RE: PLAN REVIEW COMMENTS FOR PLAN CHECK # 2008-0933
DECK REPLACEMENT AT 715 ALDER STREET
Dear Mr. Gregg:
I have reviewed the above building permit application for the Planning Division and it
was found that the following information, corrections, or clarifications will need to be
addressed before review can continue:
1. Setbacks: It appears that an approximately 1 -foot portion of the landing and
stairs off the eastern deck encroach into the 5' side property line setback. It also
appears that the rear portion of the western deck encroaches into the 15' rear
property line setback. According to ECDC 16.20.040.0 (Porches and Decks):
Uncovered and unenclosed porches, steps, patios, and decks may project into a
required setback not more than one-third of the required setback or four feet,
whichever is less; provided, that they are no more than 30 inches above ground
level at any point. Since both sections in question are greater than 30 inches
above the ground, both portions of deck are considered nonconforming with
respect to City Code.
Nonconforming structures are regulated in ECDC 17.40. According to 17.40.020,
nonconforming structures may be continued and limited maintenance and repair
can occur on them as well. However, a nonconforming structure may not be
expanded nor entirely replaced except if it meets current zoning requirements. It
is understood that the decks are to be replaced like -for -like; however, since the
footings and decking system are to be replaced in their entirety, the work must
meet the current setback requirements.
You may redline your existing plans or submit three copies of your updated site plan (one
reduced size) and two sets of any updated pages of the building plans. Please make all
submittals to a Development Services Permit Coordinator, Monday through Friday, 8:00
am to 4:30 pm, except on Wednesdays when we are closed for permit review. If you
