ROOFTOP MECHANICAL AT 303 5TH AVENUE SOUTH
Dear Mr. Moeller:
Thank you for resubmitting the elevation drawings of 303 5th as requested. I see that the new
heat pump will extend above the 25’ elevation at the top of the tower but the new AC unit will be
below that elevation. As a result, I need you to confirm one additional item; how far is the new
heat pump set back from the street property line?
Per BD-2 zoning code, the maximum height for structures (buildings, HVAC units, etc.) is
usually 25’. However, in BD-2, structures may be built up to a maximum height of 30’ if they
are set back at least 15’ from the street. In this case, that 15’ setback would apply to both 5th and
Maple. If you can show that the heat pump meets the 15’ setback requirement as proposed, I
could approve the permit. If the heat pump as currently shown does not meet the 15’ setback
requirement, swapping the locations of the new AC unit and the heat pump may allow the
required 15’ setback to be met.
I apologize for the additional request but if the heat pump meets the 15’ setback, you can take
advantage of the extra 5’ in height and the unit could be approved. Make all submittals to a
Development Services Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm, except
on Wednesdays when we are closed for permit review. If you have any questions, please contact
