing deck relative
to the rear setback. If it does encroach, limited maintenance and repair can be
undertaken but wholesale replacement (including replacing the footers) would not
be allowed as-is and the replacement would have to meet the setback
requirements.
You may redline your existing plans or submit three copies of your updated site plan (one
reduced size) and two sets of any updated pages of the building plans.Please make all
submittals to a Development Services Permit Coordinator, Monday through Friday, 8:00
am to 4:30 pm, except on Wednesdays when we are closed for permit review. If you
