Dear Kristin:
I have reviewed the above building permit applications for the Planning Division. Before I can sign off
on the permits, however, the following information needs to be clarified in a written response:
1. Please have your geotechnical engineer update the associated geotech report to make specific
reference to the requirements of Chapters 23.40 and 23.80 of the Edmonds Community
Development Code (ECDC). Unless otherwise provided, ECDC 23.40.280 requires a building
setback "of 15 feet from the edges of all critical area buffers or from the edges of all critical
areas, if no buffers are required." This distance would supersede the 10' side property line
setback required by the RS -12 zone. ECDC 23.80.070.A. I also identifies minimum buffer
requirements that must be applied unless the geotech report can specifically address how the
project satisfies the design standards of ECDC 23.80.070.A.3. If the geotech report
satisfactorily addresses the design standards in ECDC 23.80.070.A.3, development may occur
within the critical area/buffer and the underlying zoning setback would apply.
