RE-ROOF AT 9304 234TH STREET SW
Dear Mr. Gilbert:
Thank you for submitting the elevation drawings showing the existing roof structure at 9304 234th Street
SW. Unfortunately, the drawings confirmed what I had suspected. Because the house encroaches
approximately 6.5’ into the 25’ street setback on the east, that portion of the house is considered to be
nonconforming. According to Section 17.40.020.D of the Edmonds Community Development Code
(ECDC), nonconforming buildings may be continued and maintained, and even altered, but only in
specific circumstances:
D. Maintenance and Alterations.
1. Ordinary maintenance and repair of a nonconforming building shall be permitted.
2. Alterations which otherwise conform to the provisions of the zoning ordinance, its site
development and bulk standards, and which do not expand any nonconforming aspect of the
building, shall be permitted.
3. Alterations required by law or the order of a public agency in order to meet health and safety
regulations shall be permitted.
In this case, the proposed re-roof would increase the nonconformity of the eastern portion of the structure
by adding additional space within the house (going from a flat to a vaulted ceiling) and by increasing the
pitch of the roof from 4:12 to 8:12. I realize that the re-roof would still be well under the 25’ height
requirement, but it is the proposed work in the nonconforming setback that is the issue.
Please resubmit plans for the re-roof that maintain the current location of the interior of the structure and
pitch of the roof, at least within that portion of the structure that is nonconforming. Practically, a like-for-
like replacement may be easier but that is up to you and the homeowner. Please make all submittals to a
Development Services Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm, except on
Wednesdays when we are closed for permit review. If you have any questions, please contact me at (425)
